You have our approval, in accordance with the attached conditions, to construct Tall Tree Place
subdivision in Wake County, as you described in your application dated September 9, 1998. After
reviewing your application, we have decided that this project is covered by the Neuse River buffer rules
(15A NCAC 2B .0233). In addition, you should get any other federal, state or local permits before you go
ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater,
Non-Discharge and Water Supply Water shed regulation.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and send a new application. If the property is sold, the new
owner must be given a copy of this approval letter and is thereby responsible for complying with all
conditions.
If you do not accept any of the conditions of this approval, you may ask for an adjudicatory
hearing. You must act within 60 days of the date you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, PO Box 27447, Raleigh, NC 276 1 1-7447. This approval and its conditions are
final and binding unless you ask for a hearing.

the Neuse River Buffer regulations. Also, attached is a letter from the Land Management
Group, Inc. indicating the existing on site pond is considered isolated with no stream,
creek or feeder stream association and therefore has no Neuse River Buffer application.

I have evaluated the Tall Tree Place site for the presence of waters of the U.S., including
wetlands. The 1987 Corp of Engineers Wetland Delineation Manual was used as
guideline in making this determination.
After reviewing the site, the existing pond (less than 1/3 acre), which was constructed out
of uplands, would likely be considered jurisdictional waters/wetlands by definition.
However, due to the fact that there is not a stream/creek or spring (a feeding water source)
associated with this pond, it would be considered isolated and not regulated by the U.S.
Army Corp of Engineers. Since there are no streams, creeks, or streams feeding this
isolated pond, the Neuse River Buffers would not apply. No other waters/wetlands were
encountered within the site boundaries.
