Hickory, NC 28601 Dear Mr. Huysman: You have our approval, in accordance with the attached conditions and those listed below, for the purpose of construction of a golf course, as you described in your application dated August 6, 1998. After reviewing your application, we have decided that this impact is covered by General Water Quality Certification Numbers 3103 and 3108. These Certifications allow you to use Nationwide Permit Numbers 14 and 26 when they are issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. The proposed activity is identified in a prior application presented to your offices in mid May of this year. The site plan presented to your offices has changed and some previously described channel impacts have changed. In general, the revised site plan utilizes the same road crossing locations and wetland fills; one new segment of impacts to not-important channel is proposed. During site visits with your offices we identified channels that would not require mitigation for proposed impacts. In sum, replace prior impact tables, Joint Forms and site maps with those that are enclosed in this package and resume the time clock, as appropriate. Previous impacts under NW26 to 500 linear of important channel and 0.70 acres of wetland and Waters have been reduced to 400 linear feet of impact to important channel and 0.32 acres of impact to wetland. Notably, the wetland impact of 0.05 acre on Hole 11 is not accounted for due to isolation and impacts associated with mitigation at Hole 16 are not accounted for because they will be completed under an approved Channel Mitigation Plan; in accordance with discussions with the COE. An additional 200 linear feet (0.01) acre of impacts to minimally important channels have been included in G9, Hole 18. Additionally, impacts for 4 road crossings are now accounted for under this Nationwide. Changes from previous permit application have been made because the COE and DWQ have classified relevant drainage features different than S&EC, The classifications, which are shown on the attached maps, show the breaking point from important to not important. Also, the accounting for impacts has changed because channel relocation done as mitigation is not tallied as loss. Please call with questions. These tables accurately present proposed impacts at this time; disregard prior tables. Both the COE and DWQ have visited the site and have assessed channel importance. DWQ based their assessment on the presence of fish and crayfish and the COE independently determined if impacts are more than minimal. Channel mitigation is proposed on-site within a channelized stream that crosses an abandoned agricultural field. We anticipate that approval of the 404 and 401 will be conditional approval of a Stream Mitigation Plan. Nationwide Permit 14 - Impacts to: Important Channels 140 linear feet Not Important Channels 0 linear feet Waters of the US 0.032 acres Wetlands 0.0 acres One road crossing proposed under this permit; it is denoted on the attached maps as R-1. The total impact is to 0.032 acres of Waters of the US; of which 140 linear feet of important channels are lost. Nationwide Permit 26 - Impacts to: Important Channels 400 linear feet Not Important Channels 700 linear feet Waters of the US 0.086 acres Wetlands 0.38 acres Four road crossings are proposed under this permit; they are denoted on the attached maps as R-2, R-3, R-4, and R-5. Crossing impacts are to 0.036 acres; of which 320 linear feet is to important channel beds. Golf impacts are to 0.38 acres of wetland mitigation and to 700 linear feet of not- important channel. A total of 80 linear feet of important channel will be culverted for a play area. Golf impacts are identified by G#'s. Hole 3 has been re-designed but has same extent of impacts. Permanent impacts to significant streambeds under Nationwide Permit 26 are estimated to be 285 linear feet. This request for authorization is for 500 linear feet; the balance (215 linear feet) of impacts is from degraded channelized streams that we propose to relocate. Additionally, channel mitigation for impacts will occur on-site within the floodplain of Clarke Creek where a tributary has been channelized for approximately 1000 linear feet. The proposed mitigation area is shown on the attached Site Vicinity Map. Total permanent impacts to significant streambeds under five Nationwide 14 Permits are to 460 linear feet of channel which total 0.054 acres. Impacts associated with the road crossings and outfall protection are minimized by the use of concrete headwalls and small rip-rap pads. Mitigation for impacts associated with road crossings totals 240 linear feet; these channels will be mitigated within the area identified above. ' BRYAN PROPERTIES, CHARLOTTE GOLF C,a pC? . 4?c? a ? 3 CHANNEL SIGNIFICANCE AND PROPOSED UWPACTS DISCUSSION The following discussion pertains to the channel features (sections) shown on the ' attached map and relevant photographs. The attached table addresses relevant characteristics. ' Most all channel features are subject to disturbance from cattle and heavy sediment loading. Channel area 1 Significance: Is assessed to be a storm water feature and has no significance until a point approximately 200 ft. down stream from the confluence with another channel. At this point, combined flows from the two areas create an intermittent channel. A large portion of this channel is in the open and is cattle trodden. Photo 27 illustrates the latter. ' Proposed Impacts: Include those associated with Hole #8 (see photo 27), and a road crossing, (RC2) just below the confluence of channel one with the next channel. No significant stream bed is proposed to be impacted in the upper reaches of this channel. Impacts associated with the road crossing are eligible for NW 14. ' Channel area 2 ' Significance: Is a deeply incised storm water feature with persistent pools, but has no significance. It appears to have been a drainage ditch from an old, yet, existing animal waste lagoon above; this channel receives effluent from the lagoon. Proposed Impacts: No impacts are proposed. ' Channel area 3 Significance: Appears to be a drainage feature that was more active before the ' construction of the anaerobic animal waste lagoon located above it. It has significance beginning particularly below the wooded area (at the confluence with channel 2). Drainage to the significant, important, areas is estimated over 100 acres. Photo 26 shows ' some cattle disturbance and is on non-important areas. Proposed Impacts: No impacts are proposed. t Channel area 4 J Significance: Is a deeply incised drainage feature (ditch through high ground). It is frequently flooded with lot runoff from the current farming operation and has no significance. Un-natural black water is evident in Photo F15. Proposed Impacts: No impacts are proposed. Drainage areas 5 and 6 (not assessed to be jurisdictional) Significance: These channels are drainage features for upland areas. There poorly defined bed and bank structure tend to indicate storm flows created them. Significant sedimentation, from erodeable surfaces likely indicates formation by storm events. They are very similar and appear to be non-significant intermittent features. The channels loose their distinction and jurisdictional character in the flood plain area of the large unnamed tributary to Clark Creek due to high traffic and disturbance from cattle and assumed lack of constant or intermittent flow. Photos 20 and 23 illustrate the latter, these areas are not assessed to be jurisdictional because soils are lacking and hydrology indicators are weak. Proposed Impacts: Include those associated with Hole #5 for Channel 5 (see photos 21- 24 and F14), and include those associated with Hole #6 for Channel 6 (see photos 16-20). No impacts are assessed to be significant. Drainage area 7 (not assessed to be jurisdictional) Significance: Has no significance, and is considered a storm water feature. Like channel 5 and 6, this area has a drainage basin approximately less than 50 acres. Photo 1711 illustrates cattle disturbance and weak bed and bank structure. Proposed Impacts: Include those associated with Hole #1 (see photos Fl t-F13, 14, 15) No impacts are assessed to be significant. Channel area 8 Significance: Is the large perennial tributary to Clark Creek. It is located within the largest wetland pocket and is considered significant. Proposed Impacts: Include those associated with Hole #3 (see photos 10-13) Channel area 9 Significance: Significant. Proposed Impacts: Include those associated with Hole #18. Impacts to this channel in excess of 150 linear feet will likely require mitigation under DWQ guidelines. I 1 I t I Channel area 10 Significance: Appears to be non-significant and does not maintain characteristics to main channel. Proposed Impacts: Include those associated with the Driving Range. This feature will most likely be filled, but will not impose significant impacts. Channel area 11 Significance: Is significant and is likely subject to DWQ mitigation. Proposed Impacts: Include those associated with Hole #12 (see photos F3- F4) and two 80 linear foot road crossings, 0.018 acres, significant impact. Channel area 12 Significance: Drains from the existing pond and is subject to disturbance from cattle. Appears to be non-significant but intermediate. Proposed Impacts: Include those associated with Hole #11 (see photos F5-F6), and an 80 linear foot road crossing, 0.009 acres, significant impact. Large Tributary to Clark Creek Significance: Perennial channel and has significance. Impacts: Road Crossing East of Proposed Hole # 7.
