As stated by Mr. Standridge, the removal of the rip -rap from the streambed is considered adequate and any
additional rip -rap can remain until the approved plan is completed. Pease feel free to coordination with me

Thank you for your reply. This is exactly what I needed to know and your email below satisfies the restoration plan
requirement.
The main issue was the rip -rap within the streambed and it appears that the majority of that has been removed.
Therefore, we (Corps of Engineers) are fine with the rip -rap remaining along the stream bank until the approved
plan is completed. Please notify us once the project is completed. Please give me a call if you would like to discuss
further.

Mr. Standridge and Mr. Scarbraugh,
We will respond formally within 30 Days of your 17 October E-mail but I'd like to set up a call to make sure I
understand your expectations and what flexibility we may have.
When your last e-mail was passed along to The City through Hazen and Sawyer, we anticipated construction of the
approved project to start within a few weeks. To be clear, the approved plan is the one that will be completed. The
project was awarded in February but the contractor had some delays which has prevented mobilization.
Unfortunately, construction of the approved plan has still not started. We have received submittals from the
Contractor and we are working on nailing down a start date. I do expect to start in the near future but I'm not sure if
I will have a project timeline within the next two weeks. I will attempt to provide a project timeline along with my
formal response if one is available.
The rip rap in question was intended as a temporary emergency measure because the bank degradation was
increasing at such a rate that we were concerned that the entire road would collapse prior to the start of the approved
project. If the road collapsed, neighborhood access would be cut off. We removed most of the Rip Rap that has
settled into the stream bed. I desire to leave the current rip rap on the stream bank until the start of the project, at
which time the project will be completed in accordance with the approved plans. I've attached two pictures of the
site; one from June and one from today. If you are passing through Havelock, please get in touch with me and we
can walk the ground. I'd like to discuss the site and ensure I understand your short term and long term
requirements. I'm sure we will have an acceptable site after completion of the approved project, but getting to the
end without losing the road in the near term is my dilemma.

Mr. Bottorff,
Back on June 3, 2019 I sent an email (attached) regarding a compliance issue for the Caps Branch stabilization
project located at the intersection of Oakwood Drive and Hwy 70. During a compliance inspection on May 29, 2019
we found that Caps Branch had been completely filled with rip-rap(pictures attached), which is not what was
authorized by the Corps of Engineers (see attached site plan). I have yet to receive a response/plan that will bring
this site into compliance. Please provide the requested restoration plan within 30 days of this email.

Hazen is working with the City to address the riprap issue. We apologize for the delay. We did not realize until late
