After reviewing your application, we have decided that this impact is covered by General Water Quality Certification Number 3099. This Certification allows you to use Nationwide Permit Number 030 when it is issued by the Corps of Engineers. In addition, you should, get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This replaces the Certification issued on May 12, 1998. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. The four sites are: Beatty's Ford Access Area on Lake Norman, Lincoln County Long Island Access Area on Lake Norman, Catawba County Neck Road Access Area on Mt. Island Lake, Mecklenburg County Castle Bridge Access Area on Lake Rhodhiss, Caldwell County Duke Power Company is requesting 401 Water Quality Certification from the North Carolina Division of Water Quality for the four above referenced projects. The NCWRC has reviewed information provided by the applicant, and field biologists on our staff are familiar with habitat values of the project area. A site visit was conducted to the Long Island Access Area on May 29, 1998. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Based on review of the submitted plans, we have no objection to improvements at the four access areas provided that the following conditions are implemented: 1. Stringent erosion control measures should be installed where soil is disturbed and maintained until project completion. 2. Temporary or permanent herbaceous vegetation should be planted on all bare soil within 15 days of ground disturbing activities to provide long-term erosion control. The project is located in Lincoln County, North Carolina off of Unity Church Road. CURRENT CONDITION OF SITE The existing site is comprised with a paved parking lot, 3 boat ramps and a wooden pier. The area to be used for the new ramps, piers and parking lot expansion is the grassy area surrounding the current site. PROPOSED DEVELOPMENT Remove 3 existing ramps, install 4 new boat ramps, 2 loading piers, plus build, pave and light parking lot. Construction activities are not planned to start until 1999. The scope of this project will include: - Installation and removal of erosion control devices - Removal of existing boat ramps and pier. - Clearing and removal of debris as necessary to accommodate project layout. - Grading, graveling and paving of new ramp turnaround area and the area necessary to tie the new ramp area into the existing parking lot to sustain light duty traffic. Asphalt curbing shall be placed along the turnaround and the parking lot edge. Expect entire parking lot will need to be paved. - Preparation of ramp bed for (4) 120 foot long boat ramps with class B riprap (five inch to 15 inch diameter stone). - Installation of (4) 120 foot concrete boat ramps. Ramps expected to be constructed of 7 inch thick reinforced concrete mat with curbing to specified dimensions. - Installation of 10 foot wide by six inch thick concrete apron to adjoin boat ramps with concrete curb extending from ramp to edge of concrete apron. - Installation of (2) 100 foot long loading piers and concrete pier abutments for access. Piers shall be located between the concrete ramps. Any piles required for pier should be installed prior to installation of rock for ramps to avoid having to drive piles through the riprap. Pier design and installation shall be negotiated and purchased from Gator Dock Company. - Finish grading and grassing and/or rocking of edges along entrance road and parking lot, shoreline and other structural components to establish natural erosion control. - Installation of new trash can pad. - Installation of FERC regulatory signs. r NNI - El F.r «« y s? The project is located in Mecklenburg County, North Carolina off of Road 2074. CURRENT CONDITION OF SITE The existing site is comprised with a paved parking lot, 1 boat ramp and a wooden pier. The area to be used for the new ramps, piers and parking lot expansion is the grassy area surrounding the current site. PROPOSED DEVELOPMENT Remove 1 existing ramp, install 2 new boat ramps, 1 loading pier, expand pave and light parking lot. Construction activities are not planned to start until 1999. The scope of this project will include: - Installation and removal of erosion control devices - Removal of existing boat ramps and pier. - Clearing and removal of debris as necessary to accommodate project layout. - Grading, graveling and paving of entire site to sustain light duty traffic. Asphalt curbing shall be placed along the turnaround and the parking lot edge. - Preparation of ramp bed for (2) 110 foot long boat ramps with class B riprap (five inch to 15 inch diameter stone). - Installation of (2) 110 foot concrete boat ramps. Ramps expected to be constructed of 7 inch thick reinforced concrete mat with curbing to specified dimensions. - Installation of 10 foot wide by six inch thick concrete apron to adjoin boat ramps with concrete curb extending from ramp to edge of concrete apron. - Installation of (1) 100 foot long loading pier and concrete pier abutment for access. Pier shall be located between the concrete ramps. Any piles required for pier should be installed prior to installation of rock for ramps to avoid having to drive piles through the riprap. The project is located in Catawba County, North Carolina off of Road 1904. CURRENT CONDITION OF SITE The existing site is comprised with a gravel parking lot, 1 boat ramp and a wooden pier. The new site is located about 1800 feet upstream of current site in a dense mature wooded area. PROPOSED DEVELOPMENT Retire old site, develop new site by installing 2 new boat ramps, and 1 loading pier, lighted and paved parking lot with 50 to 60 spaces and paved entrance road. Intentions are to begin construction towards the latter part of 1998. Only clearing and rough grading is planned to be performed in 1998. All ramp work, pier work, paving work and final site prep activities are planned for 1999. The scope of this project will include: - Installation and removal of erosion control devices - Removal of existing boat ramps and pier. - Clearing and removal of debris as necessary to accommodate project layout. - Grading, graveling and paving of entire site to sustain light duty traffic. Asphalt curbing shall be placed along the turnaround and the parking lot edge. - Preparation of ramp bed for (2) 120 foot long boat ramps with class B riprap (five inch to 15 inch diameter stone). - Installation of (2) 120 foot concrete boat ramps. Ramps expected to be constructed of 7 inch thick reinforced concrete mat with curbing to specified dimensions. - Installation of 10 foot wide by six inch thick concrete apron to adjoin boat ramps with concrete curb extending from ramp to edge of concrete apron. - Installation of (1) 100 foot long loading pier and concrete pier abutment for access. Pier shall be located between the concrete ramps. Any piles required for pier should be installed prior to installation of rock for ramps to avoid having to drive piles through the riprap.
