PROJECT SUMMARY: The applicants wish to build a combination tackle shop/motel building
on the ocean front. In addition, they would like to extend the existing ocean fishing pier landward
and oceaciward as indicated on the plans.

9. PROJECT DESCRIPTION
The Smiths are the owners of Salty's Fishing Pier. The property is located at North Topsail Beach off
of Highway 1568 (New River Inlet Road) in Onslow County. The property is near Villa Capriani on the
ocean front side of the highway. We believe that the existing fishing pier was built in 1987 by Nelson
(Salty) Miller. Construction of the pier was authorized by the U. S. Army Corps of Engineers. The
approved length appears to have been 1200 feet with a 14' x 80' "T" platform at the oceanward end.
It is not known by this writer whether the project was ever completed as it was permitted. Aerial
photography from 1989 indicates that the existing pier was approximately 700'-750' long and did not have
a "T" platform.
The pier as it exists today exhibits damage from the two hurricanes of 1996. The applicant's consultant
indicates that about 300' of pier is left. The applicants plan to repair the portion that is left and add on
to each end. The landward entrance ramp and the oceanward end of the pier are gone. The pier has
been closed since the Fall of 1996. Currently a pier house is located on the existing pier, over the waters
of the Atlantic Ocean. It is the staff's understanding that the pier house will be removed from the pier
and relocated to the new tackle shop/motel building if the proposed construction is authorized. A two-
story house/studio is the only structure on the 1.67 acre tract besides the pier. It does not appear that the
studio was significantly damaged during the hurricanes. The applicants propose to renovate the studio
into 4 units for rent.
The applicants propose to build a new 32' x 78' Tackle Shop/Motel on the tract along with parking. They
propose to connect the fishing pier to this new building with a walkway. Any new buildings and all
required parking must meet the required 60' CAMA setback from the first line of stable natural
vegetation. There is effectively no separation between the public beach and the private, buildable portion
of the property. The landward end of the pier must be extended approximately 220' towards the road.
The extension is necessary to bring the existing structure into compliance with the rules and provide
access to the existing pier. Current access is on the public trust beach due to the erosion that has occurred
since 1987. The applicants also propose to add 500 more feet of pier onto the oceanward end of what
is existing. Included in this 500' is a 40' x 40' platform at the end. The permit drawing delineates the
existing pier, the proposed pier and platform and the access pier or ramp that crosses the beach. The
proposed pier is 16' wide.
There are no natural dunes remaining on the site. It is relatively flat with a small amount of natural beach
grasses growing. The area was severely overwashed during Hurricane Fran in 1996 and has not
experienced recovery. Much natural beach erosion has occurred during the last 10 years.
The estuarine waters known as Mason's Creek, Alligator Bay and the Intracoastal Waterway have been
classified as SA/ORW. These waters are located across the street, on the soundside of Highway 1568.
The Atlantic Ocean has been classified as SB by the Division of Water Quality. The Division of Marine
Fisheries has designated the estuarine waters of the sound as primary nursery area, open to the taking of
shellfish.

10. ANTICIPATED EMPACTS
The construction of the fishing pier will result in the shading or covering or 16,400 square feet of public
trust beach and ocean waters. Approximately 40,000 square feet of upland area will be disturbed for the
construction of the motel and parking. Extensive lighting on the pier and proposed building may affect
nesting habits of sea turtles which frequent this beach. Near shore navigation will be impaired by the
proposed structure.

Narrative for William A. Smith and Katie C. Smith CAMA Application - Salty's Fishing Pier
The Smith's were deeded the subject property in October of 1995 in the name of Seaview
Corporation as recorded in Deed Book 1267, Page 109 of the Onslow County Registry. This
property is located between the Atlantic Ocean and N.C.S.R. 1568, in the town of North Topsail
Beach, Onslow County. This property includes 2.93 acres with an existing structure maintained as
a studio and an existing pier. Parking for the studio and pier was scattered throughout the
property upon both sand and gravel parking areas. This property has a width of 309 feet and
depth of 505 feet. The property has sparse wild growth with a soil type of Newhan Sands.
This pier has been known as Salty's Fishing Pier and was originally built between 1985 and 1988
by Mr. Salty Miller. At that time the property was under the local zoning jurisdiction of Onslow
County. The Town of North Topsail Beach was founded in 1990 and the town does have this
property zoned commercial, which does allow a fishing pier within this zone.
In the summer of 1996, Hurricane Bertha and Hurricane Fran destroyed portions of the pier,
leaving 300' in length from the approximate mean high water line out towards the Atlantic Ocean.
The Smiths request to repair the existing pier to it's original length. As shown on the attached
plan, there is a proposed 200' ramp, 100' of existing nonfishing area, 200' of existing fishing pier
and a proposed 500' fishing pier including an octagon shaped platform. The existing 300' of pier
will be left in place, however, the deck will be leveled and any structures adjacent to or above the
16' wide deck will be removed. The proposed pier will also be 16' in width. The pier will be
constructed perpendicular to the approximate mean high water line of the Atlantic Ocean.
Construction materials and building techniques are listed within the application.
The Smiths proposed tackle shop, snack bar and motel will be constructed on the property,
landward of the 60' AEC line, as also shown on the plan. This structure will be 32'x 78', two
story on pilings with parking below, having a total square footage of 4,992. The tackle shop and
snack bar have a total of 1,472 square feet of retail space and will be located on the first floor.
Three rooms of the motel will be located on the first floor and the remaining nine will be located
on the second floor. As shown on the plan, the tackle shop, snack bar and motel will access the
pier directly by a uncovered deck.
The existing studio will be converted into a 4 room structure for rent similar to the motel. There
will be existing parking below this structure.

The water supply for the improvements will be handled by the Onslow County Water Department
and the sewer supply will be handled by North Topsail Water and Sewer, Inc.
The Town of North Topsail Beach requires one parking space for every 200' of retail area and
one parking space for every 10' of fishing pier. These requirements have been met as shown on
the plan.
The First Line of Stable Vegetation and the 60' AEC line have been verified and staked by the
Wilmington Office of CAMA. The proposed structure will be allowed to use the 60' AEC line,
because the square footage of the building is less than 5000 square feet.
The total amount of land disturbance is approximately 27,000 square feet, 22,000 square feet in
parking area and less than 5000 square feet in building area. Therefore, a Sedimentation and
Erosion Control Plan is not required.
This property does fall within 575 feet of the area of environmental concern of Outstanding
Resource Water. Therefore, the property's impervious surface can not exceed 25% of the area
above the approximate mean high water line. Including all improvements existing and proposed,
the impervious surface is 24.8%, as shown on the plan.
This property is located in Flood Zone VE with a base flood elevation of 15'. Therefore the
proposed structure's lowest horizontal member must be constructed at an elevation of at least 15'.
The property is not covered by Federal Flood Insurance. The average elevation of the
property is 7'.
The adjoiners have been contacted by certified mail and the green receipts cards are attached.
Construction of the pier will commence immediately upon approval of this application and receipt
of the permit.

• A copy of the deed (with state application onlylor
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross-sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 71.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

Purpose of the pier is to provide recreational fishermen access
to the Atlantic Ocean for fishing-Construction will be to jet
and drive 45' to 55' piling 12' apart in the width of the pier

pile caps,stringers,decking,bracing(cross & longitudinal) and
hand rails.All timber products shall be pressure treated by
chromated copper arsenate (CCA) to .80PCF. All dressed lumber
shall be pressure treated by chromated copper arsenate to .60
PCF.Approximately one 14' bent can be constructed each day.
Purpose of the one land based building is to provide a tackle
shop,snack.bar and motel rooms for service of the fishermen.
COnstruction will be standard hurricane construction to meet
a wind force of 11OMPH and be supported above the 100 year
flood level on piling.Parking will be provided on site.
Storm water will be controlled by runoff onto grassed property
on site.

SEDIMENTATION AND EROSION CONTROL FENCING
During the construction of the fishing pier and one building
less than one acre of land will be disturbed and thus no
sedimentation or erosion control fencing will be erected.
During the construction of the parking area a sedimentation
and erosion control fence will be erected and maintained.
