This permit, issued on April 4; 2008 is subject to compliance with the application (where consistent with
the p ermit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to tines, imprisonment or civil action; or may cause Lne perliilL w vc hull MW Vvlu.
Pier and Docking Facility
1) Unless specifically altered herein, this permit authorizes only the access piers, platforms, finger piers
and docking facility, all -as expressly and specifically set forth in the permit application and workplan
drawings. No other structure, whether floating or stationary, shall become a permanent part of this
facility without permit modification. No non -water dependent uses of structures shall be conducted
on in or over public trust waters without permit modification. Contact a representative of the
Division at (910) 796-7215 prior to the commencement of any such activity for this determination.
2) No attempt shall be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2011
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) Any portion of the permitted access pier and docking facilities built over coastal wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.
4) No portion of any permanent structure (including pilings) shall be installed within 80 feet of the near
bottom edge of the federally maintained channel.
5) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's riparian access corridor, which is determined by
drawing a line parallel to the channel, or deep water, then drawing a line perpendicular to the channel
line that intersects with the shore at the point where the upland property line meets the water's edge.
6) In order to ensure compliance with Conditions 4) and 5) of this permit, an as -built survey depicting the
authorized structure, the location of the federally maintained channel and corresponding setback shall be
performed and a copy of the survey provided to the Division of Coastal Management, within 60 days of
completion of construction of these portions of the project.
NOTE: Failure to comply with the survey requirements referenced in Condition No. d of this permit may
result in a permit violation.
7) The permittee's shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee's are not relieved of this requirement if they abandons the
permitted activity without having it transferred to a third party.
8) The permittee's shall install and maintain at his expense any signal lights or signals prescribed by the
U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum,
permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
9) It is possible that the authorized structures may be damaged by wave wash from passing vessels. The
issuance of this permit does not relieve the permittee's from taking all proper steps to ensure the
integrity of the permitted structure. The permittee shall not hold the State of North Carolina nor the
United States liable for any such damage.
10) This permit authorizes a maximum of four (4) boat slips.
11) The two authorized covered gazebos shall not be enclosed. Any material used on the sides shall not
obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches
and knee walls are permitted. Lattice is specifically excluded from being used under this authorization.
12) The roofs of the covered gazebos shall not be designed for second story use.
13) No vegetated wetlands or open water areas .shall be excavated or filled, even temporarily.

General
14) The permittee's understands and agree that, if future operations by the United States require the
removal, relocation, or other alterations, of the structure or work herein authorized, or if, in the opinion
of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to the free navigation of the navigable waters, the permittee's shall be required,
upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or
obstructions caused thereby, without expense to the United States or the State of North Carolina. No.
claim shall be made against the United States or the State of North Carolina on account of any such
removal or alteration.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.

such activity for this determination.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No.
197800056 (COE Action Id. No. 2008-00928-010), which was issued on 3/12/08.

DCM has determined that no substantial development has occurred since the last permit action, therefore, this
project does not qualify for a renewal under CRC rule 15A NCAC 07J.0404(b). However, subsection (c) allows
the Division of Coastal Management to circulate the request to the state agencies to determine if any changes
in circumstances or in development standards warrant a new application and CAMA major permit
review. DCM is not aware of any proposed changes to the previously authorized project.

9. PROJECT DESCRIPTION:
The project site is located along the property lines of Lots 57 & 58, Section 13 of the Seawatch at Sunset
Harbor subdivision, adjacent .to the AIWW, in Oak Island ETJ, Brunswick County. To get to the property
take NC Hwy 17 south from to
and turn left onto Southport -Supply Road (NC HWY 211).
Continue on Southport -Supply Road approximately 4-5 miles and turn right onto Sunset Harbor Road.
Continue south on Sunset Harbor Road for approximately 4.7 miles (from intersection of Southport -Supply
Road and Sunset Harbor Road) and turn left into waterway villages at Seawatch (dirt road). Continue
along the dirt road for approximately 800 ft. and turn right onto aceano Passage. Follow Oceano Passage
and the road runs directly into Lots 57 & 58.
The subject properties total approximately 0.89 acres and are currently undeveloped. High ground
vegetation at the site consists of Live Oak and Pine. The understory vegetation has been cleared. The high
ground is bordered to the south by a variety of coastal wetland species including. Smooth Cordgrass
S' antina alt rni ova and Black Needle Rush (�Iuncus roemarianus}. High marsh coastal wetland species
(p }
including;. Spike Grass (L)istichlis spicata}, Black Needle Rush (JTuncus roemarianus), and Salt Meadow
Grass ( ,partina patens} complete the transitional zone to the high ground.
The applicants (Jeffrey and Cheryl Beale) and co -applicants (Edward and Annie Dougherty) have
requested a joint filing for this CAMA Major Permit application. The proposal includes the construction of
a four -slip docking facility on the subject property, listed with the Brunswick County Tax office as Lots 57
& 58, Section 13 of the Seawatch at Sunset Harbor subdivision. The applicant and co -applicant have
provided documentation granting permission for Coastal Communities, Inc. to lease the subject pier and
docking facility for sales and marketing purposes of the Seawatch at Sunset Harbor S/d.
The Brunswick County Land Use Plan classifies the area as Conservation. The .waters of the ArEE, in the
vicinityof the subject properties, are classified SA, by the Division of water (duality. The Division of

Marine Fisheries does NOT designate the area as a Primary Nursery Area (PNA) and the area is
CLOSESD to the taking of shellfish.
PROPOSED PROJECT:
The applicant's are proposing to construct a shared pier with a fixed "horseshoe" shaped dock, two
gazebos, two floating docks and two, boatlifts. The pier structure (6' x 174') would originate from the high
round portion of the property and extend towards the south, crossing a 400section of coastal wetlands,

and terminating short of the Corp of Engineers 84 Federal Channel setback. The p

gazebos would be constructed at opposite ends of the fixed spine. A gangway would connect to each of the

10. ANTICIPATED BVACTS:
As proposed, the planned development would be located within the applicant's area of riparian access.
Additionally, the proposed structure does not appear to extend beyond, or into, the edge of the adjacent
channel, nor does it appear to exceed 1/4 of the width of the waterbody.
The construction of the proposed finger piers and boatlifts would incorporate an additional 2,028 sq. ft. of
estuarine waters and public trust area.

will temporarily dock a boat in order to tour the property and waterway. When sales and marketing are complete, the dock
will remain private use for the applicants.
