PROJECT DFUSCRRM0 The project site is located at 1629 Sunrise Lane, adjacent to Myrtle Grove Sound and the Atlantic Intracoastal Waterway (AIWW), in New Hanover County. This site is adjacent to the Rodney Ringler project which is currently in the CAMA Major Permit review process for a similar private pier. The .77 acre lot is 92 feet wide and approximately 371 feet in depth from Myrtle Grove Sound. The property is densely wooded and currently undeveloped, but, it will be the site of the applicant's future residence. Vegetation along the shoreline consists of small oaks, fronted with shrubs, Marsh-elder (Iva frntec ..nc), and Grounsel-bush (Baccharns halimifolia). There is a marsh border, approximately 500 feet wide, waterward of the shoreline of the property. Black Needle Rush (7nncns m .mariannc) dominates the high coastal marsh intermixed with Spike Grass (Distichlis snicata), Sea Oxeye (Bnrrichia frntec .en S), and Salt Meadow Grass (S)artina patens) at the transition to highground. Smooth Cordgrass (Snartina alterniflora) dominates the remaining 400 feet of marsh to an old shell berm which has formed along the perimeter of the cove. This berm's elevation is above mean high water (MHW) and supports shrub vegetation, Marsh-elder (Iva frntesc .nc), Grounsel-bush (Baccharus halimifolia), and Sea Oxeye (Bolrichia fnites ens). South of the project site, the berm is of sufficient height and width to support several large Live Oaks, Red Cedar, and Yaupon. There are breaks in the berm, both north and south of the project which allow tidal flow to the extensive marsh landward of the berm. In the project area, the waters of the are classified as SA, by the NC Division of Water Quality, and they are OPEN to the harvest of shellfish. These waters are designated as Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. This area of Myrtle Grove Sound is approximately 2200 feet wide. The applicant proposes to construct a private pier. The pier would be 5 feet wide and 530 feet long to the outer berm, then angle southeast into the cove for an additional 70 feet. The pier would terminate in a T-shaped platform, 16 feet long and 16 feet wide. The platform would be roofed. A floating dock, 18 feet long and 6 feet wide, would be installed waterward of the platform. Two boat lifts (14 ft. X 12 ft.) would be installed, one on each side of the floating dock. The total length of the structure would be 649 feet. 10. ANTICIPATED IMPACTS The proposed pier would incorporate approximately 796 square feet of estuarine waters and public trust area. There would be some disturbance of the marsh and shallow bottom along the proposed pier alignment during initial construction, and the proposed structure would shade approximately 2650 square feet of coastal wetlands. Staff review of the plans and specifications has determined that the development activities proposed will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H. 1000. By copy of this letter, we are informing you that your project will not require a stormwater management permit. Please keep in mind that this determination does not relieve you of your legal responsibility to obtain other permits which may be required by the Division of Water Quality, the Division of Land Resources, Coastal Areas Management Act, Federal, State, or Local Governments. In addition, any future modifications to the project will require additional review from this Office to assure that stormwater impacts are not an issue.
