On 15 April 1998, Mr. Eric Galamb performed an on-site visit to determine compliance with the Neuse Buffer rules (15A NCAC 2B .0233). The 20 March 1998 plat map shows a road crossing a forested area between lots 57/52, and 28/29. The Division of Water Quality (DWQ) believes that this crossing would violate the Neuse Buffer rules since there is a practicable alternative to impacting this buffer. Namely, the road crossing could move to connect the two cul-de-sacs between lots 51 and 70. The proposed road in violation of the rule could become two cul-de-sacs without violating the rule provided that the 50 buffer remains intact. The proposed project is located on an UI to Upper Barton Creek. This stream has a water supply classification (WS IV NSW). As a result of that classification, density and buffer requirements must also be met. A local government study can (in our opinion should) occur to reflect the perennial nature of the stream above the proposed road crossing.
