Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: The site is an aproximate 34.5-acre tract. The northern portion of the site contains a residential subdivision. The subdivision contains paved roads, stormwater devices, developed lots, graded/undeveloped lots and cleared areas. The remainder of the site contains wooded land, overgrown fields and a drained pond. Residential and commercial structures are located within the vicinity of the site. 3b. Explain the purpose of the proposed project: The purpose of the proposed project is to construct Villas on 5TH, a residential subdivision. 3e. Describe the overall project in detail, including the type of equipment to be used: The Vilas on 5T" is a 105 lot subdivision. Approximately 81 lots are in the process of development (cleared, graded, built upon, etc.). In order to construct the remainder of the subdivision (25 lots) and to satisfy City of Mebane requitrements, it is necessary to construct Cameron Lane across the site. Cameron Lane will provide interconnectivity within the subdivision and provides two accesses to the subdivision (one to Highway 119/S.5T" Street and a second to Mebane Airport Road). The road is being stubbed onto adjacent property west of the site to satisfy City of Mebane requirements. In order to construct Cameron Lane and provide access to the undeveloped portion of the sub -division, it is necessary to install a stream/wetiand crossing. To facilitate the construction of the road and development of the site, clearing and grading is necessary. Graders, haulers, excavators and other heavy equipment will be used during grading and construction of the site. 4. Jurisdictional Determinations 4a. Pilot has delineated streams and wetlands on the site, including all three phases of the subdivision. Additional surface waters or wetlands are not located on the portion of the site where Phase III will be constructed. Total buffer impacts 6i. Comments: The applicant is seeking buffer authorization for the project from the local DWR delegated municipality. D. Impact Justification and Mitigation 1. Avoidance and Minimization 1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The applicant has designed the proposed residential sub -division to avoid other impacts to streams and wetlands, specifically associated with lot/pad fill and a stormwater device. The applicant has further demonstrated avoidance and minimization of stream impacts by proposing to construct culvert head/end walls. The remaining 643 linear feet of stream and 0.269 acres of wetland are being avoided. The road will provide two points of access and interconnectivity to the subdivision. The road is also a thoroughfare that is being required by the City of Mebane to be stubbed onto adjoining propertyy located west of the site. In order to meet Mebane and site requirements, the applicant has designed the stream crossing in a relatively straight portion of the stream that does not contain adjacent wetlands. If the crossing is moved upgradient of the proposed crossing location, there are two parallel streams that would be impacted resulting in a much larger stream impact. If the crossing were moved down -gradient, the crossing would impact significantly more wetlands. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. The clearing limits will be staked and silt fence will be used. A temporary coffer dam will be installed upgradient of the proposed culvert. During construction, water will be pumped around the construction footprint. Appropriate stream bank protection will be provided in the channel during construction and all excess excavated material will be immediately removed from the stream bank crossing area. The rip rap is being keyed in to further minimize the impacts to the stream. Upon completion of the culvert installation, the temporary sand bag coffer dam will be removed and flow will be diverted through the culvert. Following construction, disturbed banks will be restored to similar pre -construction conditions, matted and seeded/live staked. Upon installation of the sewer line, the emeregent wetland will be restored to grade and seeded. 2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State 2a. We consulted the USFWS Website to determine if federally protected endangered or threatened species inhabit Alamance County, NC. The Cape Fear Shiner is listed as a federally protected endangered species. The stream on the site is small and does not contain fish habitat. Fish will not be directly impacted by the proposed project. A pump around will be used during the culvert installation to avoid sedimentation down stream. Additionally, stormwater will be treated from impervious surfaces prior to being discharged to down -gradient waterbodies that contain fish habitat. Based on our observations, it is our opinion that the proposed project will have no effect on federally listed species. 6. Essential Fish Habitat (Corps Requirement) 6a.
