I spoke with you about a possible violation of the Neuse buffer rule, just off Lead Mine Road just north of Crabtree Valley in Raleigh. Here's a map, as requested. You can see I've written and drawn in the intermittent stream. It's pretty obvious. It's at the bottom of the hill. In wetter time, there's running cedar growing near it. The big green circle is, as designated, naked dirt. It surely looks to me like a violation of the Neuse buffer rule. The only way it's not is if this is not a stream. Since the definition is still not law, that's hard to say, I suppose. I'll be eager to hear your findings. If you have 10 extra minutes and are a nature lover, drive on to French Drive, walk along the very edge of the yard (where I wrote "walk here") and go see the frog pond. Only a few people know it's there, and it's heavily populated with green and bull frogs, whom you will hear croaking and see leaping out of your way. It feels like a million miles from any city. C7 , To: ccnc@bellsouth.net Subject: Lead Mine Road site i Dear Ms. Bowen: Steve Mitchell from the Raleigh Regional Office and both looked at the area you are referring to in your 7/24/98 letter. We both determined that the channel through the logged area was a stormwater channel that had been dug out years ago. Below the the logged area the channel begins to take on the characteristics of an intermittent stream. Stormwater channels and manmade ditches are not subject to the Neuse Buffer Rules and therefore is no required buffer along them. There are jurisdictional areas along Lead Mine Creek. Don d'Ambrosi 280 Nottingham Dr.''` , Cary, NC 27511 Re: Preliminary Wetland and Neuse Basin Buffer Report: Leadmine Rd./Smith Site (± 107 acres), Raleigh, Wake County, NC Dear Don: WETLANDS In March 1998, the property was traversed on foot and the soils, vegetation and hydrology evaluated and wetland areas preliminarily examined by current procedures described in the 1987 Corps Manual for Identifying and Delineatine Wetlands. We have determined that no definite jurisdictional stream channels or wetland pockets exist on site. (See attached map). One marginal channel is present. No wetlands or Waters of the U.S. were found anywhere else on the tract out- side of the 100 year floodplain of Leadmine Creek (Areas within the floodplain of Leadmine Creek were not evaluated If the project moves forward, our determination should be reviewed by the Corps and DWQ in order to obtain their written concurrence with our findings. Recent Section 404 rule changes prevent the loss of more than 500 linear feet of stream beds and/or 3 acres of wet- lands by Nationwide Permit 26. An Individual Permit would likely be required if project impacts exceed these thresh- olds. A wetland delineation map and the site development plan can be used to determine a projects' eligibility for Na- tionwide wetland permits. Findings Potential wetland areas on the site were evaluated for the presence of hydric soils and evidence of hydrology and vege- tation. In these areas, hydrologic proof would be in the existence of hydric soils with oxidized root channels in the up- per 12 inches of the "A" horizon. Other indicators of hydrology include: water borne deposits, drift lines. scour marks, and regional indicators of soil saturation, etc. Wetland Delineation/Permitting/Mitigation Soil/Site Evaluation for On-Site Septic Systems Environmental Assessments Branch Office: 231 16th Ave. N.E. Hickory. North Carolina 28601 Phone: (704) 322-6700 Fax: (704) 327-9164 Permitting Wetland impact permits are issued on a per-project basis as determined by the Army Corps of Engineers. The Corps has determined that impacts on parcels sub-divided from larger tracts are sometimes considered to be cumulative to existing impacts for the large tract. If this is the case, then thresholds as discussed below may not apply and impacts to wetlands must be considered in light of existing permits. Prior construction notification to the Corps is not required for impacts less than 1/3 acre above headwaters if impacts to streambeds are less than 500 linear feet and if no other Nationwide Permit is required. Prior construction notification to DWQ is not required for impacts less than 1/3 acres above headwaters if impacts to channels are less than 150 linear feet. If impacts are greater than 1/3 acres and are due to commercial development then a stormwater pond may be required. (Headwaters is defined as a stream with an average flow of 5 cfs; in this area, roughly a 3,500 acre drainage area). Impacts to vegetated wetlands in excess of these thresholds may require mitigation. Wetland mitigation is a complex process that requires planning and monitoring. S&EC will discuss mitigation issues with you if we believe your project may require mitigation. Impacts to channels in excess of the linear footage thresholds may require mitigation. Channel mitigation is typically intended to replace lost significant aquatic functions and values. Relocating channels is considered to be an adverse impact and typically results in mitigation within the new channel. This mitigation typically requires that meanders be created and side-slopes and beds be vegetated; rip-rap is discouraged. Nationwide Permits and prior construction notifications have a maximum 45 day processing period while Individual Permits have no processing periods. Recent rule changes require that all impacts to wetlands, less than 1/3 acre, be reported to the Corps within 30 days of the completion of construction. If you choose to have us perform additional work, the following is a listing of additional services. None are required by law unless impacts are proposed, but some clients prefer to have them: Request that the Corps and DWQ verify our delineation, notification to the Corps and DWQ regarding impacts to jurisdictional areas (if any). Another purpose of this letter is to update you on the current status of the Neuse River Basin Buffer Zone rules. A site meeting would be needed to illustrate the areas within your project that may be regulated. Any stream channel with or without wetlands could be. We do not believe any areas on your site except Leadmine Creek are subject to these rules, but we recommend that we have DWQ concur that the marginal channel shown on the attached is not. Neuse Basin Buffer Rules Basically, the buffer zone is made up of two sections which extend a total of 50 feet from the center of all channels and from the edge of all ponds and lakes surrounded by "forest vegetation". The inner section is 30 feet wide and must contain "forest vegetation" (i.e. only "high value timber" can be removed). The outer section measures 20 feet and can be selectively cleared of high value species but must be maintained as a forest environment. However, building and other construction type activities (i.e. grading), with the possible exceptions of road/ utility crossings, are prohibited within both sections. Furthermore, sheet flow must be encouraged within both sections, and adjacent drainage ditches must be constructed so that water does not form channels through the buffer zone. At this time, all forested stream channels represented as blues lines on the most recently published USGS 7.5 minute quadrangles, within the Neuse River Basin, are subject to the new rules. Additionally, DWQ intends to use "site specific data" to establish buffer zones around areas of surface water that are not shown on the USGS quadrangles. Based on our recent site visits with DWQ staff, they intend to apply the buffer to most channels considered jurisdictional, regardless of size or acreage (see attached map for our estimates of areas subject to these rules).
