Preston Howard, Jr., P.E., Director ENVIRONMENT AND NATURAL RESOURCES September 29, 1998 Lincoln County DWQ Project # 980414 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS, WRP Mr. Larry Griffith Waterside Landing Properties, LLC 1545 West Trade Street Charlotte, NC 28216 Dear Mr. Griffith: You have our approval, in accordance with the attached conditions and those listed below, to retain fill placed in 0.6 acres of wetlands and/or 600 linear feet of waters. This will be for the purpose of a commercial fill at Waterside Landing at NC 16 and NC 73 in Lincoln County, as you described in your application dated May 7, 1998. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. Stormwater management shall done in accordance with plans submitted by B.K. Barringer and Associates, P.A. on September 22, 1998. However, because of the circumstances regarding these plans the Division will require that you post a bond for the construction of the stormwater wet detention pond indicated in the plans. The Division is willing to waive this requirement if the pond is fully constructed according to the above plans by March 23, 1998. We understand that you have chosen to contribute to the Wetland Restoration Program in order to compensate for these impacts to wetlands and/or streams. In accordance with 15A NCAC 2R.0500, this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2H .0506(h). According to 15A NCAC 2H .0506(h), feet of restoration will be required. Until the Wetland Restoration Program receives and clears your check (made payable to: DEHNR - Wetland Restoration Program), wetland or stream fill shall not occur. Mr. Ron Ferrell should be contacted at 919-733-5083 ext. 358 if you have any questions concerning the Wetland Restoration Program. You have one month from the date of this Certification to make this payment. For accounting purposes, this Certification authorizes the fill of 600 feet of streams, in 030833 river and subbasin and 600 feet of stream restoration are required. Please be aware that the Wetland Restoration Program (WRP) rules require rounding of acreage amounts to one-quarter acre increments (15A 2R.0503(b)). As you recall, the plans are required for an "after the fact" 401 Certification for stream culverting. The developer has proposed that they treat the stormwater from a future development somewhat adjacent to the subject site which flows to the same "named" stream. Per your previous email you decided that the developer's proposal would be acceptable if "he" could prove "he" owned the proposed stormwater pond site, provided a construction schedule with which the Division concurred, and provided a means to assure construction such as a bond. According to engineer, the developer is willing to post a bond, will construct the pond within 6 months of DWQ approval, and has provided information regarding ownership. However, I am not sure, according to the deed, who owns the subject property. In any event, the developer is willing to post a bond, and the stormwater management plan is acceptable. Based on this review, we have identified significant uses, which would be removed or degraded by this project. These uses are pollutant removal and aquatic life uses. Furthermore, insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H .0506. Therefore, unless modifications of the proposal are made as described below, we will have to move toward denial of your 401 Certification as required by 15A NCAC 2H .0507(e) and will place this project on hold as incomplete until we receive this additional information. Until we receive additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your project on administrative hold. We understand from conversations with the Corps of Engineers that due to the date of construction, this project is eligible for Nationwide Permit 26. Since fill has exceeded one-third acre, a Certification from DWQ is still required. Please provide us with information supporting your position that states your project must be constructed as planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Specifically can you construct your development with less than one-third acre of fill? Any documentation such as maps and narrative that you can supply to address alternative designs for your project may be helpful in our review of your 401 Certification. Also this project will require compensatory mitigation as described in 15A NCAC 2H .0506(h). Your mitigation proposal is insufficient because none was proposed. Also a wet detention pond will be required to protect downstream uses. Barringer. This meeting was the result of various violations of State and Federal wetland regulations. As a result of this inspection, it was determined that approximately 600' of stream has been placed in culvert without proper authorization and that an undetermined quantity of wetlands (<1 acre) had also been filled without the proper Federal and State authorization. These actions are violations of the Federal Clean Water Act. As was discussed during the site visit, in addition to the 2:1 stream mitigation required of you by the U.S. Army Corps of Engineers (USACOE), you will also be required by Section 401 of the Federal Clean Water Act to comply with additional conditions required by NCDWQ. These requirements will include (but may not be limited to) the installation and maintenance of a stormwater pond. This requirement was the main focus of the meeting and many, many potential options for placement and design of this stormwater pond were examined. NCDWQ understands that this project will now require an Individual Permit (IP) by USACOE. As was discussed, you will also be required to apply to The North Carolina Division of Water Quality for a 401 Water Quality Certification. If you can reduce your stream impacts to less than or equal to 150' then stream mitigation will not be required by NCDWQ. Please respond to this matter within 14 days upon receipt. Your response should include why these violations occurred and what measures you plan to implement to rectify them. Lake Norman, with over 525 miles of shoreline, is bounded by four counties, and has become a magnet for growth in the northern Charlotte Region. Waterside Crossing is located at the intersection of NC 73 and NC 16 in East Lincoln County, NC across from a smaller commercial development anchored by FoodLion and Eckerd Drugs. NC 73 is the southern most of two east-west routes that connect the four counties surrounding Lake Norman. NC 16 is the only significant north-south route on the western side of Lake Norman in East Lincoln County. This intersection is anticipated to play a role equivalent to those at Exits 25 and 28 of .I-77 in Cornelius and Huntersville, Mecklenburg County. The planned relocation of NC 16 as a limited access divided highway to the west of its present location will enhance the importance of Waterside Crossing as a major service center for Lake Norman and East Lincoln County. Waterside Crossing is comprised of 150-acres zoned Planned Mixed Use. It is divided into two major components: The 92 acre single-family residential section that is owned by Waterside Landing Residential, LLC, and is in the Catawba River Watershed. The 58 acre commercial/multi-family section that is owned by Waterside Landing Properties, LLC is in the subject watershed. Special attention from a zoning and subdivision point of view has been given this project due its size, its impact on commercial development and its status as the first project to be developed under the Planned Mixed Use Zoning in Lincoln County. The hallmark of this zoning is the attention to buffers surrounding the project and the dedication of significant amounts of improved common open space. Of the 150 acres, almost 30 acres has been set aside as common open space of which over 16 acres are landscaped perimeter buffers. Waterside Crossing helps fulfill the land use plan for East Lincoln County in a tasteful, well planned effort which is attested to in the accompanying letter and maps of East Lincoln County from the Lincoln County Planning Department. The location, size and comprehensive approach to planning of Waterside Crossing will establish it as an anchor for growth in East Lincoln County. The NC 16/NC 73 location has been identified by the land use plan and the projected land use plan as a regional commercial location. The project commenced in June of 1996. Due to its importance to the commercial development in East Lincoln County, special efforts were taken in the planning phase to incorporate the input of the Lincoln County Planning Department. The project was rezoned to a Planned Mixed Use zoning with preliminary site sketch plan approval on January 20, 1997. Engineering construction drawings were commenced immediately with plans submitted for NC Division of Land Quality approval on August 4, 1997. Construction commenced immediately. At build-out, the project has an estimated $90,500,000.00 market value, contributing over $787,500.00 in property taxes and utility district assessments annually. The following breaks out the cost of the individual components. The single-family residential section of the project is in the WS IV Protected classification of the Catawba River Watershed. 184 homesites on 92 acres are being developed under the low-density option of two units per acre. It has an estimated developed market value of $47,200,000.00 with annual property taxes of approximately $408,500.00. The raw land cost attributed to the site is $9,000 per acre with infrastructure development costs of $26,000 per acre. The commercial/multi-family section of the project does not lie in a classified Water Supply Watershed. This portion of the project is divided into three uses; the retail and retail outparcel use (22 acres) (the subject of this application), the professional office use (18 acres) and the townhouse use (18 acres). The retail/retail outparcel portion of the project is the subject of the Individual Permit Application. NC 73, NC 16 and the Boulevard bound the site on three sides. Due to the demand for the center to provide access from three thoroughfares, the placement of the primary tenant along the eastern property line is imperative to the success of the project. Commitments have been made for the sale of the retail center and several of the outparcels. The fully developed retail center/outparcel area has an estimated market value exceeding $15,000,000.00 with annual property taxes of approximately $131,000.00. The raw land cost attributed to the site is $30,000 per acre with infrastructure development costs of $20,000 per acre. The professional/office and townhouse uses are separated from the retail/retail outparcel uses by a four lane divided boulevard connecting South Pilot Knob Rd. to NC 16. Discussions are underway with Lincoln Medical Center in Lincolnton, NC to enhance their commitment to establishing a medical services center for East Lincoln County at this location. Additional medical related office and professional tenants are expected to be attracted by their investment in the project. The fully developed professional/office area has an estimated market value of $13,000,000.00 with annual property taxes of approximately $114,000.00. The raw land cost attributed to the site is $22,000 per acre with infrastructure development costs of $24,000 per acre. The townhouse community will be developed as a medium density project. Approximately 7-8 units per acre are planned. Significant buffer and landscaped areas are planned to provide continuity among the variety of uses in the project. Due to land and development costs it is necessary for the site to yield six retail outparcels in addition to the retail shop space. The retail section has three frontage roads that constrain site planning: NC 73 to the north, NC 16 to the west and the Boulevard that connects the professional office, townhouse and single family residential sections of the project. All major anchor tenants require visibility to all thoroughfares that serve prospective customers. Local shop space requires somewhat less visibility than the anchor space, but needs to be connected to and along customer pathways to the anchor tenant. In each of the alternatives, the pond and the ditch come to play in the development of the site. A careful examination of the locations shown on Alternatives A-D reveals that the only way for the major retail tenant to address all three thoroughfares as well as providing 6 retail outparcels is to situate the rear of the retail center toward the eastern property line. This configuration also allows delivery and service vehicles to approach the retail space from the blind side of the site. It is apparent that this site is unique. DEM - Water Quality Enclosure: General Permit SEA/ae J Project Summary and Mitigation Considerations Waterside Crossing will play a major role in the commercial and retail market in east Lincoln County. The project developers have made every effort possible to produce a quality development and conform to all "current regulations" and zoning requirements. The preliminary planning for this development began in 1996 and was rezoned with preliminary site plan approval issued by Lincoln County January 20, 1997. Project layout was developed based on "current regulations" at that time. Engineering design followed in the spring and summer of 1997 with submittal to NCDENR, Land Quality Section on October 13, 1997, with approval being issued on October 28, 1997. Approvals did not mention additional permit requirements during this review and approval process and construction began based on approved plans. The engineer of record for the project became aware of regulation changes regarding stream disturbances while attending the North Carolina Erosion and Sedimentation Control Design Workshop. Once aware of the new regulations, the engineer alerted the US Army Corps of Engineers, Asheville Regulatory Field Office and initiated pre- application consultations with the Corps and NCDENR, Division of Water Quality. A stormwater quality BMP will be incorporated into the project buffers adjacent to NC Hwy. 16 and NC Hwy. 73 to meet NCDWQ requirements. Streams on the proposed adjacent residential property were investigated by the engineer and Mr. Leonard S. Rindner, PWS to determine their qualifications for stream mitigation. In the opinion of Mr. Rindner, these streams are in excellent condition and do not qualify for mitigation or restoration. In lieu of restoration, the developer proposes a stream protection buffer along approximately 2100 linear feet of stream located at the rear of proposed building lots and common open space. The NCWRC has reviewed information provided by the applicant, and field biologists on our staff are familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The purpose of the competed filling of 0.6 acres of open water pond and 600 LF of stream channel was to accommodate the construction of a 20 acre commercial/retail site. Barringer. This meeting was the result of various violations of State and Federal wetland regulations. As a result of this inspection, it was determined that approximately 600' of stream has been placed in culvert without proper authorization and that an undetermined quantity of wetlands (<l acre) had also been filled without the proper Federal and State authorization. These actions are violations of the Federal Clean Water Act. As was discussed during the site visit, in addition to the 2:1 stream mitigation required of you by the U.S. Army Corps of Engineers (USACOE), you will also be required by Section 401 of the Federal Clean Water Act to comply with additional conditions required by NCDWQ. These requirements will include (but may not be limited to) the installation and maintenance of a stormwater pond. This requirement was the main focus of the meeting and many, many potential options for placement and design of this -.1ormwater pond were examined. NCDWQ understands that this project will now require an Individual Permit (IP) by USACOE. As was discussed, you will also be required to apply to The North Carolina Division of Water Quality for a 401 Water Quality Certification. If you can reduce your stream impacts to less than or equal to 150' then stream mitigation and stormwater management will not be required by NCDWQ. Please respond to this matter within 14 days upon receipt. Your response should include why these violations occurred and what measures you plan to implement to rectify them. Legal action has been suspended pending the outcome of this consideration. The following description of the work is taken from data provided by the applicant and from observations made during a site visit by a representative of the Corps of Engineers. Plans submitted with the application show that the applicant has installed reinforced concrete pipe (RCP) in an approximately 600 linear foot section of an intermittent, unnamed tributary to Forney Creek. In addition, approximately 0.6 acre of associated open water ponds, perimeter wetlands, and interspersed intermittent channel have been replaced by RCP. Once piping was in place, approximately 10,000 cubic yards of sandy clay was utilized to back fill and level the area over the pipe. Installed pipe sizes vary from between 42 and 60 inches in diameter. The channel dimensions of the live stream (wet area) during normal flows is estimated to be 3 to 4 feet in width and 6 to 12 inches in depth. In compliance with State and local regulations, the applicant proposes to construct an appropriately sized stormwater basin with a 0.47 acre littoral shelf to accommodate the planting of wetland vegetation. The planned littoral shelf in combination with preservation of a 600 linear foot stream segment near the project area has been proposed by the applicant to offset described impacts on waters and wetlands. The purpose of the project is to accommodate the construction of a 20 acre commercial/retail development. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to decide the need for the applicant to obtain any required State authorization. No Department of the Army (DA) permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Water Quality (NCDWQ) has decided the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this site is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register is the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision, whether to issue a permit, will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts that the proposed activity may have on the public interest requires a careful weighing of all those factors that become relevant in each particular case. The benefits that may be expected to accrue from the proposal must be balanced against its foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore decided by the outcome of the general balancing process. That decision should reflect the national concern for both protection and use of important resources. All factors that may be relevant to the proposal must be considered including the cumulative effects of it. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (according to Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer decides that it would be contrary to the public interest. 2 The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to decide whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to decide the need for a public hearing and to decide the public interest of the proposed activity. Generally, the decision whether to issue this Department of the Army (DA) permit will not be made until the North Carolina Division of Water Quality (NCDWQ) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDWQ considers whether the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. Lake Norman, with over 525 miles of shoreline, is bounded by four counties, and has become a magnet for growth in the northern Charlotte Region. Waterside Crossing is located at the intersection of NC 73 and NC 16 in East Lincoln County, NC across from a smaller commercial development anchored by FoodLion and Eckerd Drugs. NC 73 is the southern most of two east-west routes that connect the four counties surrounding Lake Norman. NC 16 is the only significant north-south route on the western side of Lake Norman in East Lincoln County. This intersection is anticipated to play a role equivalent to those at Exits 25 and 28 of I-77 in Cornelius and Huntersville, Mecklenburg County. The planned relocation of NC 16 as a limited access divided highway to the west of its present location will enhance the importance of Waterside Crossing as a major service center for Lake Norman and East Lincoln County. Waterside Crossing is comprised of 150-acres zoned Planned Mixed Use. It is divided into two major components: The 92 acre single-family residential section that is owned by Waterside Landing Residential, LLC, and is in the Catawba River Watershed. The 58 acre commercial/multi-family section that is owned by Waterside Landing Properties, LLC is in the subject watershed. Special attention from a zoning and subdivision point of view has been given this project due its size, its impact on commercial development and its status as the first project to be developed under the Planned Mixed Use Zoning in Lincoln County. The hallmark of this zoning is the attention to buffers surrounding the project and the dedication of significant amounts of improved common open space. Of the 150 acres, almost 30 acres has been set aside as common open space of which over 16 acres are landscaped perimeter buffers. Waterside Crossing helps fulfill the land use plan for East Lincoln County in a tasteful, well planned effort which is attested to in the accompanying letter and maps of East Lincoln County from the Lincoln County Planning Department. The location, size and comprehensive approach to planning of Waterside Crossing will establish it as an anchor for growth in East Lincoln County. The NC 16/NC 73 location has been identified by the land use plan and the projected land use plan as a regional commercial location. The project commenced in June of 1996. Due to its importance to the commercial development in East Lincoln County, special efforts were taken in the planning phase to incorporate the input of the Lincoln County Planning Department. The project was rezoned to a Planned Mixed Use zoning with preliminary site sketch plan approval on January 20, 1997. Engineering construction drawings were commenced immediately with plans submitted for NC Division of Land Quality approval on August 4, 1997. The following breaks out the cost of the individual components. The single-family residential section of the project is in the WS IV Protected classification of the Catawba River Watershed. 184 homesites on 92 acres are being developed under the low-density option of two units per acre. It has an estimated developed market value of $47,200,000.00 with annual property taxes of approximately $408,500.00. The raw land cost attributed to the site is $9,000 per acre with infrastructure development costs of $26,000 per acre. The commercial/multi-family section of the project does not lie in a classified Water Supply Watershed. This portion of the project is divided into three uses; the retail and retail outparcel use (22 acres) (the subject of this application), the professional office use (18 acres) and the townhouse use (18 acres). The retail/retail outparcel portion of the project is the subject of the Individual Permit Application. NC 73, NC 16 and the Boulevard bound the site on three sides. Due to the demand for the center to provide access from three thoroughfares, the placement of the primary tenant along the eastern property line is imperative to the success of the project. Commitments have been made for the sale of the retail center and several of the outparcels. The fully developed retail center/outparcel area has an estimated market value exceeding $15,000,000.00 with annual property taxes of approximately $131,000.00. The raw land cost attributed to the site is $30,000 per acre with infrastructure development costs of $20,000 per acre. The professional/office and townhouse uses are separated from the retail/retail outparcel uses by a four lane divided boulevard connecting South Pilot Knob Rd. to NC 16. Discussions are underway with Lincoln Medical Center in Lincolnton, NC to enhance their commitment to establishing a medical services center for East Lincoln County at this location. Additional medical related office and professional tenants are expected to be attracted by their investment in the project. The fully developed professional/office area has an estimated market value of $13,000,000.00 with annual property taxes of approximately $114,000.00. The raw land cost attributed to the site is $22,000 per acre with infrastructure development costs of $24,000 per acre. The townhouse community will be developed as a medium density project. Approximately 7-8 units per acre are planned. Significant buffer and landscaped areas are planned to provide continuity among the variety of uses in the project. It has an estimated developed market value of $15,300,000.00 with annual property taxes of approximately $134,000.00. Due to land and development costs it is necessary for the site to yield six retail outparcels in addition to the retail shop space. The retail section has three frontage roads that constrain site planning: NC 73 to the north, NC 16 to the west and the Boulevard that connects the professional office, townhouse and single family residential sections of the project. All major anchor tenants require visibility to all thoroughfares that serve prospective customers. Local shop space requires somewhat less visibility than the anchor space, but needs to be connected to and along customer pathways to the anchor tenant. In each of the alternatives, the pond and the ditch come to play in the development of the site. A careful examination of the locations shown on Alternatives A-D reveals that the only way for the major retail tenant to address all three thoroughfares as well as providing 6 retail outparcels is to situate the rear of the retail center toward the eastern property line. This configuration also allows delivery and service vehicles to approach the retail space from the blind side of the site. It is apparent that this site is unique. DEM - Water Quality Enclosure: General Permit SEA/ae Project Summary and Mitigation Considerations Waterside Crossing will play a major role in the commercial and retail market in east Lincoln County. The project developers have made every effort possible to produce a quality development and conform to all "current regulations" and zoning requirements. The preliminary planning for this development began in 1996 and was rezoned with preliminary site plan approval issued by Lincoln County January 20, 1997. A project layout was developed based on "current regulations" at that time. Engineering design followed with submittal to NCDENR, Land Quality Section on October 13, 1997, approval was issued on October 28, 1997. Approvals did not mention additional permit requirements during the review and approval process and construction began based on approved plans. The engineer of record for the project became aware of regulation changes regarding stream disturbances while attending the North Carolina Erosion and Sedimentation Control Design Workshop. Once aware of the new regulations, the engineer alerted the USACE, Asheville Regulatory Field Office and initiated pre-application consultations with the Corps and NCDENR, Division of Water Quality. A stormwater quality BMP will be incorporated into the project buffers adjacent to NC Hwy. 16 and NC Hwy. 73 to meet NCDWQ requirements. Approximately 0.47 acres of wetlands will be incorporated in the BMP littoral shelf and forebay areas. The developer agrees to a 1:1 stream mitigation ratio. In lieu of a 2:1 stream mitigation ratio, the developer offers to provide a stream protection buffer along approximately 600 linear feet of stream in the same watershed as the stream disturbance. The stream is located on a 28 acre parcel in the northwest quadrant of NC Hwy. 16 and NC Hwy. 73. A conditional use plan has been approved for this site with a density of 10 units per acre. Barringer. This meeting was the result of various. violations of State and Federal wetland regulations. As a result of this inspection, it was determined that approximately 600' of stream has been placed in culvert without proper authorization and that an undetermined quantity of wetlands (<1 acre) had also been filled without the proper Federal and State authorization. These actions are violations of the Federal Clean Water Act. As was discussed during the site visit, in addition to the 2:1 stream mitigation required of you by the U.S. Army Corps of Engineers (USACOE), you will also be required by Section 401 of the Federal Clean Water Act to comply with additional conditions required by NCDWQ. These requirements will include (but may not be limited to) the installation and maintenance of a stormwater pond. This requirement was the main focus of the meeting and many, many potential options for placement and design of this stormwater pond were examined NCDWQ understands that ? this project wii! now require an Individual Permit (IP) by USACOE. As was discussed, you will also be required :o apply to The North Carolina Division of Water Quality for a 401 Water Quality Certification If you can reduce your stream impacts to less than or equal to 150' then stream mitigation will not be required by NCDWQ.
