On September 11, 1998, I met with you to conduct an evaluation of the water feature present on this tract of land. This project has been assigned the reference number NBR-RRO 074. As a result of w the site visit, it was determined that the water body present is subject to the Neuse Buffer Rules: ",Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233. x As I explained the Neuse River Riparian Buffer Rules state the following: ° F A d t d 'n accordance with Sub- 0- .0233-Existing riparian areas shall be protect,, an mam ame 1 Items (3)(a)-(e) of this Rule on all sides of surface waters in the Neuse River Basin and protected in two zones." (a) "Zone 1 is intended to be undisturbed forest....Zone 1 begins at the upper edge of the active channel of the water body or the mean high water line and extends landward a distance of 30 feet, measured horizontally on a line perpendicular to the waterbody.. Forest vegetation of any width that exists in Zone 1 on the effective date of this Rule must be preserved and maintained." (b) "Zone .2 begins at the outer edge of Zone 1 and extends landward a minimum of 20 feet as measured horizontally on a line perpendicular to the waterbody. The combined minimum width of Zones 1 and 2 shall be 50 feet on all sides of the waterbody. In short, the timber within the first ten feet of the creek can not be harvested. Within the outer twenty feet of Zone 1 , limited removal of individual trees is allowed provided that the basal area of 75 square feet per acre measured every 100 feet along the length of the stream is maintained. (See Page 4-9 and Chapter 6 of the attached Guidance Manual). Zone 2 can be harvested provided that the ground disturbance is limited. When the Department of Transportation has finalized the plans for the by-pass and it becomes apparent that timber that was afforded protection under the Neuse Riparian Buffer Rules will be removed by the project, please provide this Office with the information necessary and will proceed with a variance that will allow the harvest of that timber.
