You have our approval, to place 0.0036 acres of temporary fill for a temporary road crossing, as
you described in your application dated August 27, 1998. After reviewing your application, we have
decided that this project is covered by the Neuse River buffer rules (15A NCAC 2B .0233). In addition, you
should get any other federal, state or local permits before you go ahead with your project including (but not
limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply
Watershed regulations. The fill must be removed upon project completion and the disturbed buffer
replanted with native tree species.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and send us a new application. If the property is sold, the new
owner must be given a copy of this approval letter and is thereby responsible for complying with all
conditions.
If you do not accept any of the conditions of this approval, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, NC 276 1 1-7447. This approval and its conditions are
final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Neuse River buffer

The purpose of this letter is to request an exemption from the Neuse River Riparian Buffer rules
for the construction of a temporary access road located off Delta Lake Drive, Raleigh, North
Carolina. The temporary access road will cross a tributary of Turkey Creek shown as an
"intermittent stream" on the most recent version of the Raleigh West, NC USGS topographic
quadrangle. Once the need for the access road has expired, it will be removed and the channel and
surrounding area restored as close as possible to its original condition.
Mr. Steve Mitchell is familiar with the project and has discussed the project with Mr. Ken Bailey
of Arland Community Development and myself.

contact us so someone from our company can accompany you. The parties involved are ready to
begin construction immediately. We would greatly appreciate a timely review of this application.

property (for Nationwide Permit numbers 14, 18, 21, 26, 29 and 38). All streams
(intermittent and permanent) on the property must be shown on the map. Map scales
should be 1 inch equals 50 feet or 1 inch equals 100 feet or their equivalent.
b. If available, representative photograph of wetlands to be impacted by project.
C. If delineation was performed by a consultant, include all data sheets relevant to the
placement of the delineation line.
d. Attach a copy of the stormwater management plan, if required.

NOTE: Wetlands or Waters of the U.S. may not be impacted prior to:

The purpose of this letter is to request the use of Nationwide Permit 26 for the construction of a
temporary road crossing and permanent lot fill for the development of Delta Ridge Subdivision
located on Delta Lake Drive, Raleigh. North Carolina (see attached site vicinity map). The
impacts will effect two tributaries of Turkey Creek and their adjoining wetlands. Impacts to
wetlands and waters total 0.0476 acres and 252 1.1 respectively (200 feet of which was
determined as not containing "significant aquatic function" during our site meeting held in
October 1997; the remaining 52 feet was not thoroughly reviewed for "significance").
Construction of the subdivision will comply with all the general conditions stated within
Nationwide Permit 26.
Attached are the completed PCN Form, Agent Authorization Form, Site Plans (showing proposed
wetland impacts), Corps Notification Letter, Neuse River Buffer Exemption Approval Letter from
the N.C. DWQ, and Wetland Delineation Forms.

My client is proposing to impact a small portion of the Neuse River Riparian Buffers for
the construction of a temporary access road The temporary clearing limits are shown on
the attached erosion control plan A 48" corrugated metal pipe will be placed in the
natural channel, fill suitable for heavy vehicle traffic will be place over the pipe and the
side slopes will be armored with class 1 or greater rip-rap Once the need for the access
road has expired, it will be removed and the channel and surrounding area restored as
close as possible to its original condition. All other conditions stated within the Neuse
River Buffer rules (15A NCAC 2B .0233) will be followed.
13. Purpose of proposed work: (Sheet 2) To develop three single family home lots. (Sheet 3) To
gain access to a portion of the property located on the north side of the "intermittent
stream" for the use of disposing extra rock and spoil acquired during grading activities
occurring on other tracts of land within the site.
14. Stat,• reasons wily it is believed that this activity must be carried out in wetlands (include any
measures taken to minimize wetland impacts): (Sheet 2) Required for the development of the
three lots as depicted on the original site plan. (Sheet 3) The portion of the property
proposed for the disposal of the extra rock and spoil is the most practicable location on
the site for this activity. Unfortunately, due to its isolation it will be necessary to cross the
"intermittent stream" We believe that the temporary crossing method that my client has
devised will minimized the wetland and Neuse River Buffer impacts to the greatest extent
practicable while still being able to complete the necessary activity.
