SUBJECT: WRC Comments on Pinkerton Stabilization on UT Pole Creek, Buncombe County, NC
Dear Ms. Jones:
Mr. Richard Pinkerton requested a permit to stabilize 390 linear feet of UT Pole Creek, Buncombe
County, NC using rip -rap. Comments from the NCWRC on this application are offered for your
consideration under provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d).
While we would prefer natural techniques be used for streambank stabilization, we understand that
previous attempts to stabilize the bank at this location have failed and significant erosion has occurred. In
an effort to reduce direct impacts to downstream fisheries from sediment originating at this location, we
do not object to the permit application. We do not have records of trout at this location and do not request
the trout spawning moratorium. We do not request any special conditions be attached to the permit.
