Brooks Water Quality Administrator October 14, 2019 Andrew Auld, AMBR Spano & Associates 409 Langholm Drive Winter Park, FL 32789 Erosion Control Technician Subject:Water Supply Watershed Permit No. 2019-06-10 Haywood Crossing Subdivision — Highway 191 (next to West Henderson High School) Dear Andrew Auld: The Legislature of the State of North Carolina has, in Chapter 153A, Article 6, Section 121, General Ordinance Authority; and in Chapter 143, Article 21, Watershed Protection Rules, delegated the responsibility or directed local governmental units to adopt regulations designed to promote the public health, safety, and general welfare of its citizenry. Henderson County Site Development Division received a complete Water Supply Watershed Management Permit Application for the subject project on June 28, 2019. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Water Supply Watershed Regulations set forth in Article 21 of Chapter 143 of the North Carolina General Statutes as well as Article VIII - Natural Resources, Subpart B - Water Quality, §42-239 of the Henderson County Land Development Code (LDC). We are forwarding Permit No. 2019-06-10, dated October 14, 2019, for the construction, operation and maintenance of the subject project and the stormwater system. This permit shall be effective from the date of issuance until rescinded and shall be subject to the conditions and limitations as specified therein, and does not supersede any other agency permit that may be required. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with Water Quality Board (WQB). The written petition must conform to §42-379 of Henderson County LDC. Per §42-379 the petition must be filed with the WQB within thirty (30) days of receipt of this permit. You should contact the WQB with all questions regarding the filing fee (if a filing fee is required) and/or the details of the filing process at 100 North King Street, Hendersonville, NC 28792, or via telephone at 828-697-4857, or visit their website at www.hendersoncountync.gov. Unless such demands are made this permit shall be final and binding. This project will be kept on file at the Henderson County Site Development Office.
