Maynard and Ms. Peggy Maynard PO Box 3448 Topsail Beach, NC 28445 Dear Mr. and Mrs. Maynard: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.322 acres of wetlands or waters for the purpose of constructing the Trinity Pointe subdivision at Trinity Road and NC 54, as you described in your application dated 29 September 1998. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3101 and 3108. These certifications allow you to use Nationwide Permit Numbers 12 and 26 when the Corps of Engineers issues them. This approval is also valid for the Neuse River buffer rules (15A NCAC 2B .033). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. Conservation easements shall be recorded on the deeds for lots 2, 3, 4 and 5 to prevent future wetland fill. Lots shall be graded to direct site runoff into these areas for treatment. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Maynard Tract 401 Wetland Certification denial DWQ Project # 931020 WRES Project # 97131¢ Dear Mr. Dorney, We are responding to a letter written from your office to Mr. J.R. and Ms. Peggy Maynard on October 21, 1998 regarding denial of our 401 Wetland certification for the project. That letter expresses insufficient evidence to conclude that the project must be built as planned and recommends denial of the 401 certification application. In that letter you expressed the need for additional information on the project, as well as a response within a two-week timeframe. This letter is our written response. On September 14, 1998, we had a meeting on this project with the members of the Raleigh Regional Office including Ken Schuster, Annette Lucas and Steve Mitchell and our wetlands consultant, Nelson Paul. In that meeting we reviewed all alternatives for road crossings and wetlands disturbances. We indicated this project has already been redesigned more than twice to satisfy the Town of Cary's requirements and needs. From this meeting we made amendments to this plan. These included shifting Boulder River Trail south and completely out of the stream buffer area and minimizing the amount of fill in Folkner Creek Trail. Upon these amendments, the Raleigh Regional Office accepted our plan. The existing shape and drainage features of this 1.8 acre parcel require at least one stream crossing to develop this land efficiently and practically. We are proposing one perpendicular road stream crossing in the most practical place possible. The second road crossing has been shifted as far to the north as possible to stay out of the stream buffer. The Raleigh Regional Office agrees with both crossings as no other practical alternative. All lots within this proposed subdivision have been analyzed and can be constructed without impacting the 50 foot stream buffer with building pads. The owner will survey the stream buffer prior to start of construction and place temporary tree protection fencing along the buffers where disturbance might be questionable. I1-03-98 Please let us know if you need any additional information on this project. We are in the construction document review process with the 'T'own of Cary. They are not completely up to date as we are trying to work out wetlands and stream buffer issues. The Town has no further revisions to the plans pending a resolution to the stream buffer issue. Maynard Tract in Wake County for residential development. Insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H.0506 and 15A NCAC 2B .0233. Therefore, unless modifications of the proposal are made as described below, we will have to move toward denial of your 401 Certification as required by 15A NCAC 2H .0507(e) and will place this project on hold as incomplete until we receive this additional information. Until we receive additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your project on administrative hold. Please provide us with information supporting your position that states your project must be constructed as planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Specifically can you construct your proposed development on all lots without disturbing the 50-foot stream buffer? Several lots (notably numbers 28, 29, 18 and 19) do not appear to have enough room for home construction without impacting the buffer. Any documentation such as maps and narrative that you can supply to address alternative designs for your project may be helpful in our review of your 401 Certification. Please respond within two weeks of the date of this letter by sending a copy of this information to me. If we do not hear from you in two weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. The Trinity Road/Highway 54 intersection is located west of the Highway 54/1-40 interchange. 10a. The project impacts are intended to be covered by Nationwide Permit (NWP) 26 and NWP 12. Project impacts under NWP 26 consist of 0.322 acres and include 35 linear feet (LF) of stream impacts. Impacts under NWP 12 consist of 0.043 acres, which will be returned to pre-existing contours and revegetated. 12. The configuration of the lots and roads associated with the project is the product of meetings and discussions with state officials. The design is neccessary to accomplish the project purpose and takes into account regulations regarding planning issues enforced by the Town of Cary, wetland and water 401 General Certification rules of the State of North Carolina, Neuse River Buffer rules of the State of North Carolina and Nationwide Permits 26 and 12 managed by the US Army Corps of Engineers. Wetland fills will utilize excess material from the road grading. Fill material will be distributed in the areas indicated on the plans utilizing a bulldozer. Erosion control measures will be in place to protect adjacent areas. An excavator will be used to construct the utility crossing and sidecast material will be returned to the excavation. A bulldozer will be implemented, as needed, to return the area of the utility crossing to the pre-existing contours. 13. The project purpose is to develop the subject property for residential, single-family home development; efficiently, economically and for the greatest economic yield; considering environmental constraints of the site and regulatory allowances. 14. The site is planned as residential, single-family home, subdivision development. The site is diagonally traversed by a wetland/stream system that makes avoidance of wetlands and waters impossible in view of the project purpose. Wetland and water impacts have been minimized to the maximum extent possible by careful planning and by incorporating City and State officials in the planning process. The proposed project configuration is the result. DWQ indicated a willingness to consider this as a roadway crossing as allowed in the riparian buffer by the existing rules. This plan of action was endorsed by the Raleigh Regional Office Staff in attendance contingent upon review by John Dorney as part of the 401 permit request.
