Narron and Charles O. Whitley Timber Tracts in Johnston County. On May 27, 1998, I met with you and Mr. Hans Rohr to conduct an evaluation of the water bodies present on these two tracts. As a result of the site visit, it was determined that the water bodies present on these tracts are subject to the Neuse River Riparian i "xy Buffer Rules (15 A NCAC 2B .0233). As you know the Neuse Buffer Rules: Neuse River Basin: Nutri Y ent Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 state the following: ".0233-Existing riparian areas shall be protected and maintained in accordance with Sub- Items (3)(a)-(e) of this Rule on all sides of surface waters in the Neuse River Basin. h As we discussed, the riparian buffer must be protected in two zones. r_t x (a) "Zone 1 is intended to be undisturbed forest....Zone 1 begins at the upper edge of the active channel of the water body or the mean high water line and extends landward a distance of 30 feet, measured horizontally on a line perpendicular to the waterbody.. Forest vegetation of any width that exists in Zone 1 on the effective date of this Rule must be preserved and maintained....Selective cutting of individual trees of high value in the outer twenty feet of Zone 1 (is allowed) provided that the basal area remains at or above 0.75 square feet per running 100 feet." (b) "Zone 2 begins at the outer edge of Zone 1 and extends landward a minimum of 20 feet as measured horizontally on a line perpendicular to the waterbody. The combined minimum width of Zones 1 and 2 shall be 50 feet on all sides of the waterbody. WATER UALITY,CFCT.',:. woody species which provides for diffusion and infiltration of runoff and filtering of pollutants. The maps that you have provided indicate the location of the water bodies that are to be protected under this rule and the flagging of the thirty foot protection boundary for Zone 1 meets the requirements of that section of the rule. The selective cutting in this zone will be accomplished by first determining the basal area of the zone and then protecting the tree density by ensuring that the basal area remains at 75 square feet per acre. Mr Rohr's calculations based on 1/150th acre plots indicate that this requirement will be met.
