Re: Upchurch Property; Neuse River Buffer Determination
Dear Mr. Zarzecki:
At your request, I made a site visit to the Upchurch property on Rand Road near
Garner in Wake County on July 7, 1998. The purpose of the site visit was to determine
presence of any intermittent or perennial stream that would be subject to the Neuse River
Buffer Rules requiring a 50 foot wide vegetated buffer along its banks.
On the southeast side of the property stormwater collects into a small channel for
about 100 feet before entering a pond just below the property line. The USGS Garner
Quad shows definitive contours lines extending into the property'but dose not show the
pond or a stream. The SCS soils map for Wake County shows an intermittent channel
extending well up into the property. Using the DWQ stream determination criteria I
identified the beginning of the intermittent stream at the S&EC flag marked #100. At that
point the concentrated stormwater drops across a nick point under a large sweetgum tree
and the channel shows signs of scour and standing water. About forty feet below this
point there is water standing in channel and some aquatic life. Since there is existing
forest vegetation around the channel, the stream would be subject to the 50 foot wide
buffer in the Neuse River Buffer Rules as currently in effect.

WETLANDS & NEUSE BUFFER REPORT
Wetlands:
In June 1998, the property was traversed on foot and the soils, vegetation and hydrology evaluated and
wetland areas examined by current procedures described in the 1987 U.S. Army Corps of Engineers
(Corps) Manual for Identifying and?Delineating Wetlands.
We have determined that a marginal drainage feature exists on the site known as the Upchurch Property
located south of Rand Rd. and east of Whiteoak Tr., Garner, NC (see attached map). 'We believe that this
marginal area is ephemeral in nature and not jurisdictional. The drainage contains some hydric soils and
hydrology, but no plants. Although the drainage contains a nick point and defined banks, other
'characteristics such as fibrous roots and non-hydric soils suggest that it only contains surface flow during
heavy storm events. This determination should be confirmed by the Corps. No wetlands or Waters of the
U. S. were found anywhere else on the tract.
Delineation approval and wetland permits cannot be granted unless we have agent authorization (see
attached: Agent Authorization). This authorization form must be filled out by the current landowner and
sent to S&EC (a faxed copy is fine). ,

that exist on this property wouldbe.subjecl to the Neuse River Basin Nutrient; Sensitive Waters E

"Management q1 rategy rules protecting existing riparian areas. It is my professional opinion; due to
characteristics described in paragraph two, that the marginal drainage feature is ephemerally driven and
1V . not an,intermittent stream and.not subject to the NRB 50 foot buffers. This:deterrwnatlon should be
confirmed the DWQ. The marginal drainage feature is not indicated on the most recent version of the
Garner, N.C. USGS topographic quadrangle.;
These new rules, which came into effect on 7/22/97, protect up to 50 feet from the edge of existing
"surface waters" (intermittent streams, perennial streams, lakes, ponds and estuaries) found within the
Neuse River Basin. The 50-foot buffer basically consists of two zones. The first zone is measured 30 feet
landward from the top bank of intermittent streams and ponds and intended to contain an undisturbed-
forested area. The second zone is measured 20 feet from the edge of the first zone and is intended to,
contain a vegetated buffer. Removal of grass clippings, timber, etc. is allowed on a periodic basis within
