Aqua North Carolina, Inc. (Aqua) offers the following response to the above -referenced Notice of Violation
(NOV):
A ua' s Response:
The NOV references a wastewater residual dewatering facility. Aqua does not operate a
residual dewatering facility at this location.
Violation I —
a. I. PERFORMANCE STANDARDS — It states, "creation of nuisance conditions due to
improper operation and maintenance, or failure of the utilization areas to adequately
assimilate the reclaimed water". The inspection does not indicate any improper
operation and maintenance nor the failure of the utilization area to assimilate the
reclaimed water. As such, there is no violation of this permit condition and the Notice
of Violation should be rescinded.
b. With respect to odor, we believe the odor is due to effluent age in the spray irrigation
force main. Aqua has previously offered to inject sodium hypochlorite into the force
main to stop anaerobic biological activity (which causes malodors) and the ORC Brian
Peters with Century Golf, refused on behalf of the golf course and HOA. It is worth
noting that Aqua's contract responsibilities ends at the irrigation pond. Aqua is
prohibited from installing infrastructure on the irrigation facilities without the owner's
approval.Aqua is currently discussing options for calcium nitrate feed (i.e. Bioxide)
with Evoqua and pending positive test results and Century Golfs approval, Aqua will
submit an Authorization to Construct for a Calcium Nitrate feed system at the pump
station. We may request approval for a pilot test of the material prior to design
completion.

3. Violation 2 - IV. MONITORING AND REPORTING REQUIREMENTS -
a. For Items 1 through 4, there was no application on the subject fields in January 2019,
February 2019, March 2019, and May 2019. Failure to mark the "No Application" on
a NDAR was an oversight and the revised NDARS are being compiled and submitted.
b. For Item 6, the NDMR was submitted on October 17, 2019.
c. For Item 7, our records indicate the pH and Residual Chlorine data was submitted.

4. Lastly, the spray field ORC is a Century Golf employee. Aqua has had issues with
communication and compliance with the ORC, and Aqua has been in communication with their
management to find a reasonable solution that prevents recurrence of the NDAR reporting
issues.
