After reviewing your application, we have decided that this impact is covered by General Water Quality Certification Number 3101. This Certification allows you to use Nationwide Permit Number 12 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceec one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. C&A Project No. WN9701 Dear Mr. Hoke: This is in response to your request for determination of possible endangered or threatened species or critical habitats that might be found in the vicinity of the above project. For your information I have enclosed a copy of the NC Natural Heritage Program's Stokes County listing for endangered or threatened species. For site specific information I suggest you contact the NC Natural Heritage Program and/or the US Fish and Wildlife Service, addresses attached. While we have found no endangered fish species in Town Fork Creek, we have collected riverweed darter (Etheostoma podostemone) and bigeye jumprock (Moxostoma ariommum), both state listed as special concern, and roanoke hog sucker (Hypentelium roanokense), state listed as significantly rare. The force main crossing of Town Fork Creek and a tributary branch has the potential to impact these species. To lessen impacts to streams from this project, we offer the following recommendations to further protect aquatic resources: 1) Where crossings are necessary, sewer lines should cross streams at right angles to minimize impacts to riparian areas. 2) Sewer lines crossing streams should be buried in the stream bottom or attached to existing bridges to maintain fish movement upstream and downstream and prevent debris from collecting at the pipe and causing a hydrologic change. We do not recommend installing priers in a stream channel to support a sewer line. .1 3) If concrete will be used, work must be accomplished so that wet concrete does not contact stream water. This will lessen the chance of altering the stream's water chemistry and causing a fish kill. 4) Disturbed stream banks must be restored to original contours and revegetated with native materials such as silky dogwood (Cornus amonum), silky willow (Salix sericea) and hazel alder (Alnus serrulata). Riprap may be used to stabilize the bank below the high water mark (bankful stage), and vegetation must be used above the high water mark. 5) An undisturbed buffer zone should be left between streams and all construction. We prefer a buffer zone of at least 50 feet to control sedimentation into streams, provide shade, and maintain a travel corridor for wildlife. 6) Stringent erosion control measures should be implemented where soil is disturbed and maintained until project completion. 7) Temporary or permanent herbaceous vegetation should be planted on all bare soil within 15 days of ground disturbing activities to provide long-term erosion control. We prefer a "seed as you go" strategy rather than allowing a large area to remain bare. Preference should be give to native seed mixtures. Our design of the wastewater force main does take into account the parameters of your listed guidelines as follows: 1) Our force main is crossing Town Fork Creek at as close to 90° as possible and clearing and disturbance will be limited to the width of.permanent right-of-way (30'). 2) The force main (3") will be buried three feet below the stream bed. 3) The force main will be concrete encased. Specifications call for concrete to be placed, set and backfilled prior to allowing the stream flow back on that particular area. Crossing will be performed during low flow periods with due diligence of attention given to local future weather conditions. In any event, the contractor shall be limited to a three day time of access for the stream crossings. 4) All disturbed stream banks shall be lined with 18" thick rip rap according to local erosion control guidelines and approved erosion control plan. Filter fabric will be installed under the rip rap to prevent future bank erosion from beneath. At one area, near the railroad tracks, we are forced to align closer to Lick Creek because of the railroad right-of-way. 6) An erosion control plan is being submitted for the project and erosion control measures will be maintained during the entire construction period. 7) Temporary or permanent vegetation shall be required for all disturbed areas of the project. For your information I have enclosed a copy of the NC Natural Heritage Program's Stokes County listing for endangered or threatened species. For site specific information I suggest you contact the NC Natural Heritage Program and/or the US Fish and Wildlife Service, addresses attached. While we have found no endangered fish species in Town Fork Creek, we have collected riverweed darter (Etheostoma podostemone) and bigeye jumprock (Moxostoma ariommum), both state listed as special concern, and roanoke hog sucker (Hypentelium roanokense), state listed as significantly rare. The force main crossing of Town Fork Creek and a tributary branch has the potential to impact these species. To lessen impacts to streams from this project, we offer the following recommendations to further protect aquatic resources: 1) Where crossings are necessary, sewer lines should cross streams at right angles to minimize impacts to riparian areas. 2) Sewer lines crossing streams should be buried in the stream bottom or attached to existing bridges to maintain fish movement upstream and downstream and prevent debris from collecting at the pipe and causing a hydrologic change. We do not recommend installing priers in a stream channel to support a sewer line. 3) If concrete will be used, work must be accomplished so that wet concrete does not contact stream water. This will lessen the chance of altering the stream's water chemistry and causing a fish kill. 4) Disturbed stream banks must be restored to original contours and revegetated with native materials such as silky dogwood (Corpus amonum), silky willow (Salix sericea) and hazel alder (Alnus serrulata). Riprap may be used to stabilize the bank below the high water mark (tankful stage), and vegetation must be used above the high water mark. 5) An undisturbed buffer zone should be left between streams and all construction. We prefer a buffer zone of at least 50 feet to control sedimentation into streams, provide shade, and maintain a travel corridor for wildlife. 6) Stringent erosion control measures should be implemented where soil is disturbed and maintained until project completion. 7) Temporary or permanent herbaceous vegetation should be planted on all bare soil within 15 days of ground disturbing activities to provide long-term erosion control. We prefer a "seed as you go" strategy rather than allowing a large area to remain bare. Preference should be give to native seed mixtures. Our design of the wastewater force main does take into account the parameters of your listed guidelines as follows: 1) Our force main is crossing Town Fork Creek at as close to 90° as possible and clearing and disturbance will be limited to the width of permanent right-of-way (30'). 2) The force main (3") will be buried three feet below the stream bed. 3) The force main will be concrete encased. Specifications call for concrete to be placed, set and backfilled prior to allowing the stream flow back on that particular- area. Crossing will be performed during low flow periods with due diligence of attention given to local future weather conditions. In any event, the contractor shall be limited to a three day time of access for the stream crossings. 4) All disturbed stream banks shall be lined with 18" thick rip rap according to local erosion control guidelines and approved erosion control plan. Filter fabric will be installed under the rip rap to prevent future bank erosion from beneath. At one area, near the railroad tracks, we are forced to align closer to Lick Creek because of the railroad right-of-way. 6) An erosion control plan is being submitted for the project and erosion control measures will be maintained during the entire construction period. 7) Temporary or permanent vegetation shall be required for all disturbed areas of the project.
