This project is referenced by the Raleigh Regional Office as NBR RRO-065. The original letter sent to you stated that the unnamed tributary (UT) Turkey Creek was an intermittent stream and therefore subject to the Neuse River I Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233). As per your request of September 14, this letter is being written to establish the point that the t buffer protection begins. As indicated on the attached map, the buffer protection begins below the intended project and the feature located within the project boundary is y ephemeral or storm water derived and not subject the Neuse Buffer Rules.. AVtn: Matt Dana 3715 University Drive Durham, NC 27707-2639 919-490-2999 (office) 919-490-6165 (fax) Re: hinder Care Site, Cary, Wake County, NC c???y Dear Sir: Neuse River Buffo Evaluation In July 1998, the property was traversed to determine any potential "surface waters" subject to the Neuse River Basin Nutrient Sensitive Waters Management Strateuv rules for the protection and lnairtte mce of riparian a with existing "forest vegetation" 05A NCA 213 .02331. Neuse River Buffers: The property contains possible "surface waters" subject to the "Neuse River Basin Nutrient Sensitive Waters Management Strategy rules protecting existing riparian areas" (see attached sketch map). We believe that the channel feature denoted on the attached sketch map is ephemerally (i.e., stormwater) driven and therefore may not be subject to the Neuse River Buffers. An "intermittent stream" is shown to originate within this drainage cn the most recent version of the Cary, N.C. USGS topographic quadrangle and USDA Wake Couaty Soil Survey. Although the channel feature contains some of the stream characteristics used by the N.C. Division of Water Quality (DWQ), we believe that the intermittent stream historically started at the point indicated on the attached sketch map (located off the property). The stream characteristics observed appear to be caused by the stortnwater entering the property from the adjacent roads and businesses. Due to the marginal nature of this channel feature, we recommend that a site visit be conducted with the DWQ to determine its classification. As per our previous phone conversations, a sine visit will be scheduled with the DWQ to review the site for compliance with the Neuse River Buffer Rules. It may be possible to conduct this site visit on 8/4/98. A report-of the DWQ determination will be sent after this site visit is conduete& Neuse River Buffer Rules The Neuse River Buffer rules, which came into effect on 7/22/97, protect up to 50 feet from the edge of existing .'surface waters" (intermittent streams, perennW streams, lakes, ponds and estuari es) found within the Neuse River Basin. The 50-foot buffer basically consists of two zones The first none is measured 30 fed landward from the top bank of intermittent streams and ponds and intended to contain an Undisturbed-forested area. The second zone is measured 20 feet from the edge of the first zone and is intended to contain a vegetated buffer. Removal of grass clippings, timber, etc. is allowed on a periodic basis within the second zone. Exceptions to the rules allow for road crossings and utilities where "no [other) practicable alternative exists". SdtEC will be glad to discuss these new rules, as well as any other wetland regulations, with you. As per our previous phone conversation, it appears that it may be possible to obtain a variance through the Eavircameatal Management Commission (EMC) from the buffers since this lot was `sphrued and recorded" prior to 7/22/97 (the effective date of the rules). This option can be taken if the DWQ determines that the channel feature is subject to the buffers and your client is unable to redesign the project to accommodate for them. If you choose to have us perform additional work, the following is a listing of additional services: (1) Request that the DWQ review the site for compliance with the Neuse River Buffer rules, (2) Aid in a request for a variance from the rules through the EMC, and (3) Notification to the Corps and DWQ regarding impacts to wetlands and permitting issues. This additional work can be completed at an hourly rate of $65.00/hour or a new proposal can be generated. Please advise. Please call if you need further explanation.
