APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Thomas:
You have our approval, in accordance with the attached conditions and those listed below, to place
fill material for the purpose of constructing a school at Weddington High School, as you described in your
application dated July 22, 1998. After reviewing your application, we have decided that this fill is covered
by General Water Quality Certification Number 3108. This certification allows you to use Nationwide
Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal,
state or local permits before you go ahead with your project including (but not limited to) Sediment and
Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This
approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in
the General Certification.
This approval is only valid for the purpose and design that you described in your new application except
as modified below. If you change your project, you must notify us and send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby
responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed
one acre, compensatory mitigation may be required as described in 15A NCAC 2H 00506(h) (6) and (7). For
this approval to be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below.
_l. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands_
and waters to notify the state in order to assure compliance for future wetland and/or water impact. These
mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit
(whichever is later).
2. An additional condition is that a final, written stormwater plan including a wet detention basin must be
approved by DWQ before wetland (or stream) impacts occur.
3. Applicant is reminded that anti-seep collars must be installed along the existing sewer line in the wetland
and that a revegetation plan will be required for the 10-foot buffer between the sewer line and streambank.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions
are final and binding unless you ask for a hearing. K.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

SUBJECT: NOTICE OF VIOLATION
Unauthorized Installation of Utility Line

Dear Mr. Davis:
On August 4, 1998 Mr. Samar Bou-Ghazale conducted a site visit to the
Weddington High School site near NC 84 and Deal Road. As a result of this
investigation, Mr. Bou-Ghazale noted that approximately 400' of sewer line had been
constructed through a wetland without prior NCDWQ authorization. Additionally, in a
subsequent phone conversation you noted to Mr. Bou-Ghazale that the line had been
installed in the wetland without the required anti-seep collars (Condition # 13 of NW 12)
and that the required 10' undisturbed buffer (as measured from the edge of the
construction corridor to the stream-Condition #2 of NW 12) had also been impacted.
As is required in NW 12, if any conditions of the permit cannot be met then
written concurrence (and prior notification) from the North Carolina Division Water
Quality (NCDWQ) is required. Mr. Bou-Ghazale informed this office (On August 10,
1998) that you plan to submit an application for a 401 Water Quality Certification
showing anti-seep collar details and a re-vegetation plan for the disturbed buffer area.
Until this plan is reviewed and approved you will be in violation of 15A NCAC 2H.0500
which may result in an enforcement action being pursued against you by NCDWQ.

Dear Sirs:
On behalf of my client, Mr. Jerry W. Thomas of Union County Public Schools, I am requesting your review
of a very well planned project that avoids and minimizes impacts to important wetlands and streams. As a
result of sensitive land planning, the forested wetlands, streams, and natural areas have been incorporated
into the overall design. Approximately 90% of the delineated streams and wetlands on the site are not
impacted by the development of this project. The delineated wetlands and streams on the site include +
2,330 If of streams and + 1.16 acres of jurisdictional wetlands. Approximately 1,850 If of the stream are
considered important and 480 If of the streams were determined unimportant by the USACE. The streams
were.evaluated based on important characteristics such as persistent pools; evidence of macro-invertebrates;
evidence of wildlife utilizing the stream; and channel substrate. As depicted on the attached plans great
care has been taken in avoiding the important perennial stream and minimizing impacts to adjacent wetlands.
Proposed impacts are limited to ± 0.27 acres of wetlands; 400 If of unimportant streams.
BACKGROUND
The site is within a drainage area of Culvert Branch (Water Classification - C), a tributary of Twelve Mile
Creek. Twelve Mile Creek is in the Catawba Basin. The majority of the site is a moderately sloping
woodland and former agricultural land. Current land use in the vicinity is single family subdivisions, and
agricultural areas. There are approximately 2.04 acres of jurisdictional surface waters and wetlands on the
project site. The jurisdictional waters and wetlands on this site adjacent to Culvert Branch were be found to
have very high value and function regarding water storage, pollution removal, bank stabilization, aquatic life
resources utilizing Guidance for Rating the Values of Wetlands in North Carolina - Fourth Version.
Wetlands and streams which will not be disturbed will be protected during construction from damage due to
construction traffic, drainage and other forms of disturbance. The remaining enhanced by utilizing the storm
drainage system which will increase their water storage, pollution removal, bank stabilization, and aquatic
life functions.
Wed and Delineation Methodology
Preliminary identification and delineation of the Jurisdictional Waters on the site were determined according
to the Corps of Engineers Wetland Delineation Mariual, Technical Report Y-87-1, 1987, with Appendices.
Preliminary data gathering included review and interpretation of topographic maps; USDA Soil

Conservation Survey; aerial photographs, and preliminary site visits to selected areas. Then the Routine
On-Site Determination Method was utilized to determine the upper boundary of the wetlands. In order to
make a positive wetland determination, indicators of hydrophytic vegetation, hydric soil, and wetland
hydrology were identified as described in the manual. The wetland boundary was marked in the field by
Leonard S. Rindner, PWS, Environmental Planning Consultant and was reviewed and verified by the
USACE (Steve Chapin). The surveyed map has been used for planning and for permitting purposes.

The forested headwater wetland areas are dominated by Facultative, and Facultative Wet species. Trees
include red maple, sweetgum, willow oak, hornbeam and green ash. Understory and herbaceous strata
includes silky dogwood, alder, spicebush, smilax, microstegium, sedges, soft rush, and others. Where the
forest has been removed or the soils are more saturated Obligate species such as black willow are present.

The site includes Chewacla (ChA) soils. These soils are map units which may have inclusions of hydric soils
according to the Soil Conservation Service (now Natural Resource Conservation Service) , Technical
Guide-Section 11-A-2, June 1991.
The wetland areas on this site are the result of a surface runoff, overbank flooding and a high seasonal water
table over a clayey subsoil. The stream through the pine area at the upper part of the site was channelized in
the past.

WETLANDS PERMITTING AND MITIGATION
The layout minimizes impacts to the perennial tributary and intermittent tributaries which exhibit important
characteristics such as persistent pools and/or saturated channel bottom; evidence of macro-invertebrates;

reduced soils; algae; hydrophytic vegetation in or adjacent to the channel; evidence of wildlife utilizing the
stream; and sandy to gravelly channel substrate. Except for temporary construction and development
impacts, we believe that the proposed project will not cause significant impacts to the ecological functions or
values of Jurisdictional Waters of the U. S.
Avoidance. Minimizationand Mitigation
Best Management Practices will also be employed to minimize impacts to Jurisdictional Waters. These will
include:
a) Siltation Barriers; Sediment Traps and Temporary Diversion Ditches
b) Barricades to define construction limits to sensitive sites and to protect trees
c) ' Preconstruction meetings as necessary
d) Vehicular access will be restricted to specific areas to avoid disturbance to adjacent wetlands and
natural areas to be preserved.
e) Methods to prevent short term impacts will be inspected regularly and maintained during
construction of the project.
0 Wetlands to be preserved will be clearly marked prior to construction to prevent accidental
damage. The contractors will be held responsible for unauthorized wetland damage not
permitted according to plans and specifications. Preconstruction meetings shall be held if necessary
with representatives of the USACE and the NCDWQ
g) Short term construction impacts, primarily stream sedimentation will affect aquatic habitat,
however this will be minimized to the extent practicable to promote rapid recovery.
h) Project construction will strictly adhere to an approved Sedimentation and Erosion Control Plan.
Best Management Practices will include utilizing siltation trapping ponds and other erosion control
structures where appropriate. Impacts from hazardous materials and other toxins to fish and
aquatic life such as fuels will be avoided by not permitting staging areas to be located near surface
waters.
i) As required by the 401 Water Quality Certification conditions, measures will be taken to prevent
"live" or fresh concrete from coming into contact with waters until the concrete has hardened.
PROPOSED COMPENSATORY MITIGATION
A mitigation plan has been developed for a "no net loss" of wetland habitat, value, and function to the extent
feasible on this site. The goal of this plan is to preserve, protect, the extents of the remaining existing
wetlands and streams.
Based on a site review and subsequent discussions with the USACE (Steve Chapin), minimizing
impacts to the forested buffer adjacent to the perennial stream was determined to be acceptable as mitigation
for impacts to the remaining streams and wetland impacts. Protection of existing streams and wetlands will
be enhanced with as much natural buffer as feasible. Although in most cases this natural construction buffer
will be sufficiently wide, it will be a minimum of 20' wide barricaded with silt fence.
Stream buffers will be protected from construction impacts and siltation. Wetland areas not to be
disturbed will be clearly marked and barricaded if required.
Mitigation has not been provided for streams determined unimportant and for intermittent streams
that did not have organisms such as fish, crayfish, and bullfrog tadpoles. Although mitigation is not provided
for these streams the developer has taken significant steps in developing the plans to minimize impacts to
streams and wetlands on the project to balance the sites economic viability, site planning requirements,
marketing issues, engineering requirements, local zoning conditions,' and the environmental consequences.
Employment of strict erosion and sediment control procedures will be specified to avoid impacts to water

quality. Existing wetlands and surface waters and buffer areas will be protected from erosion and
sedimentation during construction and installation of the mitigation sites. Control structures such as
sedimentation traps, siltation barriers, and/or at a minimum silt fence will be utilized as necessary. The
preserved streams and wetlands will be protected from firture impacts by the applicant or by a group
designated by the applicant for this purpose. Development of these areas will be deed restricted as required
by the NCDWQ and which will be developed for approval by the USACE and/or NCDWQ.
THREATENED AN ENDANGERED SPECIES
Federally listed plant and animal species with endangered or threatened status are protected under the
Endangered Species Act of 1973. The US Fish and Wildlife Service has identified two endangered species -
Schweinitz's sunflower (Helianthus schweinitzii), and the Carolina heelsplitter (Lasmigona decorata).
Schweinitz's sunflower thrives in full sun characteristic of successional fields, margins, and forested
openings. Habitat conducive to the sunflower did not appear to be present. The Carolina heelsplitter is a
freshwater mussel which prefers shaded areas either in a ponded portion of a small stream or in runs along
steep banks with moderate current. Primary habitat are waters less than three feet deep with a soft mud,
muddy sand, or shady gravelly substrate. It is normally restricted to protected silted areas or under banks
especially associated with obstructions such as stumps or fallen trees. Its current distribution according to
the US Fish and Wildlife Service is limited to portions of two streams - Goose Creek and Waxhaw Creek --
and a small river originating from rural areas in Union County. Therefore it does not expected on this site.
State Protected Species
The Carolina Darter (Etheostoma collis) is a fish that inhabits small streams such as those found in the
project area. This species has a federal status of Proposed Special Concern and a state status of Special
Concern. The species prefers small clear streams of less than 15' width with moderate to swift current and a
sand/gravel benthic composition. It apparently tolerates a wide range of water quality conditions and
vegetation types adjacent to the streams and appears resistant to pollution. (E. Menhinick). Therefore, strict
adherence to an approved erosion and sedimentation control plan will be maintained during the construction
period in order to control degradation of water quality.
AQUATIC HABITAT

preserved. Short tern construction impacts, primarily stream sedimentation will affect aquatic habitat,
however this will be minim;zed to the extent practicable to promote rapid recovery. Project construction will

CONCLUSION
The approximate 88 acre school development has been designed to balance the site's viability with its
environmental value. The goal of the site plan was to balance the environmental consequences of this
development by preserving to the extent feasible the most valuable Jurisdictional Waters of the U.S. on the
site. Great care will be taken to minimize further impacts to wetlands and streams. The undisturbed streams
' and wetland areas will be preserved by the applicant or by a group designated by the owner for this purpose.

EXECUTIVE SUMMARY
As a part of a potential real estate transaction. Union County engaged Law Engineering to
perform a. Preliminary Environmental Site Assessment (PESA) for an approximately 126-acre
tract located in Sandy Ridge Township in Union County. The site is located northeast of the
intersection of Twelve-Mile Creek Road and State Highway 84.
On-Site Observations
The site is undeveloped, consisting primarily of open grass fields with isolated wooded areas
The areas bounding Culvert Branch creek. which traverses the southern portion or the property.
are wooded. We did not observe evidence of storage of discarding of potential environmental
contaminants on the property.
Surrounding Properties
The site: is located in a primarily rural residential and farmland developed area. Residential
developments bound the northwestern. eastern and southeastern property limits. State Highway
84 bounds the southern limits of the site. Deal Road bounds a portion of the eastern property
limits. Twelve-Mile Creek Road extends along a portion of the western property limits.
Surface and Subsurface Drainage
Based on USGS topographic maps (Matthews and Waxhaw Quadrangles) and on-site
observations, the site drains into Culverts Branch which flows across the property to the
southeast. Culverts Branch drains an approximately two mile radius north and northwest of the
site.
Site and Area Use History
Based on our review of historical aerial photographs and the site chain-of-ownership, we found
no indications of previous site uses which use may be considered of environmental concern.
Regulatory Review
Regulatory records were not found to list the site or surrounding properties as a location of a
contamination incident. -a location containing hazardous materials or containing registered
underground storage tanks.
Comments and Recommendations
We found no evidence of on-site or off-site items of potential environmental concern to the
property. It is our opinion that no further assessment of the site is warranted at this time.

1.0 INTRODUCTION
As a part of a potential real estate transaction, Union County engaged Law Engineering to
perform a Preliminary Environmental Site Assessment (PESA) for an approximately 126-acre
tract located in Sandy Ridge Township in Union County. ' The site is located northeast of the
intersection of State Highway 84 and Twelve-Mile Creek Road (see Figure 1).
The property is undeveloped farmland. Portions of the site are bounded by State Highway 84,
Twelve-Mile Creek Road and Deal Road.
The above project information was developed from conversations between our Mr. Robert Jones
and Mr. John Munn, Union County Manager.

2.0 SCOPE OF SERVICES
The assessment is a general site characterization and identification of potential environmental
concerns based on readily available information. site observations and interviews. It was not
the purpose of this assessment to determine the actual presence. degree or extent of
contamination. if any, on the site. As described in Law Environmental Proposal No. 56-4137.
the scope of work for the project included the following summarized tasks:
• Perform a site reconnaissance to look for surface indications of environmental
contamination. waste-handling activities and the presence of underground storage
tanks.
Perform a vehicular reconnaissance of accessible areas to identify surrounding
property uses and area facilities which operations may be of environmental
concern to the site.
• Perform a review of selected available local. state and federal environmental
regulatory agency records to identify facilities in the area of the site (including
the site) that handle or generate hazardous materials. contain underground storage
tanks or are documented sites of environmental contamination.
• Review- available background and historical information such as aerial
photographs, topographic maps and previous geotechnical reports for potential
aspects of environmental significance to the site.
• Review the furnished history of ownership for indications of past and present uses
of the site. The historical review would include a review of a chain-of-ownership
for the property (if provided by your attorney), interviews with available past and
present property owners and reviewing past tenant occupancy, if applicable.
• Prepare a report summarizing our observations. findings and conclusions.
Provide recommendations for additional appropriate site assessment work.

• rare or endangered species
• geological hazards

3.0 SITE RECONFNAISSANCE
Information regarding the current status of the site was obtained by on-site observations. Site
reconnaissances were performed on December 17 and 21. 1993. Aspects of the site observed
during our reconnaissances included:
• the approximate project site boundaries and adjacent properties
• the topography and general surface drainage patterns
• evidence of current or past on-site management and/or disposal of potential
sources of environmental contaminants
• observable site-features of potential environmental concern
3.1 General Site Description
The property dimensions and existing site features are shown on the site plan provided (Figure
?). The western property limits are bordered by Twelve-Mile Creek Road. State Highway 84
bounds a portion of the southern property limits. Deal Road extends along a portion of the
eastern property boundary.
The site was found to consist primarily of open-grassland and isolated wooded areas, as shown
on Photograph Nos. 1 through 4. Culvert Branch traverses the southern portion of the property,
flowing generally from northwest to southeast. Photograph No. shows an outfall onto the site
from a culvert exiting from under Twelve-Mile Creek Road. The areas along Culvert Branch
are wooded.
We did not observe evidence of distressed vegetation, sheen on the water or stained soils in the
area of the on-site creek. Photograph No. 6 shows a view of the flowing creek water observed
at the time of our site visit. We found evidence of vehicle tracks traversing the site. No
evidence of storage or disposal of potential environmental contaminants was observed at the site.
An empty drum labelled "Calgon" was found in the northwestern portion of the site near an
adjacent residential property.

3.2 Surrounding Properties
A vehicular reconnaissance (drive-by) of accessible adjacent property was made during this
preliminary assessment to identifv current potential off-site sources of contaminants that might
adversely impact the site. Our reconnaissance was conducted within an approximate one-half
mile radius of the site.
Our drive-by was performed along the following major routes which are identified on Figure 1:
• Twelve-Mile Creek Road (State Road 1341) from State Highway 84 to State Road
1348
• Deal Road (State Road 1340) from State Highway 84 to Twelve Mile Creek Road
• State Highway 84 one-half mile east and west of the site
The site is located in an area containing. mixed rural residential developments and farmland.
Residential developments bound the northern. eastern and southeastern limits of the property.
We observed that the surrounding residential properties contain private water supply wells. We
did not identify facilities of environmental concern on adjacent or surrounding properties.

4.0 SITE GEOLOGY AND HYDROGEOLOGY
We reviewed the following information sources with respect to the geology and hydrogeology
of the site.
• Geologic Map of North Carolina: dated 1988.
• U.S. Geologic Survey (USGS) 7.5-Minute Topographic Map: Matthews. NC
Quadrangle, dated 1971. Photorevised 1988.
The site is located within the Piedmont Physiographic Province. Based on the Geologic Map,
the site is located in the Charlotte Belt geologic region. The site is mapped to be underlain by
metamorphosed volcanic rocks.
The site is located in the West Fork Twelve-Mile Creek watershed. Culvert Branch. tributary
of West Fork Twelve-Mile Creek. flows through the southern portion of the site and intersects
Twelve-Mile Creek about 1.000 feet southeast of the site. Culvert Branch begins about two
miles northwest of the site. Based on the USGS topographic map and on-site observations, the
site drains to the southeast. The area of drainage influence (upgradient) to the property is
interpreted to be located within about two miles west. northwest and north. The areas to the east
and south of the site are interpreted to be downgradient.

5.0 SITE HISTORY REVIEW
5.1 Historical Information Sources
We reviewed the following available information sources to evaluate historical uses of the site
and surrounding properties that may indicate items of potential environmental concern:
• USGS 7.5-Minute Topographic Quadrangle Map: Matthews. NC dated 1971
Photorevised 1988. (Figure 1).
• Union County Mapping Department Aerial Photograph No. 4486, dated 1985
(Figure 3)
• Union County Mapping Department Aerial Photograph dated 1970 (Figure 4)
5.2 Past Site Ownership and Uses
The chain-of-ownership for the site was provided for our review by Steelman and Long,
Attorneys at Law. A copy of the chain-of ownership is provided in Appendix A. Based on the
chain of ownership information, the site is composed of six individual tracts, as shown on the
sketch included in Appendix A. The property (six tracts) is indicated to have been conveyed
between individuals and relatives since the 1930s.
The 1970 and 1985 aerial photographs of the site show conditions similar to those observed
during our site reconnaissances. Farmland usage is apparent by the open fields with isolated
wooded areas. No evidence of structures was observed at the site in the photographs.
Repeated attempts to contact the present property owner, Mr. Clifford Deal, by telephone at
(704) 846-2024 were unsuccessful.
5.3 Past Area Property Uses
The 1970 aerial photograph shows the area property uses as farmland. The 1985 aerial
photograph shows residential development to the northwest, north and northeast of the site.

6.0 REGULATORY REVIEW
Regulatory agency records were reviewed to evaluate the site and surrounding area for
contaminated sites and/or potential sources of environmental contamination to affect the site.
6.1 EPA National Priorities List (NPL)
The Comprehensive Environmental Response. Compensation and Liability Act (CERCLA)
established the National Priority List (NPL) of federal "Superfund" sites: These are
contaminated sites to which the EPA has assigned a high ranking in terms of their potential
public health effects.
The site does not appear on the.NPL'. There are no facilities listed on the NPL located within
a one-mile radius of the site.
6.2 EPA Comprehensive Environmental Response Compensation and Liabilitv Information
System (CERCLIS) List
The CERCLIS List is a compilation for sites which the EPA has investigated or is investigating
for a release or threatened . release of hazardous substances pursuant to the, Comprehensive
Environmental Response. Compensation and Liability Act of 1980.
A review of CERCLIS list' did not identify the site as a listed facility. No listed facilities were
found within an approximate one-mile radius of the site.

6.3 EPA Resource Conservation and Recoverv Act (RCRA) Hazardous Waste Facilities
The EPA's Resource Conservation and Recoverv Act (RCRA) Program identifies and tracks
hazardous waste from the point of generation to the point of disposal. The RCRA facilities
database is a compilation of the EPA reporting facilities that generate, transport. treat. store or
dispose of hazardous waste.
The site does not appear on the RCRA notifiers list'. No hazardous waste facilities were found
to be listed within approximately one-half mile of the site.
6.4 NCDEHNR Contamination Incidents List
The Contamination Incidents List identifies sites of known or suspected contaminant releases
The site does not appear on the list'. No facilities/properties located within one-fourth mile of
the site were identified on the list.
6.5 Registered Underground Storage Tanks (UST) List
The Underground Storage Tank (UST) Records was reviewed to identify registered UST's
located at surrounding properties and at the site. The site was not identified to contain registered
USTs. No adjacent properties or area sites were listed to contain registered underground storage
tanks.

6.6 Landfills
A review of public records6 did not identify solid-waste landfills on the site or within one mile
of the site.
6.7 Water Wells
We contacted the Groundwater Section at the North Carolina Department of Environment.
Health and Natural Resources - Division of, Environmental Management for information
regarding the water supply wells at adjacent residential properties. Mr. Zehid Kahn stated that
their office has a file for water supply wells in Union County and that it appears some analytical
testing of water has been performed on nearbv: wells to the site. Mr. Kahn said that the file
would have to be reviewed to determine information pertinent to the area wells.

8.0 QUALIFICATIONS
The opinions included herein are based on the information obtained during the study and on our
experience with similar projects. This report is based on limited observations made on the dates
noted and using the procedures described herein. The findings of our assessment are relevant
to the dates of our site work and the publication dates of regulatory lists. This report should not
be relied upon to represent site conditions at substantially later dates. If additional information
becomes available, we request the opportunity to review the information, reassess the potential
environmental concerns and modify our comments and recommendations, if appropriate.
This report is intended only for the use of the Union County, subject to the Terms and
Conditions of our Asreement. The contents of this report should not be relied upon by any
other parties without the express written consent of Law Engineering.

Gentlemen:
I have been requested by John Munn, County Manager for Union
County, to furnish to you as part of your environmental site
assessment of the above referenced property, a history of the
ownership of the 122.82 acre site. I have reviewed the land
records of Union County and have constructed a chain of title for
the property which runs back at least 50 years, which I
understand will be sufficient for your site evaluation purposes.
The chain of title on this property has to be broken down into
six tracts in order to be understandable. I have identified the
six portions of the property as Tracts 1(a), 1(b), 2, 3, 4, and 5
and have attached a color coded map identifying each of the six
parcels.
The chain of zizie for Tract i (a) is as follows:
1. Deed dated March 2, 1935 from Clyde Jones, agent and
conservator-for North Carolina Bank and Trust Company to C.A.
Deal, C.M. Deal and A.J. Deal. This deed is for a tract
containing 76 1/3 acres of land. The consideration is recited to
have been $1,000.00. Attached to the deed is a copy of an order
entered by H. Hoyle Sink, Superior Court Judge for the Twelfth
Judicial District of North Carolina ordering the transfer and
sale of the property by Mr. Jones to the Deals. The deed is
recorded in Deed Book 79, Page 461 of the Union County registry,
with the order being recorded in Deed Book 79 at Page 462 of the
Union County Registry.

SUBJECT: 401 Water Quality Certification for Weddington High School, Union County,
Culvert Creek, Catawba River Basic l J p-y: (p 15??
Staff biologists with the Wildlife, Resources Commission have completed a review of the
subject application to assess impacts on wildlife and fishery resources in the area. Our comments
are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et
seq.), and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-
667d).
The applicant is requesting to impact 0.27 acres of wetlands and 400 linear feet of stream
on an 88-acre site for the construction of a high school. A total of 2.44 acres of wetlands and
streams exist on the site. A portion of a soccer field and an athletic practice field is proposed for
placement within the 100-year floodplain of Culvert Creek.
The remaining wetlands on the site are proposed for protection. A forested buffer will be
maintained along remaining perennial stresms on the property, Wetlands, streams and stream
buffers are proposed to be protected from future impacts.
We appreciate the county's efforts to protect remaining wetlands and buffers from future
development and to minimize overall impacts of the project.
We do recommend against placing fill or other structures, which will reduce flood
storage, within the 100-year floodplain. Floodplains serve important water quality and storage
functions and reducing this storage capability can have adverse impacts on downstream liabitat
and property.
We have the following recommendations on this project:
1, Require that stormwater best management practices be installed to treat stormwater. We
recommend that stormwater from buildings, parking lots and highly manicured playing

fields be routed through wet detention ponds prior to discharge to the wetland or stream
channel.
2. Requiro the remaining wetlands to be protected from future impacts as proposed by the
upplieant. Sufficient low-energy stormwater should bo routed to wetland areas to
maintain hydrology.
3, Redesign the layout of the school to reduce impacts to the 100-year floodplain, which
would also reduce the impacts to wetland area C.
