Tobaccoville, NC 27050 Subject: Notice of Violation — (NOV-2019-PC-0700) Site #: WT002816 Oils, Deleterious Substances, and Other Stream Standard Violations PIN #: 597283205 - (1070 Gunsmoke Rd.) Stokes County Ms. Jorgensen: On October 17, 2019, Justin Henderson, staff person of the Division of Water Resources Winston- Salem Regional Office, conducted a complaint investigation at the subject property location. The site visit was prompted by a complaint that a sediment discharge had occurred to Little Yadkin River, as a result of grading activities that had been conducted at the subject site. Observation of the subject site revealed that sediment had been pushed into Little Yadkin River in an attempt to create a river access at the subject property. The Little Yadkin River is currently classified as Water Supply IV -High Developed Waters (WS-IV) of the Yadkin Pee -Dee River Basin. Please be aware that a sediment discharge to the State's surface waters, constitutes a violation of the following North Carolina water quality standard(s): 1) Other Waste Violations- The deposition of solids to surface waters is a violation of 15A NCAC 02B .0211 (12) which states: "Oils, deleterious substances, colored, or other wastes: only such amounts as shall not render the waters injurious to public health, secondary recreation, or to aquatic life and wildlife, or adversely affect the palatability of fish, aesthetic quality, or impair the waters for any designated uses. For the purpose of implementing this Rule, oils, deleterious substances, colored, or other wastes shall include substances that cause a film or sheen upon or discoloration of the surface of the water or adjoining shorelines pursuant to 40 CFR 110.3 (a)-(b) which are hereby incorporated by reference including any subsequent amendments and additions. B) Remove all sediment that was discharged into the Little Yadkin River. The streambank and streambed shall not be impacted during the sediment removal. It should be noted that this violation, and any future violations, could be subject to a civil penalty assessment of up to $25,000 per day, per each violation. A follow-up site investigation is planned to be conducted, within the next 15-days. Your cooperation in this matter is appreciated.
