Dear Sirs:
You have our approval, in accordance with the attached conditions, to place fill material in 0.0025 acres of wetlands
or waters for the purpose of stabilizing a shoreline, as you described in your application dated August 13, 1998. After
reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112.
In addition, you should get any other federal, state or local permits before you go ahead with your project including (but
not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed
regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application for a new certification. If the property is
sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying
with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation
may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions
listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

Site Description
This proposed project involves an existing man-made canal located in a newly created 43 lot
residential subdivision located off River Road in Elizabeth City, North Carolina.
Grand View is a subdivided 24.5 acre tract including a portion of an existing canal. The canal
connects to the Pasquotank River and is approximately 0.9 miles in length. This canal varies in
depth and is approximately 25 feet in width in the vicinity of the proposed development.
The shoreline in the vicinity of the proposed development is bordered by a fringe of
predominately upland plant species including Acer rubrum, Quercus spp. and Liquidambar
styraciflua, as well as various sedges and wild grasses. The parcels adjacent to the canal are or
were formerly farm fields. A mobile home park is located across from the proposed ramp.
The waters of the Pasquotank River are classified as Joint Waters by the Division of Marine
Fisheries. These waters also are classified by the Division of Coastal Management as
Estuarine Waters and Public Trust Area, both of which are Areas of Environmental Concern.
Project Proposal
The applicant proposes to construct a 15 ft. wide concrete boat ramp with 3 ft. wide launching
dock on one side of the ramp. The sides of the ramp will be bulkheaded with return walls
which will extend 46.5 ft. landward. The ramp structure will extend 5 feet beyond the NWL.
The facility will also have adjacent to the ramp, a 30 ft. long, 5 ft. wide dock along the
adjacent canal. This proposal includes the installation of a total of 138 ft. of bulkhead. This
includes the bulkheading of 35 ft. of the canal adjacent to the ramp. The applicant wishes to
construct the proposed bulkhead as close to the existing shoreline as possible. An 103 ft. of
bulkhead is included in the ramp and step return walls. The facility will have a gravel parking
lot to provide parking for 10 vehicles with boat trailers.
Anticipated Impacts
This project will result in the filling and shading of Public Trust Area/Estuarine Waters as well
as the land disturbance of Estuarine Shoreline. The proposed work will result in the loss of
0.0025 acre ( 110 sf.) of shallow water habitat within the Public Trust Area and Estuarine
Waters of this canal. The proposed construction will also result in the shading of 0.0038 acre
(165 sf.) of shallow water habitat. The boat ramp, parking lot and bulkhead instillation will
result in a short term increase in turbidity during construction, however, long term impacts
will be a reduction in shoreline erosion and the turbidity associated with this erosion. The
parking lot will increase the amount of impervious area draining into the Pasquotank River
watershed. The proposed project will increase access by the public to the Pasquotank River.

Open Space Development
Elizabeth City, North Carolina
Grand View is a 43 lot canal front residential subdivision, located off River Road in
Elizabeth City. The subdivided tract is 24.52 acres. The subdivision roads and utilities
have been constructed and several homes are under- construction. Some general
landscaping is being done within the development and now the open space is to be
developed.
Open Space development will consist of the construction of a concrete boat ramp
with related dock and parking. Excavation will consist of an area 18' wide at the water's
edge by 46.5' to accommodate a 15' wide ramp and 3' wide dock and a trench as
necessary to install bulkhead stabilization. There will be a 5' wide dock along 30' of canal
frontage. The treated lumber bulkhead will be constructed along both sides of the ramp
and behind the dock area. There will be a total of 138' of bulkhead. A gravel parking lot
will be constructed to provide parking for 10 vehicles with boat trailers.
The disturbed area for this project is 1.'15 acres. Excavated material not necessary
for backfiring the bulkhead stabilization will be spread over low areas of the site to aid in
grading. The impervious area created by this construction will be 12,356 sf.
