After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: The applicant would like to construct 275' of replacement bulkhead adjacent her property in Southern Shores along Jean Guite Creek (also referenced as Gin Guite Creek) and 590 along a man-made canal off Jean Guite Creek. The alignment of the proposed bulkhead will be an a maximum of five feet and an average of two feet waterward of normal water level at the bulkhead being replaced. Stella Olivola Bio Report Page 2 PROJECT SETTING The applicant's property is a residential lot located at the north end of Osprey Lane in Southern Shores, Dare County. The property is approximately 3.82 acres in size and is noted as having an average elevation of five feet above normal water level. On site inspection of the property indicates a greater average elevation. Located in the approximate center of the property is a high ground ridge noted on the Flood Insurance Rate Map as being in a "C" zone, while the surrounding property is in an "A-5" zone. The project site is bounded to the north and west by Jean Guite Creek, and to the east by a man-made canal, forming a peninsula. The property has approximately 1,364' of bulkheaded shoreline, of that 499' has a new bulkhead that installed in July of this year and authorized by General Permit #019585A. The remaining 865' of bulkhead is deteriorating and is in a state of disrepair. Heavy vegetation is found landward of the existing deteriorated bulkhead and includes Salt Meadow Cordgrass (Spartina patens), Groundsel Bush (Baccharis halimifolia), Loblolly Pine (Pinus taeda), Pin Oak (Quercus palustris), Wax Myrtle (Myrica cerifera), Olney's Three-square (Scirpus americanus), Red maple (Ater rubrum), Poison-ivy (Toxicodendron radicans), and Partridge- pea (Cassia aspera). Jean Guite Creek and the connecting canals are classified as "inland" waters by agreement between the Marine Fisheries Commission and Wildlife Resource Commission. The Division of Environmental Management's water quality classification for Jean Guite Creek is SC (fish propagation) and is closed to shellfishing. No submerged aquatic vegetation was found immediately adjacent to the bulkhead along the creek. A floating mats Water Milfoil are found in the small canal to the east of the property. PROJECT DESCRIPTION The applicant would like to construct 865' of replacement bulkhead a maximum of 5'-0", an average of 2'-0", waterward of an existing deteriorated bulkhead at normal water level. The placement of the structure will result in the filling of 192.2 cubic yards of shallow water habitat and public trust water. No submerged aquatic vegetation was found within the proposed fill area. High ground disturbance associated with the installation of the bulkhead and tie-backs (deadmen) will be approximately 17,300. The width of the man-made canal along the east side of the property will be reduced from 20' to approximately 18' with the construction of the bulkhead. The average width of the man- made canal on the east side of the applicants property is currently 24.6' the bulkhead will reduce the average width to approximately 22.6'. Along the narrowest point the canal will be reduced from 20' to 18' wide. 4L Stella Olivola Bio Report Page 3 ANTICIPATED IMPACTS 1) Loss of 1,730 square feet of shallow water habitat and public trust water from filling. 2) Narrowing of the existing canal from 20' to 18' in width. 3) Temporary localized turbidity during construction of the bulkhead. 4) Temporary loss of vegetation immediately adjacent the creek and the canal.
