APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS and Neuse River
Buffer Rules

Dear Ms. Jackson:
You have our approval, in accordance with the attached conditions and those listed below, to place fill
material in 1.45 acres of wetlands or waters for the purpose of constructing the Holly Springs water main
corridor at SR 1152, as you described in your application dated August 10, 1998. After reviewing your
application, we have decided that this fill is covered by General Water Quality Certification Number 3101. This
certification allows you to use Nationwide Permit Number 12 when the Corps of Engineers issues it. This
approval is also valid for the Neuse River buffer rules (15A NCAC 213 .033). In addition, you should get any
other federal, state or local permits before you go ahead with your project including (but not limited to)
Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations.
This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in
the General Certification.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application.. If the property is sold, the new owner must be given a copy of this Certification and approval
letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or
in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506
(h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification
and any additional conditions listed below.
1. Applicant is hereby notified that an interbasin transfer of more than 1 MGD requires registration with the NC
Division of Water Resources and possibly Certification from the NC Environmental Management Commission.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are
final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Holly Springs City Limits (Sunset Ridge) to Raleigh (to Tryon Rd.)
-The Consultant explained to me that DOT will not allow water lines to be attached to bridge.
-only stream crossings no wetlands
-20-30 foot construction corridor (the width of disturbance is 8-10 feet).
-foot print of construction corridor is already in "right of way" ( 5-7feet of pavement edge)
Accordingly, few trees will be cut because the installation is along road edge.
Total length is 40,0000 feet.
Consultant said no wetlands will be impacted on stream crossings. They were surveyed by the
City of Raleigh.
Recommendation:
It is unclear to me what DWQ policy is on requiring water or sewer lines to be attached to bridges
rather than excavation and placement below streams or in wetlands. It is likely that the
attachment to bridges is more environmentally sound. However, bridge maintenance and clear
debris that accumulate under the bridges may prove to be a valid concern for utility line
maintenance (and preventing spills). (Debra Sawyer may be have had to deal with this issue in the
past- I recommend running this by her.) With respect to NBR it may be necessary to critically
consider this issue.
The connection of Water from Raleigh to Holly Springs will result in interbasin transfer. Raleigh
gets water from the Neuse and. the Holly Springs WWTP discharges to the Cape Fear Basin. I
called Tom Fransen with Water Resources who stated that Raleigh proposes to sell 0.5 MGD of
water to Holly Springs (lie was unsure if this amount addressed this specific water line or if
things have changed).
Note: If the City of Raleigh transfers I MGD they must register (with Water Resources 1 think)
and if they transfer 2 MGD they need a certification from the Commission and a provided a SEPA
document. I recommend DWQ put their project on hold until the City of Raleigh provides
information documenting their current interbasin transfer status? (Attached is a copy of
"Transfer" General Statues for your review). The City have completed and addressed all of the
issues regarding this transfer. It however, is not adequately addressed in the PCN.

*(b) Any person initiating a new water withdrawal or transfer of 1,000,000 gallons per day or more shall register the
withdrawal or transfer with the Commission not later than six months after the initiation of the withdrawal or transfer. The

*(e) A unit of local government that has completed a local water supply plan that meets the requirements of G.S. 143-355(1)
and that has periodically revised and updated its plan as required by the Department has satisfied the requirements of this
section and is not required to separately register a water withdrawal or transfer or to update a registration under this section.

*(d) Any person. who is required to register a water withdrawal or transfer under this section shall update the registration by
providing the Commission with a current version of the information required by subsection (a) of this section at five-year
intervals following the initial registration. A person who submits information to update a registration of a water withdrawal or
transfer is not required to pay an additional registration fee under G.S. 143-215.3(a)(1 a) and G.S. 143-215.3(a)(1b), but is
subject to the late registration fee established under this section in the event that updated information is not submitted as
required by this subsection.
§143-215.220H(c)
*(e) Any person who is required to register a water transfer or withdrawal under this section and fails to do so shall pay, in
addition to the registration fee required under G.S. 143-215.3(a)(1a) and G.S. 143-215.3(a)(1b), a late registration fee of five
dollars ($5.00) per day for each day the registration is late up to a maximum of five hundred dollars ($500.00). A person who is
required to update a registration under this section and fails to do so shall pay a fee of five dollars ($5.00) per day for each day
the updated information is late up to a maximum of five hundred dollars ($500.00). A late registration fee shall not be charged
to a farmer who submits a registration that pertains to farming operations.(1991, c. 712, s. 1; 1993, c. 344, s. 1, c. 553, s. 81.)

one river basin to another up to the full capacity of a facility to transfer water from one basin to another if the facility was
existing or under construction on July 1, 1993.

*(c) An applicant for a certificate shall petition the Commission for the certificate. The petition shall be in writing and shall
include the following:

*(1) A description of the facilities to be used to transfer the water, including the location and capacity of water
intakes, pumps, pipelines, and other facilities.

*(e) The notice of the public hearing shall include a nontechnical description of the applicant's request and a conspicuous
statement in bold type as to the effects of the water transfer on the source and receiving river basins. The notice shall further
indicate the procedure to be followed by anyone wishing to submit comments on the proposed water transfer.

*(f) In determining whether a certificate may be issued for the transfer, the Commission shall specifically consider each of the
following items and state in writing its findings of fact with regard to each item:

*(1) The necessity, reasonableness, and beneficial effects of the amount of surface water proposed to be transferred
and its proposed uses.

Anny Corps of Engineers, the purposes and water storage allocations established for the reservoir at the time the reservoir

*(7)- Any other facts and circumstances that are reasonably necessary to carry out the purposes of this Part.

*(g) A certificate shall be granted for a water transfer unless the Commission concludes by a preponderance of the evidence
based upon the findings of fact made under subsection (f) of this section that the potential detriments of the proposed transfer
outweigh the benefits of the transfer.
§143-215.2201(h)
*(h) The Commission may grant the certificate in whole or in part, or deny the certificate. The Commission may also grant a
certificate with any conditions attached that the Commission believes are necessary to achieve the purposes of this Part. The
conditions may include mitigation measures proposed to minimize any detrimental effects of the proposed transfer and
measures to protect the availability of water in the source river basin during a drought or other emergency. The certificate shall
indicate the maximum amount of water that may be transferred. No person shall transfer an amount of water that exceeds the
amount in the certificate.
§143-215.2201(1)
*(i) In cases where an applicant requests approval to increase a transfer that existed on July 1, 1993, the Commission shall have
authority to approve or disapprove only the amount of the increase. If the Commission approves the increase, however, the
certificate shall be issued for the amount of the existing transfer plus the requested increase. Certificates for transfers approved
by the Commission under G.S. 162A-7 shall remain in effect as approved by the Commission and shall have the same effect as
a certificate issued under this Part.

transfer, the Secretary of the Department of Environment, Health, and Natural Resources shall consult with those parties listed
in G.S. 143-215.212I(d)(3) that are likely to be affected by the proposed transfer. However, the Secretary of the Department of
Environm,elnt, Health, and Natural Resources shall not be required to satisfy the public notice requirements of this section or

*(a) The Scientific Advisory Council on Water Resources and Coastal Fisheries Management (hereinafter "Council") is created
in the Department of Environment, Health, and Natural Resources.

*(b) The Council shall have eight members, including the Secretary of the Department of Environment, Health, and Natural
Resources, who shall chair the Council, and the Dean of the School of Agriculture and Life Sciences of North Carolina State
University. The members of the Council shall elect a vice-chair from among the Council membership. The Chair of the Council
shall solicit three recommendations from the scientific community including private scientists representing industrial and
environmental concerns, as well as the academic community for each of the six appointees and shall select members from

*(a) The Scientific Advisory Council on Water Resources and Coastal Fisheries Management (hereinafter "Council") is created
in the Department of Environment, Health, and Natural Resources.
§143-215.220J(b)
*(b) The Council shall have eight members, including the Secretary of the Department of Environment, Health, and Natural
Resources, who shall chair the Council, and the Dean of the School of Agriculture and Life Sciences of North Carolina State
University. The members of the Council shall elect a vice-chair from among the Council membership. The Chair of the Council
shall solicit three recommendations from the scientific community including private scientists representing industrial and
environmental concerns, as well as the academic community for each of the six appointees and shall select members from
among those recommendations. Members shall have the following qualifications:

We discussed the need for a 401 Water Quality Certification for the above referenced project
with Mr. Eric Galanb of your office on Tuesday, August 4, 1998. We understand from that
discussion that we do not need a 401 water certification if we conclude that we comply with the
general certification posted on DENR's web site.
The 404 permit for the referenced project references permit 12. 1 have read this permit and
identified no conditions with which we will not comply assuming the contractor complies with
the plans and specifications.
Our client, the City of Raleigh Public Utilities Department, would like written confirmation from
you that a specific 401 Water Quality Certification is not required if we comply with the
conditions set forth in general permit 12. We are requesting a letter from you stating this.
We are submitting herewith backup information for you to review so you can issue the
preceding statement. These documents include:
1. Copy of the 404 permit
2. Copy of Preconstruction Notification Application and attachments
3. One set of plans for the referenced project

SPECIAL PROJECT CONDITIONS
SPC - 1 Property corners or right-of-way markers disturbed by the Contractor
during construction shall be replaced at Contractor's expense by a North
Carolina registered surveyor.
SPC - 2 The Contractor shall maintain a minimum of one lane of traffic in both
directions at all times in conformance with the latest North Carolina
Department of Transportation Manual on Uniform Traffic Control Devices
for Street and Highway unless otherwise permitted by the City for local
streets.
SPC - 3 The Contractor shall maintain driveway connections to the road system to
provide access for residents along the construction route. Disruption of
access shall be held to a minimum.
SPC - 4 Contractor to coordinate with the City of Raleigh for the interruption of
utility services. Down time of the existing utility lines shall be held to a
minimum.
SPC - 5 All work shall be performed in accordance with approved permits and
encroachments.
SPC - 6 Restore to original contours after construction.
SPC - 7 Sediment and erosion control practices shall be utilized to prevent
violations of the appropriate turbidity water quality standard 50 NTUs in
streams and rivers not designated as trout waters by DEM; 25 NTUs in all
salt water classes, and all lakes and reservoirs; and 10 NTUs in trout
waters). All sediment and erosion control measures placed in wetlands
shall be removed and the natural grade restored after the Division of
Land Resources has released the project.
SPC - 8 Annual species suitable for wet locations shall be planted within
jurisdictional wetlands for soil and erosion control. Perennials such as
fescue are prohibited.
SPC - 9 No fertilizer shall be applied within 10 feet (3 meters) of streams.
SPC - 10 The construction corridor (including access roads and stockpiling of
materials) is limited to 40 feet (12.2 meters) in width and must be
minimized to the maximum extent practicable.
SPC - 11 Measures shall be taken to prevent live or fresh concrete from coming
into contact with waters of the state until the concrete has hardened.
SPC - 12 An anti-seep collar shall be placed at the downstream (utility line
gradient) wetland boundary and every 150 feet (45.7 meters) up the
gradient until the utility exits the wetland for buried utility lines. Anti-seep

collars may be constructed with class B concrete, compacted clay or
metal collars. Perpendicular wetland crossings less than 150 feet (45.7
meters) long do not require anti-seep collars.
The compacted clay shall have a specific discharge of 1 x 105 cm/sec or
less.
The following specifications shall apply to class B concrete:
a) Minimum cement content, sacks per cubic 5.0
yard with rounded course aggregate
b) Minimum cement content, sacks per cubic 5.5
yard with angular course aggregate
c) Maximum water-cement ratio gallons per 6.8
sack
d) Slump range 2" to 4"
e) Minimum strength - 28 day psi 2,500
SPC - 13 Placement of rip rap is restricted to stream bottom and banks directly
impacted by the placement of the utility line. Rip rap may only be used
below the normal high water area. The stream berm must be restored to
the original contour after construction.
SPC - 14 The edge of the construction corridor is installed parallel to and closer
than 10' (3 meters) to a stream or if the utility line crosses a stream
channel at less than 750 or more than 105° (i.e., not perpendicular stream
crossing) of the stream bank.
SPC - 15 Construction corridors parallel to streams shall be placed at the furthest
distance from the stream to the maximum extent practicable.
SPC - 16 All sediment and erosion control measures placed in wetlands or waters
shall be removed and the natural grade restored after the Division of
Land Resources has released the project.
SPC - 17 Annual species suitable for wet locations shall be planted within
jurisdictional wetlands for soil and erosion control. Perennials such as
fescue are prohibited.
SPC - 18 Nationwide certification does not authorize any permanent changes in
pre-construction elevation contours in waters or wetlands. The permittee
will have a specific plan for restoring wetland contours. Any excess
material will be removed to a high ground disposal area.
