Independent Property Owners of America, LLC. Bio Report Page 2 PROJECT SETTING The applicant's property is at Mile Post 1, at the northern end of Virginia Dare Trail (NC 12), north of Fonck Street. The property lies between Virginia Dare Trail and the ocean, next to and including the Kitty Hawk Pier in the Town of Kitty Hawk and Southern Shores, in Dare County. According to the deed submitted the property consists of two parcels totaling 14.73 acres. Approximately 4.73 acres are on the west side of NC12 in Southern Shores and will remain undeveloped at this time, the remaining 10 acres are on the east side of NC12 and are in two corporate limits (2.9 acres in the Town of Southern Shores and 7.1 acres in the Town of Kitty Haw). The CAMA Land Use Plans for the two communities classify the property as commercial/business except approximately 1.45 acres that falls within the Ocean Hazard Area of Environmental Concern, and are classified as conservation. According to the Erosion Rate Maps the property has an erosion rate of 2 feet per years, for a large structure setback of 120' and an Area of Environmental Concern of 155' measured from the First Line of Stable Natural Vegetation. Vegetation on the property includes, but is not limited to, American Beach Grass Ammophila breviligulat, Sea-oats Uniola paniculata and Panicum spp. Soil types on the property include Newhan fine sands and Beaches-Newhan complex. No coastal or freshwater wetlands are on the project site. The property is in an unnumbered VE Zone and an AO Zone and has an average elevation of approximately 12.5' above mean high water. Structures on the property include an access road two parking lots a fishing pier and pier house, an abandoned retail store, and two ocean front bulkheads. One bulkhead is an average of 27' seaward of the First Line of Stable Natural Vegetation (FLSNV), and the second is 100' landward of FLSNV. Total existing impervious surface on the project site is approximately 63,669 square feet. PROJECT DESCRIPTION The applicant, Independent Property Owners of America, LLC., requests a CAMA Major Permit to construct a five-story (142 room) hotel with a restaurant, 280 parking spaces, a storm water retention pond, swimming pool, beach access, gazebo, waste water treatment facility, and associated infrastructure. Site preparation of the property will include the removal of all existing concrete and asphalt on site, fill and grading. Total land disturbing activity will involve approximately 8.83 acres and include a small ingress egress outside the applicant's property and the Ocean Hazard AEC. Bio Report Page 3 Impervious surfaces on the site will include .2 acres in the Town of Southern Shores and 5.4 acres in the Town of Kitty Hawk totaling of approximately 5.6 acres. The hotel will be constructed landward of the large structure setback except for a 25'x 74' section of open wooden deck and a small 14'x 13' gazebo. Included in the plan is a six-foot wide pedestrian beach access, a 20'x 20' platform with a handicap ramp to the beach. The existing bulkheads/retaining walls are seaward of the proposed hotel, the applicant would like to keep both and build the beach access over the walls (average height approximately 2'), resulting in the platform terminating approximately 26' seaward of the FLSNV. All existing concrete drives and parking spaces located west and south of the existing fishing pier will be removed and replaced with a larger paved parking lot. The parking lot located west of the pier house is within the minimum setback, and will be enlarged and include a pavement within the setback, in an area that is currently sandy beach. The removal of the existing concrete surfaces south of the pier will not be replaced within the setback or Ocean Hazard AEC, resulting in total reduction of impervious surface within the AEC by approximately 1,425 square feet. Development plans call for two fire lanes on the seaward side of the hotel. The lanes will be completely within the AEC, with approximately 1,024 square feet within the large structure setback. Construction will include the placement of 12' wide geoweb mats approximately twelve inches below the surface of the sand at finished grade. Approximately 3,300 square feet of the hotel will also be within the Ocean Hazard AEC. ANTICIPATED EWPACTS 1) Decrease in impervious surface within the Ocean Hazard AEC. 2) Increased in overall impervious surfaces on the property. 3) Increased density. 4) Structure placement seaward of the First Line of Stable Natural Vegetation. 5) Net loss of indigenous vegetation. 6) Increased elevation of the tract. If more space is needed, please attach additional pages. see attachment PROJECT .ounty Dare Attachment 3D Independent Property Operators of America, LLC The proposed construction sequence for the Kitty Hawk Ocean Suites will involve the commencement of work in November of 1998 and be concluded in the Spring of the year 2000. The proposed sequence involves the following: • Fall 1998 1. Remove or abandon existing water line and above ground utilities and re- route the utilities to accommodate the proposed development 2. Fill the site to 16.5 feet and rough construct the storm water retention areas. This disturbed area will be stabilized according to the Erosion Sedimentation Control Plan issued by the Town of Kitty Hawk. 3. The fill will be allowed to settle until construction begins • April 1999 1. Set pilings for building construction, pour concrete caps, grade for parking and pour slab for hotel construction. 2. Re-shape storm retention ponds and final grade for parking for construction to be completed in Spring of year 2000. 3. Existing concrete building on site will be used for construction office until removal in the winter of 1999. 4. Pier house will be re-sided and awnings will be placed on the pier house which constitutes less than 50% of the value of the structure.
