This office has reviewed the subject erosion and sedimentation control plan. We find the plan to be
acceptable with modifications and hereby issue this letter of Approval with Modifications. The
Modifications Required for Approval are listed on the attached page.This plan approval shall expire three
(3)years following the date of approval,if no land-disturbing activity has been undertaken, as is required
by Title 15A NCAC 4B .0129.
As of April 1, 2019, all new construction activities are required to complete and submit an electronic
Notice of Intent (NOI) form requesting a Certificate of Coverage (COC) under. the NCG010000
Construction Stormwater General Permit. This form MUST be submitted prior to the commencement of
any land disturbing activity on the above named project. The NOI form may be accessed at
deq.nc.gov/NCGOI. Please direct questions about the NOI form to Annette Lucas at =
Annette.lucas@ncdenr.gov or Paul Clark at Paul.clark@ncdenr.gov. After you submit a complete and
correct NOI Form, a COC will be emailed to you within three business days. A$100 fee will be charged
annually. This fee is to be sent to the DEMLR Stormwater Central Office staff in Raleigh.
Title 15A NCAC 413 .0118(a)and the NCGO1 permit require that the following documentation be kept on
file at the job site:

1. The approved E&SC plan as well as any approved deviation.
2. The NCGO1 permit and the COC, once it is received.
3. Records of inspections made during the previous 30 days.
Also,this letter gives the notice required by G.S. 113A-61.1(a)of our right of periodic inspection to insure
compliance with the approved plan.
North Carolina's Sedimentation Pollution Control Act is performance-oriented, requiring protection.of
existing natural resources and adjoining properties. If, following the commencement of this project, the
erosion and sedimentation control plan is inadequate to meet the requirements of the Sedimentation
Pollution Control Act of 1973 (North Carolina General Statute 113A-51 through 66), this office may
require revisions to the plan and implementation of the revisions to insure compliance with the Act.
Acceptance and approval of this plan is conditioned upon your compliance with Federal and State water
quality laws,regulations, and rules. In addition, local city or county ordinances or rules may also apply to
this land-disturbing activity. This approval does not supersede any other permit or approval.
Please note that this approval is based in part on the accuracy of the information provided in the Financial
Responsibility Form, which you provided. You are requested to file an amended form if there is any
change in the.information included on the form. In addition, it would be helpful if you notify this office
of the proposed starting date for this project. Please notify us if you plan to have a preconstruction
conference.

MODIFICATIONS REQUIRED FOR APPROVAL
Project Name: Roadside Truck Plaza Grading Plan
Project ID: CLEVE-2020-007

Modifications pursuant to applicable North Carolina General Statutes and/or Regulations:
1. This plan approval is mostly for.clearing and grubbing and the rough grading for building pads only.
2. The contractor should maintain the berms on the top of pads on daily basis. Runoff from the building
pads and other relatively level areas should not be allowed to sheet flow over fill slopes. The
construction sequence should include requirements to maintain diversions along the top of fill slopes
and slope drains during the fill placement process. These measures should remain in place until the fill
slopes have been adequately stabilized with established vegetation. [G.S. 113A-57(2)].
3. All slopes should be stabilized with matting and specially Slopes over 50 feet in length,perimeter dikes,
swales, ditches, and all slopes steeper than 3:1 require stabilization within 7 days. [G.S. 143-215.1].
4. The stabilized emergency spillway for each basin should extend down the downgradient
slope to level ground. [G.S. 113A-57(3)].
5. Construction entrance must contain at least 2-3 inch stone, 100 feet length and be maintained
in a condition that will prevent tracking or direct flow of mud onto streets. Periodic
topdressing with stone will be necessary.Install water bars,ditch diversions or other suitable
measure so that stormwater does not leave the limits of disturbance through the construction
entrances as needed. Detail of construction entrance shows only 50 feet. [G.S. 113A-57(3),
15A NCAC 4B .0105].
6. Any off-site borrow and waste required for this project must come from a site with an
approved erosion control plan, a site regulated under the Mining Act of 1971, or a landfill
regulated by the Division of Solid Waste Management.. Trash/debris from demolition _
activities or generated by any activities on site must be disposed of at a facility regulated by
the Division of Solid Waste Management or per Division of Solid Waste Management or
Division of Water Resources rules and regulations. [15A NCAC 4B .0110].
7. This erosion and sediment control(ESC)plan received numerous comments during several
iterations of ESC plan submittals. Adjustments to this ESC plan are expected to occur,

based on field conditions, to ensure compliance with accepted erosion and sedimentation
control design standards, the NPDES General Construction Stormwater Permit, and the
North Carolina Erosion and Sediment Control Planning and Design Manual. [15A NCAC
4B .0115, G.S. 143-215.1,NCGO10000].
8. Additional measures may be required - The applicant. is responsible for the control of
sediment on-site. If the approved erosion and sedimentation control measures prove
insufficient,the applicant must take those additional steps necessary to stop sediment from
leaving this site. [15A NCAC 4B .0115].
