After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3101, 3103 and 3108. These certifications allow you to use Nationwide Permit Numbers 12, 14 and 26 when the Corps of Engineers issues them. This approval is also valid for the Neuse River buffer rules (15A NCAC 213 .033). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This Certification replaces the one issued to you on September 29, 1998. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Conservation easements shall be placed in all lots with remaining jurisdictional wetlands and waters and on areas within 50 feet of al streams on the property to restrict future wetland and/or water impact. These mechanisms shall be put in place at the time of recording of the plat. 2. Wetland and stream fill is allowed for sites "E" and "F" and the road bed only. 3. Wetland fill is not allowed at location "D". 4. The invert of the pipe under the road must not be lower than the elevation of the wetland in location "D". 5. The forest vegetation within 50 feet of all streams and on the old dam within 50 feet of the stream shall not be removed unless a variance is granted by the EMC or unless rules are changed to allow this removal. 6. A 50-foot wide wooded buffer shall be planted adjacent to the stream and stormwater form adjacent lots shall be directed to sheetflow through the buffer. Dickerson, RLS I am writing this letter to follow-up our correspondence to Mr. Kevin Martin on September 2, 1998 concerning the above referenced project. At Kevin's request, we also sent you a copy of the letter. The owners have reviewed this letter and requested that we further address the Kensington Hill Way alignment with respect to your letter to Mr. Gerald Smith dated August 19, 1998. This letter asked, "specifically can you construct your road crossing to avoid the forest ve etg ation by realigning the entrance road". As stated in our previous letter, the existing alignment of Kensington Hill Way has far less impact on existing forest vegetation than the removal of the existing leaking dam and placement of a new earthen dam embankment and spillway to meet the Town of Cary design criteria. This is readily visible on site. If the roadway is realigned downstream, the dam will have to be replaced to partially recoup the financial loss associated with loss of lots. The refurbished pond would allow for premiums to be added to all adjacent lot prices. Also, Kevin requested that we discuss the proposed level spreaders in further detail. We would install these level spreaders at all storm drainage outlets that discharge within required Neuse River buffer riparian areas. Our plans currently indicate a riparian buffer along the entire length of this drainage way. It is our understanding, however, that part of this riparian buffer area is not required due to the absence of forest vegetation. We hope that this additional information will assist you in your decisions concerning the 401 Water Quality Certification for this project.
