Dear Mr. Bowden:
You have our approval, in accordance with the attached conditions and those listed below, to place fill
material in 0.1 acres of wetlands or waters for the purpose of replacing an existing culvert and restoring a
streambank, as you described in your application dated July 7, 1998. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows
you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. This approval is also valid for
the Neuse River buffer rules (15A NCAC 2B .033). In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when
the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application.. If the property is sold, the new owner must be given a copy of this Certification and approval
letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or
in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506
(h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification
and any additional conditions listed below.
1. Written DWQ approval is required for the stream realignment plan before impact occurs. This plan must
include detailed bioengineering details including tree planting.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are
final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

(60" RCP) with a double 9'x 5' box culvert to relieve frequent flood of the Homes and roadway in

Downstream channel has clogged with silt/sediment which has reduced the hydraulic capacity of
the culvert system. Replacement of the culvert system must be supplemented with downstream
channel work to provide the design capacity of the culvert system and to ensure the system is
maintainable. The defined channel created downstream of the culvert outlet will be protected with
rip rap toe protection and soil bioengineering application above the toe.

CONSTRUCTION SCHEDULE
1. Obtain plan approval and other applicable permits.
2. Flag the work limits and mark all tree removal areas and tree protection areas.
3. Hold a pre-construction conference at least one week prior to starting construction.
4. Excavate outlet channel and install permanent outlet protection (rip-rap toe protection
and bioengineering slope protection above rip-rap).
5. Install temporary rock check dams in outlet channel to reduce downstream
sedimentation due to culvert and channel improvement construction.
6. Install temporary diversions along entire alignment of culvert replacement to divert
minor flow from construction area.
7. Remove existing 60-inch storm drainage pipe.
8. Drive sheet pilesalong entire length of excavated trench.
9. Install temporary filter fabric and rip-rap to protect excavated construction area from
erosion.
10. Install cofferdams to divert flow to one side of the construction area.
11. Construction box culvert bottom slab and sidewalls along entire construction area for
one cell of the box culvert. Culvert concrete forms and cofferdam installation must
be installed in a temporary fashion so that they can be removed to provide an un-
obstructed flow area for large storm events.
12. Upon completion of the placement of one cell of the box culvert, divert storm
drainage flow into the completed cell. Complete the box culvert bottom slab and
sidewall installation.
13. Complete culvert installation with construction of top slab and backfilling.
14. Install upstream channel improvements along with rip rap toe protection and
bioengineering protection above rip rap.
15. Inspect all erosion and sediment control practices, cofferdams, filter fabric, etc.
weekly and after rainfall events. Repair any damage immediately.
16. After site is stabilized, remove all temporary measures and install permanent
vegetation on the disturbed areas.
17. Estimated time before final stabilization 3 months.
