On August 10 1998, I met with you at the subject property to conduct a site visit for the
4 ., above referenced project. This project is referenced by the Raleigh Regional Office as NBR RRO-
- 3 * '° -x!069. At your request, an evaluation was performed to determine if the feature (as indicated by the
k Alue line on the attached map) would require compliance with the Neuse River Basin: Nutrient
`sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas,
Administrative Code T15A:02B.0233 (NCAC 0233).
As a result, it was determined that the unnamed tributary (UT) is an intermittent stream and
' herefore is subject to the Neuse Buffer Rules. This point is located between 0-7 and 0-8 at L111,
r' ,T 3 d begins at the point on the map shown in red. These Rules require a fifty foot riparian buffer
k?lon streams
lv, g determined to be intermittent or perennial. Above this point, the stream is ephemeral
or stonmwater derived and not subject to protection under this Rule.

Attached you will find the Trinity Point map. With the N3R call made, the road had to be
relocated up and into lots 8 and 9. They had already lost lots 18, 19, 28, 29, 33 34, and 44.
Portions of lots 3, 4, 5, 17, 22, 23, 24, 31, and 32. To facilitate this, I proposed that they pursue
the road as a crossing of the upper end of the buffer. If it makes it any easier, I could just move
the N13R call downstream 10 feet. This water body begins in a seep area that, in years past, cattle
excavated into a wetland area, and this eventually becomes intermittent.

Dear Nelson:
Thank you for taking the time to meet with members of the Raleigh Regional Office and Withers & Ravenel
to discuss the above referenced project in further detail. As a result of this meeting with NCDENR Raleigh
Regional Staff Members Ken Schuster, Steve Mitchell and Annette Lucas, it was determined that we need
to amend our subdivision plan with the wetlands impacts and Neuse River riparian buffer areas shown and
submit this information to Mr. John Dorney of the Division of Water Quality. The Raleigh Regional Staff
Members supported our position that the Faulconer Creek Trail roadway location be kept as shown on the
attached plan. This would be done in conjunction with other revisions that are incorporated in the attached
plan. DWQ indicated a willingness to consider this as a roadway crossing as allowed in the riparian buffer
by the existing rules. This plan of action was endorsed by the Raleigh Regional Office Staff in attendance
contingent upon review by John Dorney as part of the 401 permit request.
We therefore are requesting that you complete the required wetlands permit applications for this project and
submit a copy of this letter so that we may proceed with the permitting for this project.
We will also be providing copies of this letter and site plan to the Raleigh Regional Office Staff. We will
request that they contact us with any questions or discrepancies they note with any information contained
in this letter.

or have any questions.
