Dreyfuss and Brame, Thank you for your PCN and attached information, received 9/25/2019, for the above referenced project. I have reviewed the information and need clarification before proceeding with verifying the use of Nationwide Permit 29 (http://saw-reg.usace.army.mil/NWP2017/2017NWP29.pdf). Please submit the requested information below (via e-mail is fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the Nationwide Permit or consider your application withdrawn and close the file: 1 1) Your PCN included impacts to streams and wetlands, however these and other potential jurisdictional boundaries have not been verified by the USACE. In fact, there is currently an existing Approved Jurisdictional Determination (AJD, valid until 7/14/2020) on this site, and the recently completed delineation does not match the existing AJD. Given the fact that the old pond bed on -site had been recently drained prior to our previous site visit (on 5/28/2015), and the likelihood of changes in the location of stream channels and wetland boundaries in these areas following drainage, the Corps has granted a re-evaluation of the extent of potential waters of the US on site. As such, a field verification site visit has been scheduled with Pilot Environmental (agent) on 10/23/2019. Please note that revisions to the PCN and plans may be necessary depending on the results of the field verification; 2) Since multiple culvert pipes are proposed at the stream/wetland crossing, it will have to be designed to comply with NWP 29 Regional Conditions 3.6; this typically involves designing one pipe to accommodate low flow in the existing channel, and then placing the remaining pipe as a high flow pipe, typically set a foot or two above the existing thalweg (Regional Condition 3.6.2). 1 have also seen sills placed on the high flow pipe to meet this condition. Please re -design accordingly; 3) "Culvert Cross -Section #1" indicates that the culvert will be buried 1-foot below existing stream bed grade, with the rip rap pad then being placed at the existing stream bed grade. This would have the effect of low flow water flowing under the rip rap, which would not meet NWP 29 General Condition 2 or Regional Conditions 3.6.1. Please re -design the rip rap pad to ensure that low -flow water will flow on top of the rip rap pad, either through adding a grade control (e.g. cross -vein) set at the existing stream bed grade at the down -stream end of the rip rap pad, or some other means. 4) Sheet C1 shows a line extending west from the western terminus of Bryant Court across Stream ISA. Does this line represent a utility crossing or any other infrastructure that would require Corps authorization? 5) The location where the western extent of the proposed Cameron Lane terminates at the west property line would necessitate a stream crossing if the road were ever extended onto the adjacent property. Could future stream impacts be avoided with a re -design of this portion of the road? Please let me know if you have any questions. -Dave Bailey David E.
