After reviewing your application, we have dec ided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any ot her federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expir e when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you de scribed in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is .sold, the new owner must be given a copy of the Certification and appro val letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the f uture) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this app roval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a h earing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of A dministrative Hearings, P.O. No excavation is permitted, except for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does not authorize any excavation waterward of the approved alignment. 4) No marsh grass will be excavated and/or filled. 5) No excavated or fill material will be placed at any time, in any marsh or surrounding waters, outside of the alignment of the fill area indicated on the workplat(s). Any sewage discharge at the docking facility be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 7) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth, in the permit application. No other structures, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 8) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 9) The authorized structure and associated activity must not cause an unacceptable interference with navigation. 10) This permit does not authorize the interference with any existing or proposed Federal project, and, the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 11) All portions of any accessway crossing coastal wetlands must be elevated to a minimum of 3' above substrate level, measured to the bottom of the decking. 12) With the exception of the 150'x 6' pier crossing wetlands to access the dock, no decks or other structures are authorized for placement over wetlands. NOTE: An easement is required from the State Property Office prior to initiating construction. NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day operation of the facility to prevent sand blasting residue and/or other facility waste from entering the adjacent waters. Such discharge, either directly or indirectly, to adjacent waters could contravene State water quality standards, thereby violating State law. FIELD INVESTIGATION REPORT: Jarrett Bay Boatworks, LLC PAGE #2 9. NARRATIVE DESCRIPTION: The project site consists of a 27.67 acre site on the south side of State Road 1162 (Steel Tank Road), off of Highway 101. This is approximately 6.5 miles north of Beaufort, South of the Core Creek Bridge. The property fronts Core Creek to the west. In 1971, General Steel was issued Dredge and Fill Permit #414 to construct a barge basin into this property, 400' x 80'. In 1985, Morehead City Precast Company was issued State Permit #210-85 for the maintenance excavation of the basin. This company dealt with the manufacture and shipment of concrete and steel products. The current permit, #8-96, was issued to AWH Corporation/Hopeman Brothers for the same type of industry in 1996. This permit authorizes the maintenance excavation of the basin to -12' normal low water, and is set to expire on 12/31/99. It was transferred into the name of the new property owner, Jarrett Bay Boatworks, Inc. on 4/17/98. On 5/19/98, there was a one time change to permit conditions to allow for a change in method of dredging; a major modification was issued for the renovation of the facility into a boat manufacturing plant on 6/02/98; on 8/24/98, a Letter of Refinement was authorized to allow for the placement of 3 pilings adjacent to the rip rap to protect vessels during the staging process; after Hurricane Bonnie, the applicant recognized the need for a bumper system of sorts to protect vessels being staged for quick removal from the jagged iron bulkhead along the south side of the basin. Subsequently, the applicant applied for a Minor Modification to place pilings along this wall to keep the currents from pushing boats against it. This request is in process. The present request is for another modification to the permit to allow for the high ground expansion of the existing boat basin, and construction of a docking system in Core Creek. When the last application was reviewed, this tract was approximately 170 acres in size. The applicant has since subdivided the property, and sold the other portions. For the boat manufacturing facility which the 6/02/98 permit addressed, this 27.67 acre tract was retained. This is the portion of the property which had been utilized by previous occupants, and contains the buildings, etc., described in the 4/02/98 field report. The project site averages 6' above mean high water in elevation, and is primarily cleared. A previous occupant of the site has removed the top layer of soil from the cleared portion of the tract, and replaced it with a combination of sand and gravel, and compacted the surface for industrial traffic. Consequently, the entire cleared area is largely impervious. The property has an extensive ditch system draining to both Core and Eastman Creeks, lined by Groundsel Bush. Coastal wetlands border the property on the northwest side. The existing basin is approximately 300' x 100', and is stabilized by a steel sheetpile bulkhead to the south and east, and riprap to the north. There is an existing boat ramp on the southwest side of the basin extending into Core Creek. The applicant has constructed the smaller of the two travel lifts authorized under the last permit in the northeast corner of the basin. They have installed the wash down basin, placed pilings against the rip rap, and are currently renovating the main buildings. There are three manufacturing/office buildings on the site. Together these total 60,000 square feet of space. Asphalt parking is provided around the brick building on the north side of the property. There is an non-potable well and water tank existing for the purpose of fire prevention, A and an onsite wastewater system that is no longer functional. The waters of Core Creek are classified SA by the designated as Primary Nursery by the Division of M taking of shellfish for consumption, with occasional Land Use Plan classifies this area as Rural, with all a Concern classified as Conservation. The facility is currently utilizing an authorized temporary pump and haul system for their wastewater treatment. The Town of Beaufort has received a Community Development Block Grant (CDBG) from the Department of Commerce in the amount of $885,750 for an extension of the municipal sewer line out Highway 101 to the site. The applicant has supplied another $290,000 for the project. The town is in the process of obtaining the necessary permits for the project. These monies will also be used to extend the existing water line out Steel Tank Road from its current terminus on Highway 101. The facility is currently utilizing an approved existing well for its potable water supply. The applicant is proposing to increase the size of the boat basin in the south east corner by excavating into high ground 100' eastward, for a width of approximately 33'. There is a 200 ton travel lift authorized for this point in the basin. The applicant wishes to provide a safe area for the lift, and keep a larger portion of the main basin open for ingress and egress. The basin would be excavated to a depth of -7' nlw in the landward end, grading to -8.25' where it connects to the existing basin, which is authorized for a finished depth of -12' nlw. This basin has been recently maintained to water depths of approximately -7' at the landward end, -8' to -10' at the middle, and -12' at the end. The basin extension design has rounded landward corners to encourage flushing. The sides of the basin will be stabilized by 258' of steel or concrete sheetpile bulkhead. Approximately 1707 cubic yards of material will have to be excavated for the creation of this feature. Of this, approximately 956 square feet will be from below the high water contour. The basin is to be expanded by dragline and backhoe. Included in this request is a slight modification to the existing dredge authorization. The original application for excavation requested that the water depths be "stepped" down from the -7 minimum to the -12' maximum at increments. Without changing the excavation footprint or the amount of cubic yardage removed, the applicant is requesting to move the -7' to the end of the new basin extension, and grade consistently through the basin to the finished connecting water depth of -12' nlw. Because of the tendency for flushing to be reduced with each additional length and reduction in width of a basin, the Division of Water Quality requested a water quality model for the project site. Submitted with the application are the results of this model compiled and averaged for the months of June through August 13, 1998. An addendum is attached to the initial report to include the results of the September 03 and September 18 testing. Sampling is expected to continue through mid-October, and results submitted to the Division of Water Quality. In an abbreviated form, the results show that the marina basin and each ambient site met or exceeded the state requirements of 5 mg/l of dissolved oxygen on all sampled dates except July 02, 1998. On this date, each site resulted in DO levels below required. In addition to the basin expansion, the applicant is proposing to grade approximately 13,402 square feet of high ground area along the north side of the basin for an office and service building and associated parking. Twenty nine parking spaces are proposed for delineation on a stone surface. The service building will be approximately 100' x 28' in size, and will be surrounded with approximately 15,351 square feet of high ground open decking. There is a walkway proposed along the north side of the basin that is 10' in width for the 332' distance along the basin, with 4' over high ground, and 6' extending over the existing rip rap. The structure narrows to 6' as it extends 80' into the waters of Core Creek. At this point of land, there is a fuel dispensing facility proposed for the servicing of vessels manufactured or maintained. This feature is not for public use. At this same point of land, there is a 27' x 20' deck proposed on high ground at the edge of Core Creek, with a 12' x 6' accessway over water to connect to a proposed dock, addressed below. Lastly, the applicant proposes to construct nine (9) boat slips in Core Creek. The docking facility will have a main pier, 150' x 6', extending over mixed coastal wetlands from the deck around the office building. Access to the dock will also be available from the two areas addressed above. The dock itself is proposed for 200' in length and 6' in width, supporting nine (9) finger docks of 20' x 3'. The space between the finger docks is approximately 19', with lengths varying from 42' to 60'. There are nine (9) mooring pilings requested waterward of these fingers. The required setback from the AIWW in Core Creek is 80'. In order to meet this setback, the applicant has reduced the length of the proposed slips to the north to 42' as stated. Soundings at the waterward edge of the dock indicate approximately -10' at normal low water. The intent of the docking system is for in-water servicing of vessels and temporary dockage of vessels awaiting testing. 10. ANTICIPATED IMPACTS: As proposed, the project will incorporate approximately 14,700 square feet of open water Public Trust Area within Core Creek. Approximately 29,293 square feet of high ground area will be disturbed for the service building, parking lot, and 16,360 square feet of open decking. The total impervious area within the 75' estuarine shoreline, including the present gravel substrate, will be approximately 2.6%. Another 3,584 square feet of high ground will be excavated for the basin extension. The additional length of the basin can be expected to alter circulation patterns and affect flushing within the basin. Turbidity impacts can be expected during construction of the additional basin area and driving of the pilings for the dock system. The accessway from the service building to the main docking system will shade approximately 900 square feet of mixed coastal wetlands. It is expected that the business will employ 120 people initially, and 200 people within 5 years. September 28, 1998 T. PROJECT SUMMARY: Applicant proposes to expand the existing boat basin into high ground and to construct a docking facility in Core Creek for in-water maintenance and trial operation of manufactured vessels. FIELD INVESTIGATION REPORT: Jarrett Bay Boatworks, LLC PAGE #2 9. NARRATIVE DESCRIPTION: The project site consists of a 27.67 acre site on the south side of State Road 1162 (Steel Tank Road), off of Highway 101. This is approximately 6.5 miles north of Beaufort, South of the Core Creek Bridge. The property fronts Core Creek to the west. In 1971, General Steel was issued Dredge and Fill Permit #414 to construct a barge basin into this property, 400' x 80'. In 1985, Morehead City Precast Company was issued State Permit #210-85 for the maintenance excavation of the basin. This company dealt with the manufacture and shipment of concrete and steel products. The current permit, #8-96, was issued to AWH Corporation/Hopeman Brothers for the same type of industry in 1996. This permit authorizes the maintenance excavation of the basin to -12' normal low water, and is set to expire on 12/31/99. It was transferred into the name of the new property owner, Jarrett Bay Boatworks, Inc. on 4/17/98. On 5/19/98, there was a one time change to permit conditions to allow for a change in method of dredging; a major modification was issued for the renovation of the facility into a boat manufacturing plant on 6/02/98; on 8/24/98, a Letter of Refinement was authorized to allow for the placement of 3 pilings adjacent to the rip rap to protect vessels during the staging process; after Hurricane Bonnie, the applicant recognized the need for a bumper system of sorts to protect vessels being staged for quick removal from the jagged iron bulkhead along the south side of the basin. Subsequently, the applicant applied for a Minor Modification to place pilings along this wall to keep the currents from pushing boats against it. This request is in process. The present request is for another modification to the permit to allow for the high ground expansion of the existing boat basin, and construction of a docking system in Core Creek. When the last application was reviewed, this tract was approximately 170 acres in size. The applicant has since subdivided the property, and sold the other portions. For the boat manufacturing facility which the 6/02/98 permit addressed, this 27.67 acre tract was retained. This is the portion of the property which had been utilized by previous occupants, and contains the buildings, etc., described in the 4/02/98 field report. The project site averages 6' above mean high water in elevation, and is primarily cleared. A previous occupant of the site has removed the top layer of soil from the cleared portion of the tract, and replaced it with a combination of sand and gravel, and compacted the surface for industrial traffic. Consequently, the entire cleared area is largely impervious. The property has an extensive ditch system draining to both Core and Eastman Creeks, lined by Groundsel Bush. Coastal wetlands border the property on the northwest side. The existing basin is approximately 300' x 100', and is stabilized by a steel sheetpile bulkhead to the south and east, and riprap to the north. There is an existing boat ramp on the southwest side of the basin extending into Core Creek. The applicant has constructed the smaller of the two travel lifts authorized under the last permit in the northeast corner of the basin. They have installed the wash down basin, placed pilings against the rip rap, and are currently renovating the main buildings. There are three manufacturing/office buildings on the site. Together these total 60,000 square feet of space. Asphalt parking is provided around the brick building on the north side of the property. There is an non-potable well and water tank existing for the purpose of fire prevention, and an onsite wastewater system that is no longer functional. The waters of Core Creek are classified SA by the Division of Water Quality; the area is not designated as Primary Nursery by the Division of Marine Fisheries; the waters are closed to the taking of shellfish for consumption, with occasional conditional openings. The Carteret County Land Use Plan classifies this area as Rural, with all areas within CAMA Areas of Environmental Concern classified as Conservation. County zoning for this tract is Industrial Wholesale. The Division of Archives and History has determined that there is no resource of architectural, historical, or archaeological significance on the site (documentation on file). The facility is currently utilizing an authorized temporary pump and haul system for their wastewater treatment. The Town of Beaufort has received a Community Development Block Grant (CDBG) from the Department of Commerce in the amount of $885,750 for an extension of the municipal sewer line out Highway 101 to the site. The applicant has supplied another $290,000 for the project. The town is in the process of obtaining the necessary permits for the project. These monies will also be used to extend the existing water line out Steel Tank Road from its current terminus on Highway 101. The facility is currently utilizing an approved existing well for its potable water supply. The applicant is proposing to increase the size of the boat basin in the south east corner by excavating into high ground 100' eastward, for a width of approximately 33'. There is a 200 ton travel lift authorized for this point in the basin. The applicant wishes to provide a safe area for the lift, and keep a larger portion of the main basin open for ingress and egress. The basin would be excavated to a depth of -7 nlw in the landward end, grading to -8.25' where it connects to the existing basin, which is authorized for a finished depth of -12' nlw. This basin has been recently maintained to water depths of approximately -Tat the landward end, -8' to -10' at the middle, and -12' at the end. The basin extension design has rounded landward corners to encourage flushing. The sides of the basin will be stabilized by 258' of steel or concrete sheetpile bulkhead. Approximately 1707 cubic yards of material will have to be excavated for the creation of this feature. Of this, approximately 956 square feet will be from below the high water contour. The basin is to be expanded by dragline and backhoe. Included in this request is a slight modification to the existing dredge authorization. The original application for excavation requested that the water depths be "stepped" down from the -7' minimum to the -12' maximum at increments. Without changing the excavation footprint or the amount of cubic yardage removed, the applicant is requesting to move the -7' to the end of the new basin extension, and grade consistently through the basin to the finished connecting water depth of -12' nlw. Because of the tendency for flushing to be reduced with each additional length and reduction in width of a basin, the Division of Water Quality requested a water quality model for the project site. Submitted with the application are the results of this model compiled and averaged for the months of June through August 13, 1998. An addendum is attached to the initial report to include the results of the September 03 and September 18 testing. Sampling is expected to continue through mid-October, and results submitted to the Division of Water Quality. In an abbreviated form, the results show that the marina basin and each ambient site met or exceeded the state requirements of 5 mg/1 of dissolved oxygen on all sampled dates except July 02, 1998. On this date, each site resulted in DO levels below required. In addition to the basin expansion, the applicant is proposing to grade approximately 13,402 square feet of high ground area along the north side of the basin for an office and service building and associated parking. Twenty nine parking spaces are proposed for delineation on a stone surface. The service building will be approximately 100' x 28' in size, and will be surrounded with approximately 15,351 square feet of high ground open decking. There is a walkway proposed along the north side of the basin that is 10' in width for the 332' distance along the basin, with 4' over high ground, and 6' extending over the existing rip rap. The structure narrows to 6' as it extends 80' into the waters of Core Creek. At this point of land, there is a fuel dispensing facility proposed for the servicing of vessels manufactured or maintained. This feature is not for public use. At this same point of land, there is a 27' x 20' deck proposed on high ground at the edge of Core Creek, with a 12' x 6' accessway over water to connect to a proposed dock, addressed below. Lastly, the applicant proposes to construct nine (9) boat slips in Core Creek. The docking facility will have a main pier, 150'x 6, extending over mixed coastal wetlands from the deck around the office building. Access to the dock will also be available from the two areas addressed above. The dock itself is proposed for 200' in length and 6' in width, supporting nine (9) finger docks of 20'x 3'. The space between the finger docks is approximately 19', with lengths varying from 42' to 60'. There are nine (9) mooring pilings requested waterward of these fingers. The required setback from the AIWW in Core Creek is 80'. In order to meet this setback, the applicant has reduced the length of the proposed slips to the north to 42' as stated. Soundings at the waterward edge of the dock indicate approximately -10' at normal low water. The intent of the docking system is for in-water servicing of vessels and temporary dockage of vessels awaiting testing. 10. ANTICIPATED IMPACTS: As proposed, the project will incorporate approximately 14,700 square feet of open water Public Trust Area within Core Creek. Approximately 29,293 square feet of high ground area will be disturbed for the service building, parking lot, and 16,360 square feet of open decking. The total impervious area within the 75' estuarine shoreline, including the present gravel substrate, will be approximately 2.6%. Another 3,584 square feet of high ground will be excavated for the basin extension. The additional length of the basin can be expected to alter circulation patterns and affect flushing within the basin. Turbidity impacts can be expected during construction of the additional basin area and driving of the pilings for the dock system. The accessway from the service building to the main docking system will shade approximately 900 square feet of mixed coastal wetlands. SEP d 3 1998 September, 1 1998 Custom Sportfishermen CORE CREEK PROJECT CAMA PERMIT NARRATIVE On March 3e, 1998 Jarrett Bay Group, LLC purchased a 170.65 acre tract of land along the Core Creek stretch of the Intracoastal Waterway. This site is located South of Steel Tank Road (NCSR 1162) west of NC Hwy 101, approximately 6.5 miles North of the Town of Beaufort. The Core Creek site is ideal for commercial marine industry and offers almost unlimited potential relative to its size, existing high ground boat basin, proximity to the Intracoastal Waterway and existing buildings. Therefore, 142.98 Acres have been sold to facilitate the development of a Marine Industrial Park. Jarrett Bay Group, LLC retained 27.67 acres of the original land purchase for the purpose of expanding all boat manufacture and repair operations from its existing location in Marshallberg. This CAMA permit is a request for development around the existing high ground basin to service boats in the water, and stage large boats to haul onto the yard via a 200 ton Marine Travel Lift. Jarrett Bay Group, LLC will invest $ 3 million in both the purchase and cost of improvements to the Core Creek site. The Company will increase its boat building facility by an order of magnitude and repair operations will almost triple with a 20+ acre yard facility. Not only will the 68 employees in Marshallberg be retained, an additional 52 employees will be hired, Jarrett Bay Boatworks, Inc. (JBBW) will host a workforce of 120 at the Core Creek facility. If growth continues as expected, the workforce is anticipated to reach 200 within five years. The facility will provide a wide range of employment opportunities for the citizens of Carteret County. The Core Creek facility (26.67 AC +/-) hosts three manufacturing buildings that total 60,000 square feet. Each building will be completely renovated prior to relocation. Equipment to be purchased by JBBW includes a new 50 ton travel lift and a 200 ton travel lift that will haul extremely large vessels, including: tugs, barges, large yachts, Coast Guard vessels, and trawlers. The existing boat basin is 300' x 100' and can be dredged to 12' below mean low water, matching the depth of the adjoining Intracoastal Waterway. An existing CAMA Major Permit (#8-96, issued 1/17/96, expires 12/31/99) to dredge the high ground basin (4,500 cubic yards of material) has been transferred to Jarrett Bay Group, LLC. A major modification to Permit #8-96 has been secured (6/2/98) by Jarrett Bay Group, LLC and utilized to build piers for the 50 ton travel lift (presently in-service on the Core Creek facility). The CAMA Major Permit Application, attached to this narrative is for the construction of a travel lift bay (100' x 32') to service the 200 ton travel lift. This high ground expansion is considerably less expensive than constructing large piers with a marine contractor. The proposed high ground expansion will keep the basin area open and allow large boats (>100') to stage along the Southern bulkhead of the existing basin. The water quality implications of the proposed high ground expansion have been addressed by a consulting firm (Quaternary Environmental Consultants, Inc.) who are in the process of actively running the Dissolved Oxygen Marina Model and collecting water quality data. Outside of grading activities (13,402 SQ./FT) for the construction of a service store and parking lot, JBBW will not engage in any other land disturbing activities. Decking (15,351 SG./FT.) is proposed around the office/service building and a single pier will extend across vegetated marsh to access nine (9) boat slips. The site is situated on the Intracoastal Waterway in such a manner that all nine (9) slips extend waterward of the MHW line to 6' inside the 80' USACE set back (Ref. Map file 105-98-7, 4/14/98, AIWW NORBFT). The proposed slips will be utilized for service of vessels that do not need to be hauled on-shore, and for the purpose of vessel sea trial. The proposed location of the nine (9) boat slips is such that no new dredging is required and no wetland environments will be impacted. A proposed AST for Diesel fuel will be utilized to fuel vessels that Jarrett Bay Boatworks, Inc. service. The intent of all proposed improvements are to extend the service capabilities of our existing facility to the waters edge. The company is not interested in the pursuit of a marina type business that would typically service daily boaters. The intent of the proposed improvements are to service clients with large vessels (>50') that do not require a haul-out onto our yard facility. CDB GRANT APPROVAL The Core Creek facility was at one time served by an on-site well and septic system, but they no longer meet regulatory standards. To compensate for this, $1.25 million dollars of CDB grant funds will be spent to extend water and sewer service 6.5 miles from the Town of Beaufort, to the Core Creek site. At present this CDB Grant project has been awarded and engineering work has been completed. Construction on the utility extensions should commence in late spring.
