After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. Spruill Washington County Project Setting sECEIVED AU G 10 1998 COASTAL MANAGEMENT The project site is located adjacent US 64 near the intersection of SR 1136 on Albemarle Sound near Roper in Washington County, North Carolina. The property is bordered on the downstream (east) side by a developed lot which is riprapped and is part of Summerfield Farms subdivision. The property is bordered on the upstream (west) side by an undeveloped wooded wetland tract. The project site includes ±85 acres which is the western most half of a larger tract of land owned by the applicant. The majority of the property is vegetated with mixed hardwoods, pines and has an undergrowth of vines and shrubs. A section of the property along the sound shoreline (t 1,500 ft) is vegetated with lawn grass and pines and contains a homesite with several outbuildings. This section of the property is the project site. An area of wooded wetlands bisects the property running parallel to the sound and connects into the Albemarle Sound at the west end of the property. The ±7' elevation above mean sea level creates an erosion bluff at the sound interface with aggressive undercutting of the bank. Albemarle Sound is classified as SB by the Environmental Management Commission. Albemarle Sound at the project site is coastal water but is not open to shell fishing. Project description The applicant proposes to place f 1,500' of riprap along the shoreline. The riprap will average 5' waterward of the normal water level (NWL) with a maximum distance offshore of 10'. The riprap will extend approximately 6' landward of the NWL to a height of 6' above the NWL. The applicant proposes to construct a 3' wide concrete sidewalk along the top of the riprap. Thirty - 25' long wooden groins are proposed every 50 linear feet along the riprap. Anticipated impacts The project as proposed will result in the filling of f 7,500 ft2 of sound bottom associated with the placement of riprap. Grading of the existing bluff and the construction of the sidewalk will result in the disturbance of f 18,000 ft2 of high ground. The project as proposed will result in localized turbidity as a result of the construction activities. David W.
