After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as descr'bed in 15A NCAC 2H.0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. The trash dumpster on site was overflowing with additional trash placed adjacent to the dumpster. The County should look into have the container emptied more frequently and place trash barrels around and on the docks so that the trash will be less likely strewn into the marsh and water. FIELD INVESTIGATION REPORT: Carteret County Harbor Authority/Atlantic Harbor of Refuge PAGE #2 9. NARRATIVE DESCRIPTION: The project site is an existing harbor of refuge owned and operated by Carteret County. The site lies within the community of Atlantic, at the eastern terminus of Highway 70. There is an existing docking facility ensconced within a 720' x 240' basin that was excavated from Little Port Creek, and connects to Core Sound by access channel. Coastal marsh, primarily comprised of S artina alterniflora and Juncus roemerianus, lines the north and west sides of the basin, and appears to have been ditched for mosquito control purposes. Residences and private piers occupy the eastern shore of the basin. The existing facility was constructed in the early 1980's, under the authorization of State Permit #83-86. Currently, there is a dock extending parallel to the marsh along the western edge of the basin, with mooring pilings to provide for 23 slips. There is a relic dock along the north end of the basin that has fallen into disrepair, and is not functional. Additionally, three docks on the south side of the basin are also in unusable condition. Currently, there is random and decidedly unsafe dockage of vessels in this area. Core Sound carries a water quality classification of SC by the Division of Water Quality; the area has been closed to the taking of shellfish for consumption since the 1950's due to bacterial contamination; this portion of Core Sound has not been designated Primary Nursery by the Division of Marine Fisheries. Core Sound waterward of the project site, and to both sides, is classified Outstanding Resource Waters, although the immediate vicinity is not. The body of water within the basin is approximately 240' across. The substrate is silty, with a peat shelf at the marsh edge, and no evidence of a shellfish resource. A significant sandbar extends westward across the mouth of the basin, extending the access channel to the west. Soundings in the basin indicate a water depth of -3' at mean low water at the waterward edge of the docking facility. Carteret County's deed for the tract covers 2.3 acres, to include the marsh on the west side, and approximating the waterward edge of the marsh on the north and east. There are two accessways connected to the dock on the west that have not been authorized under state permit, nor have they been authorized by the county. To reduce liability, the county is proposing to remove the 20' of structures joining the harbor dock as a part of this permit. Carteret County leases 23 slips in the facility currently, and proposes to lease 25 more. However, the primary intent of the harbor is to provide a safe haven from storm events. Leases are written such that, in the event of a storm, all facilities are available on a first come, first serve basis. Vessels currently utilizing the county facility are predominantly commercial fishing boats. The applicant is proposing to perform maintenance to the existing dock extending along the western shoreline of the basin. The dilapidated pier structures on the southwest side of the basin are to be removed, and a 120' x 7' section of dock constructed. A 30' x 7' access ramp will connect this structure to high ground on the east, and it will tie into the existing dock to the west. Seven mooring pilings 20' from the dock will provide 5 slips, 16'x 20', and a 20' x 30' offloading area. Four mooring pilings are proposed 20' from the existing dock on the south end, providing for 4 additional slips. On the northwest side of the existing dock, 2 mooring pilings are to be relocated, and 12 mooring pilings are to be placed forming 6 slips, 20' x 40' in size. Two I additional pilings will form 16' x 20' slips at the north end of the existing dock. The dilapidated structure along the north end of the basin is to be removed. A 51' ramp from the existing dock, curving aroupd the marsh edge, will connect to a new dock, 160' x 7'. Three pilings set 20' from this structure will form 20' x ±20' slips. Fourteen pilings will be placed waterward of the newly constructed dock on the north end of the facility to form 6 slips, 20' x 40' in size. The end result of this proposal is to provide for a total of 48 slips ranging from 16' to 20' in width, and from 20' to 40' in length. While the applicant has proposed 6' wide docks, the profile view of the proposal shows the docks to be decked to a width of 7', while the 6' measure is from the centers of the pilings. This is consistent with the existing structure. 10. ANTICIPATED IMPACTS: The area of public trust waters incorporated by this proposal will be approximately .41 acres. Some shading will occur of the shallow bottom area beneath the structure. Increases in turbidity can be expected during construction. There should be no additional boating impacts from the proposal as this area is currently utilized for docking in a haphazard manner. The safety of the facility should be improved. April 29, 1998 T. PROJECT SUMMARY: The applicant proposes to perform maintenance to the existing docking facility within the Atlantic Harbor of Refuge, replacing the dilapidated sections, and providing for an additional 25 slips. FIELD INVESTIGATION REPORT: Carteret County Harbor Authority/Atlantic Harbor of Refuge PAGE #2 9. NARRATIVE DESCRIPTION: The project site is an existing harbor of refuge owned and operated by Carteret County. The site lies within the community of Atlantic, at the eastern terminus of Highway 70. There is an existing docking facility ensconced within a 720' x 240' basin that was excavated from Little Port Creek, and connects to Core Sound by access channel. Coastal marsh, primarily comprised of S ap rtina alterniflora and Juncus roemerianus, lines the north and west sides of the basin, and appears to have been ditched for mosquito control purposes. Residences and private piers occupy the eastern shore of the basin. - The existing facility was constructed in the early 1980's, under the authorization of State Permit #83-86. Currently, there is a dock extending parallel to the marsh along the western edge of the basin, with mooring pilings to provide for 23 slips. There is a relic dock along the north end of the basin that has fallen into disrepair, and is not functional. Additionally, three docks on the south side of the basin are also in unusable condition. Currently, there is random and decidedly unsafe dockage of vessels in this area. Core Sound carries a water quality classification of SC by the Division of Water Quality; the area has been closed to the taking of shellfish for consumption since the 1950's due to bacterial contamination; this portion of Core Sound has not been designated Primary Nursery by the Division of Marine Fisheries. Core Sound waterward of the project site, and to both sides, is classified Outstanding Resource Waters, although the immediate vicinity is not. The body of water within the basin is approximately 240' across. The substrate is silty, with a peat shelf at the marsh edge, and no evidence of a shellfish resource. A significant sandbar extends westward across the mouth of the basin, extending the access channel to the west. Soundings in the basin indicate a water depth of -3' at mean low water at the waterward edge of the docking facility. Carteret County's deed for the tract covers 2.3 acres, to include the marsh on the west side, and approximating the waterward edge of the marsh on the north and east. There are two accessways connected to the dock on the west that have not been authorized under state permit, nor have they been authorized by the county. To reduce liability, the county is proposing to remove the 20' of structures joining the harbor dock as a part of this permit. Carteret County leases 23 slips in the facility currently, and proposes to lease 25 more. However, the primary intent of the harbor is to provide a safe haven from storm events. Leases are written such that, in the event of a storm, all facilities are available on a first come, first serve basis. Vessels currently utilizing the county facility are predominantly commercial fishing boats. The applicant is proposing to perform maintenance to the existing dock extending along the western shoreline of the basin. The dilapidated pier structures on the southwest side of the basin are to be removed, and a 120' x 7' section of dock constructed. A 30' x 7' access ramp will connect this structure to high ground on the east, and it will tie into the existing dock to the west. Seven mooring pilings 20' from the dock will provide 5 slips, 16'x 20', and a 20' x 30' offloading area. Four mooring pilings are proposed 20' from the existing dock on the south end, providing for 4 additional slips. On the northwest side of the existing dock, 2 mooring pilings are to be relocated, and 12 mooring pilings are to be placed forming 6 slips, 20' x 40' in size. Two additional pilings will form 16' x 20' slips at the north end of the existing dock. The dilapidated structure along the north end of the basin is to be removed. A 51' ramp from the existing dock, curving around the marsh edge, will connect to a new dock, 160' x 7'. Three pilings set 20' from this structure will form 20' x ±20' slips. Fourteen pilings will be placed waterward of the newly constructed dock on the north end of the facility to form 6 slips, 20' x 40' in size. The end result of this proposal is to provide for a total of 48 slips ranging from 16' to 20' in width, and from 20' to 40' in length. While the applicant has proposed 6' wide docks, the profile view of the proposal shows the docks to be decked to a width of 7', while the 6' measure is from the centers of the pilings. This is consistent with the existing structure. 10. ANTICIPATED IMPACTS: The area of public trust waters incorporated by this proposal will be approximately .41 acres. Some shading will occur of the shallow bottom area beneath the stricture. Increases in turbidity can be expected during construction. There should be no additional boating impacts from the proposal as this area is currently utilized for docking in a haphazard manner. The safety of the facility should be improved. April 29, 1998 T. These docks will replace old dilapidated docks that are currently in disrepair. As part of the project the old docks will be removed along with several sunken boats. We believe this project will help to clean up the harbor and provide a much safer manor for boats to dock. This project will not require any dredging or filling and the new docks will be located outside of the marsh line. The current harbor contains 23 slips that were constructed tinder CAMA permit 83-86. Part of the construction approved under this permit was not constructed and is included in this new request. The proposed new construction will create 25 additional slips and include 40 new mooring pilings.. The majority of these boats for these new slips will be relocated from the old dockage that is being removed along old highway 70.
