Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.), and Sections 401 and 404 of the Clean Water Act (as amended). The applicant proposes to provide infrastructure to a 91-site single-family home development in the vicinity of an un-named tributary of Pasture Branch Swamp, near Vander. Street and utility crossings, driveways, and lot fill will impact 0.28 AC of forested wetlands. The largest of three impact areas is 0.23 AC. Overall project size is 40 +/- AC. Direct impacts to 701inear feet of stream will result from the project. The applicant does not propose to mitigate the impacts to forested wetlands or streams other than to minimize impacts. We recommend the following: 1. The plan includes the use of culvert pipe for stream crossings. We recommend the use of bridges for all stream crossings and associated wetlands to eliminate the need to fill and culvert, where practicable. If culverts must be used, the culvert should be designed to allow the passage of aquatic organisms. Generally, this means that the culvert is buried at least one foot below the natural streambed. The directional bore stream crossing method should be used for utility crossings wherever practicable. 3. Stream crossings should be near perpendicular to stream flow. The NCWRC does not object to the issuance of permits for this project provided the permits are conditioned on our comments above.
