Dear John,
On behalf of Bob Anderson and in response to your letter of January 21, the above referenced
plans were revised as follows:
1. All stormwater conveyances are outside the 50 ft. Neuse River Buffer except the main 42"
cross pipe. Wake County requires the inlet and outlet protection for the pipe and the rip rap
stream crossing protection for the public sewer main. The total linear footage of affected
streambed is 140 ft.
2. All erosion control devices, except as noted above, were removed from the buffer.

I have reviewed the plans dated December 15, 1998, for this project. The plans
seem to show further encroachment on the buffer (than previously proposed) to,
apparently, accommodate erosion control sediment basins placed in zone 1 and 2 near the
entrance. The plans also show a stone check dam (presumably for erosion control) in the
buffered creek, immediately downstream of the road.
Also, the plans show part of the parking lot (south west side) with the stormwater
flow divided into six discrete "flumes"; however, there are no measures shown that
would create diffuse or sheet flow. The north east side of the property has a swale that is
directed toward the buffer which could possibly be made to flow in a diffuse manner to
the buffer; however, from the design shown, the swale might result in concentrated flow
to the buffer. Finally, at least part of the runoff will be captured and directly placed in the
creek channel at the road crossing. It is not clear where the roof drainage is discharged.

Please find the attached correspondence and plans dated June 16, 1998. This
appears to be a project that requires approval for impacts under the Neuse Buffer Rules
and possibly written approval under a Nationwide 14 Permit. I am not familiar with the
Nuese Buffer Rules yet, but I understand that storm drainage from the subject site should
be sheet flow. The attached letter dated July 16, 1998 (but not received by this Office
August 24, 1998), indicates some sort of vegetative/riprap distribution devices located at
the end of "flumes". However, the plans only show the "flumes". As a result, there is
nothing in these plans that provides for sheet flow. Also, it should be noted that a
stormwater management plan may be required.

The enclosed plans will show you how storm water is being handled in order to assure
sheet flow at the buffer limits. The parking area has concrete flumes positioned
adjacent to the buffer. The storm water has been subdivided to each of these flumes
in order to reduce the quantity and velocity of the runoff. Riprap will be located at
each flume and a seeded area will between the buffer and the riprap. We felt the
multiple flumes would satisfy the requirements due to area we have to work with
between the buffer and the parking lot.
The loading area in the rear will sheet flow into a riprap lined Swale with seeded banks
which will transition into a seeded area prior to entering the buffer.
I hope this will answer any questions you have regarding the storm water. 1 am
available to meet with you if you have any other questions. I would prefer this as to
sending comments back and forth to each other.

The Division of Water Quality has reviewed your submittal for approval under the
Neuse River buffer rules (15A NCAC 2B .0233) for commercial development at
Dominion Drive in Morrisville in Wake County. Your application was not complete
since no specifications of the stormwater management plan to ensure non-erosive,
sheetflow across the set-aside stream buffer was provided. Please provide information
regarding the location of your project. This information is needed by DWQ in order for
us to decide whether this project is approvable. Please send two copies of this plan to
expedite our review.
I can be reached at 733-1786 if you have any question. Until this information is
received, I will request (by copy of this letter) that the Corps of Engineers place this
project on hold. Also, the project will be placed on hold for our processing due to
incomplete information (15A NCAC 2H.0507(a)(4)).
