REQUEST FOR MORE INFORMATION
Dear Mr. Allen:
On February 22, 2005, the. Divisign of Water Quality (DWQ) received your application dated
February 14, 2005 to impact 0.47 acres of wetlands and 70. feet of streams to construct the
proposed residential lots. The DWQ has determined that your application was incomplete andlor
provided inaccurate information as discussed below. The DWQ will require additional
information in order to process your application to impact protected wetlands and/or streams on
the subject property. Therefore, unless we receive the additional information requested below,
we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and
will place this project on hold as incomplete until we receive this additional information. Please
provide the following information so that we may continue to review your project.
Additional Information Requested:
1. Plan Details
a. Please show all stream impacts including all fill slopes, dissipaters, culverts and bank
stabilization at 1"=50 feet on the site plan.
b. Please provide cross section details showing the provisions for aquatic life passage.
c. Please show the footprint of the proposed house and driveway to lots number 1, 7, 41
as these lots do not appear buildable without additional wetland impacts. If additional
impacts will be required, these impacts must be included in your project description
and PCN form.
d. It is unclear if the impacts concerning the utilities are existing or proposed. Some
areas within the wetlands to the north show impacts and some do not, please give
additional information regarding these areas.
e. Please describe whether the Corps of Engineers has determined if the existing ditch
near lots 75, 76, 84, 90 and 91 is jurisdictional and subject to 404 Permitting.

f. Please discuss why the utility impact near lots 26-29 cannot be temporary impact
rather than permanent fill.
g. Please discuss whether the wetland near lots 26-29 has any characteristics of a stream
rather than a wetland.
2. Impact Justification (Avoidance and Minimization)
This Office believes that the impact labeled on the plans as #3 can be moved or
reconfigured to avoid the impacts to the wetlands. Please revise the plans to avoid the
impacts.
Please respond within three weeks of the date of this letter by sending this information to me in
writing and Ken Averitte of the DWQ Fayetteville Regional Office. If we do not hear from you
within three weeks, we will assume that you no longer want to pursue this project and we will
consider the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands,
waters or protected buffers. Please be aware that any impacts requested within your application
are not authorized (at this time) by the DWQ. Please call Ms. Cyndi Karoly or Mr.. John Dorney
