After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: The applicant proposes to replace an existing covered boat slip area with a new structure, and stabilize 750 linear feet of the existing marina basin's shoreline with large stone rip rap. Pgrt Cape Fear Marina Page 2 9. PROTECT DESCRIPTION The project site is the existing Port Cape Fear Marina facility, located adjacent to the Cape Fear River, at 3410 River Road, in Wilmington, NC. The inland basin is approximately 700 feet long and 300 feet wide, and includes 78 wet slips (15 covered wet slips), a travel hoist, and a boat rail system, with associated temporary dockage between the boat hoist and rail. The marina is accessed from the Cape Fear River by an access channel, approximately 2200 feet in length and 100 feet wide. The surrounding highground currently includes a service/repair building, office, parking, and a permanent, diked spoils disposal area. The Cape Fear River is classified as SC waters by the NC Division of Water Quality. It is a designed Primary Nursery Area (PNA) by the NC Division of Marine Fisheries. The applicant has an active permit for continued maintenance excavation of the marina basin (700' X 250' X -6) and entrance channel (2220' X 100' X -6'). The applicant is proposing to. modify this permit to increase the permitted excavation depth from -6 feet to -8 feet at mean low water (MLW). During low water conditions, the larger, deeper draft vessels utilizing the facility, cannot safely navigate to the federally maintained river channel (-32 feet @ MLW). The applicant also proposes to replace the covered boat slip structure. The existing 20 year old building would be removed and new one constructed. The new structure would be approximately 360 feet long and 85 feet wide, and would include a six (6) feet wide dock the length of the building , with 17, four (4) feet wide finger piers (5@30', 6@36', 6@25') to accommodate 17 boat slips. During the installation, the applicant plans to complete the excavation of the small peninsula (approx. 90' X 40') at the south end of the existing covered slip area. This excavation was previously permitted during the basin expansion, but never completed. In conjunction with these improvements to the facility, the applicant also proposes to stabilize the shoreline along the rear of the covered boat area, as well as, the basin's northern shoreline. The vertical bank would be graded to a 2:1 slope, covered with filter fabric and large stone rip rap. The total length of the rip rap would be 750 feet, and it would extend approximately 10 feet into the marina basin, below mean high water. 10. ANTICIPATED EMPA T The proposed deepening of the facility would disturb approximately 409,500 square feet of previously dredged bottom. The proposed rip rap would incorporate 7,500 square feet Estuarine Waters and Public Trust Area within the existing inland basin, as well as, stabilize 750 linear feet of the basin's shoreline. Excavation of the peninsula would convert 3600 square feet of highground, to Estuarine Waters/Public Trust Area, and may possibly enhance water circulation within the marina.. PROJECT SUMMARY: The applicant proposes to replace an existing covered boat slip area with a new structure, and stabilize 750 linear feet of the existing marina basin's shoreline with large stone rip rap. Port Cape Fear Marina Page 2; 9. PROTECT DESCRIPTION The project site is the existing Port Cape Fear Marina facility, located adjacent to the Cape Fear River, at 3410 River Road, in Wilmington, NC. The inland basin is approximately 700 feet long and 300 feet wide, and includes 78 wet slips (15 covered wet slips), a travel hoist, and a boat rail system, with associated temporary dockage between the boat hoist and rail. The marina is accessed from the Cape Fear River by an access channel, approximately 2200 feet in length and 100 feet wide. The surrounding highground currently includes a service/repair building, office, parking, and a permanent, diked spoils disposal area. The Cape Fear River is classified as SC waters by the NC Division of Water Quality. It is a designed Primary Nursery Area (PNA) by the NC Division of Marine Fisheries. The applicant has an active permit for continued maintenance excavation of the marina basin (700' X 250' X -6) and entrance channel (2220' X 100' X -6'). The applicant is proposing to modify this permit to increase the permitted excavation depth from -6 feet to -8 feet at mean low water (MLW). During low water conditions, the larger, deeper draft vessels utilizing the facility, cannot safely navigate to the federally maintained river channel (-32 feet (& MLW). The applicant also proposes to replace the covered boat slip structure. The existing 20 year old building would be removed and new one constructed. The new structure would be approximately 360 feet long and 85 feet wide, and would include a six (6) feet wide dock the length of the building , with 17, four (4) feet wide finger piers (5@30', 6@36', 6@25') to accommodate 17 boat slips. During the installation, the applicant plans to complete the excavation of the small peninsula (approx. 90' X 40') at the south end of the existing covered slip area. This excavation was previously permitted during the basin expansion, but never completed. In conjunction with these improvements to the facility, the applicant also proposes to stabilize the shoreline along the rear of the covered boat area, as well as, the basin's northern shoreline. The vertical bank would be graded to a 2:1 slope, covered with filter fabric and large stone rip rap. The total length of the rip rap would be 750 feet, and it would extend approximately 10 feet into the marina basin, below mean high water. 10. ANTICIPATED IMPACTS The proposed deepening of the facility would disturb approximately 409,500 square feet of previously dredged bottom. The proposed rip rap would incorporate 7,500 square feet Estuarine Waters and Public Trust Area within the existing inland basin, as well as, stabilize 750 linear feet of the basin's shoreline. Excavation of the peninsula would convert 3600 square feet of highground, to Estuarine Waters/Public Trust Area, and may possibly enhance water circulation within the marina..
