After reviewing your application, we have decided that this impact is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: The applicant proposes to add a 22' X 34' floating boathouse to his existing dock. Samuel L. Owenby Page Two 9. PROJECT DESCRIPTION The project site is located at 815 Shoreline Drive West (NC 179), within the Town of Sunset Beach in Brunswick County. The property is located adjacent to and on the north side of the Atlantic Intracoastal Waterway near Bonapartes Landing. The highground property is approximately 152' wide by 401' deep or approximately 1.4 acres. The property slopes gently from 12' above mean sea level at NC 179 to an existing bulkhead along the waterward side of the property. Currently on the property there are two houses with associated garages, a utility building and pier. The existing pier is 4' wide by 147' long and has a 8' by 14' T-head at the waterward end. Between the existing bulkhead and the Intracoastal Waterway there is an approximately 80' wide border of Smooth Saltmarsh Cordgrass marsh (Spartina alterniflora). The Intracoastal Waterway is approximately 500 feet wide at the project site. The applicant is proposing to add a 34' long by 22' wide floating boathouse at the waterward end of the existing pier and T-head. The new structure will be 6' waterward of the T-head. The structure will be held in place by ten (10) 6" X 6" pilings, around which galvanized steel sleeves will allow the structure to float up and down with the tide. The lower level of the structure will consist of 468 sq. ft. of "U" shaped floating dock with a 5000 lb. boat lift and two (2) personal watercraft lifts. The upper level, which will be attached to and supported 9' above the floating dock by 6" X 6" posts, will be constructed with 2" X 8" beams on 16" centers, covered with 1/2" plywood and 5/4" decking boards. The structure will be accessed by ramps from the existing T- head going to both the upper and lower levels. The water depth at the end of the proposed structure will be approximately -4' at mean low water. Total project length will be approximately 195' or approximately 111' waterward of the edge of marsh, extending into a body of water that is approximately 500' across. The waterward end of the structure will be located approximately 90' from the near bottom edge of the AIWW channel. 10. ANTICIPATED IMPACTS The project as proposed will result in the incorporation of an additional 748 sq. ft. of Public Trust Area. The project will not extend more than 1/3 the width of the water body, will terminate approximately 90' from the near bottom edge of the federally maintained channel and can be constructed within the applicants riparian corridor.
