Subject: Draft NPDES Permit Renewal
Permit NC0024538
First Broad River WWTP
Cleveland County
Grade IV Biological WPCS
SIC Code 4952
Dear Mr. Hux:
Enclosed with this letter is a copy of the Draft NPDES permit renewal for your facility. Please
review this draft carefully to ensure thorough understanding of the requirements and conditions it
contains. There are several changes from the existing permit, including the following:
• The Supplement to Permit Cover Sheet has been modified to reflect the upgrades made to
the system as outlined in Authorization to Construct (AtC) Permit No. 024538A02,
completed with the Engineer's Certificate signed on April 15, 2016.
• Regulatory citations have been added to the permit.
• Parameter codes have been added to the Effluent Limitations and Monitoring Requirements
[See A. (1.)].
• Based on: reporting requirements in 15A NCAC 2B .0500, the fact that the facility has an
active pretreatment program, and downstream conductivity tested higher than upstream
conductivity with high statistical significance, daily effluent monitoring for Conductivity
has been added to the permit [see Section A. (1.)].
• The NC 2007-2014 Water Quality Standard(WQS)Triennial Review was approved by the
NC Environmental Management Committee(EMC) on November 13, 2014. The US EPA
subsequently approved the WQS revisions on April 6, 2016 with some exceptions. The NC
Division of Water Resources NPDES Permitting Unit is required to implement the new
dissolved metal standards in all permits public-noticed after April 6, 2016. The new
standards for most metals include acute standards. Further, the freshwater standards for
several metals are expressed as the dissolved form of the metals, and seven metals have

hardness-dependent equations. As a result, the NPDES Permitting Unit will need site-
specific effluent hardness data and instream hardness data, upstream of the discharge, for
each facility monitoring these metals in order to calculate permit limitations. Effluent
hardness and instream hardness sampling, upstream of the discharge, have been added to
the permit at a quarterly monitoring frequency[See A. (1.)].
• The City of Shelby reported Total Silver at less than detection, with detection levels < 1
µg/L and < 5.0 µg/L in their DMR results. The City's allowable discharge concentrations
are 0.346 µg/L (chronic) and 1.456 µg/L (acute) for Total Silver. DWR's laboratory
identifies the target Practical Quantification Limits (PQLs) for Total Silver as 1.0 µg/L.
15A NCAC 2B .0505 (e) (4) requires that all test procedures must produce detection and
reporting levels that are below the permit discharge requirements and all data generated
must be reported to the approved detection level or lower reporting level of the procedure.
If no approved methods are capable of achieving a detection level below the permit
discharge requirement (or allowable discharge concentration) the method with the lowest
detection level must be used. The City should use sufficiently sensitive test methods for all
pollutants, including when performing Effluent Pollutant Scans. Quarterly monitoring of
Total Silver has been added to the permit.
• Effluent Mercury data were reviewed from November 2016 to August 2019.The Permittee
tested effluent mercury using EPA Test Method 1631E throughout this period. In
accordance with the 2012 Mercury TMDL NPDES Guidance, the Permittee needs to show
annual average effluent concentrations below the Water Quality Based Effluent Limitation
(WQBEL) of 69.2 ng/L and no individual concentrations above the Technology Based
Effluent Limitations (TBEL) of 47 ng/L. No such exceedences occurred; therefore, no
mercury limitation is required.
• Six (6) out of 12 low level effluent mercury samples collected were over 1 ng/L. As a
result, the Mercury Minimization Plan (MMP) requirement is maintained in the permit
renewal. Some of the wording in the MMP special condition has changed;please review it
carefully. See Special Condition A. (4.)—Mercury Minimization Plan.
• Based on documentation of 1,4-Dioxane entering the WWTP from groundwater
remediation activities as reported in the permit renewal application, and concentrations of
the emerging compound quantified in annual remediation activity reports to the NC
Division of Waste Management, quarterly monitoring of 1,4-Dioxane has been added to
the permit [See A. (1.)].
• Some of the wording has been changed in Special Condition A. (2.), Chronic Toxicity
Permit Limit. Please review each paragraph carefully.
• Special Condition A. (3.) has been modified to include the specific three years in which
the Effluent Pollutant Scan shall be performed (2021, 2022, and 2023). In addition, at the
end of the Special Condition, 2na species Toxicity Testing Requirements for municipal
permit renewals per Federal Regulations [40 CFR 122.21(j)(5)] have been added.
• Federal regulations require electronic submittal of all discharge monitoring reports
(DMRs)and program reports. The requirement to continue reporting discharge monitoring
Page 2 of 3
data electronically using the NC DWR's Electronic Discharge Monitoring Report(eDMR)
internet application has been added to your NPDES permit [See A. (5.)].
The NPDES standard conditions (Parts II, III, and IV)that are a part of the permit are not included
in this draft document (cover, map, and Part I). The conditions are the same as in your current
permit except that agency and division names have been updated. The latest version is available at
https://bit.ly/2BZ4xxx and can be viewed online or downloaded as a PDF file.
