On July 20, 1998, you requested a variance from the Neuse River buffer rules from
the Division of Water Quality for your project (Hoover Road Industrial Site) located near
Hoover Road in Durham County. In a recent telephone conversation, you indicated that
your client wanted to withdraw his request for a variance. Unless we receive a written
response from you by September 1, 1998, we will consider that you have withdrawn this
application and are not interested in pursuing the project at this time.

Thank you for meeting with Tom Kagerise and me yesterday. We request a site visit to determine the type
of stream (perennial or intermittent) on the Hoover Road property. This request is in regards to both 401
rules and the Neuse River Basin rules. We are requesting a variance for the Neuse River rules and hope to
submit our package to you for evaluation by August 21, 1998. This is in anticipation of meeting the
deadline for the EMC meeting on Thursday September 10, 1998.
Refer to the attached maps for the site location. Please call (682-0368) to let us know when you will be
able to evaluate the stream. We can meet you at the site or at our office in downtown Durham.
