After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: The applicant proposes to construct ±590' of riprap, a 100' long rock groin, a 15' wide by 5' long boat ramp, a 6' wide by 250' long pier with 2 finger piers and a 16' by 32' boathouse. Edsel G. Barnes Washington County Project Setting . The project site is located off NC 32 on Albemarle Sound at Leonard's Point near Roper in Washington County, North Carolina. The property is bordered on the downstream (east) side by an undeveloped lot wooded tract. The property is bordered on the upstream (west) side by an undeveloped wooded tract. Most of the 26 acre tract is vegetated with upland grasses and pines that were planted for tree farming. A house and barn are under construction approximately 250' from the shoreline. The ±12' elevation above mean sea level creates an erosion bluff at the sound interface with aggressive undercutting of the bank. Albemarle Sound is classified as SB by the Environmental Management Commission. Albemarle Sound at the project site is coastal water but is not open to shell fishing. Project description The applicant proposes to place ±590' of riprap along the shoreline. The riprap will average 3' waterward of the normal water level (NWL) with a maximum distance offshore of 15' in a coved area. The riprap will extend approximately 15' landward of the NWL to a height of 5.5' above the NWL. The applicant proposes to grade the existing 12' bluff down to this established 5.5' height and run a concrete sidewalk along the top of the riprap. A 100' long rock groin with a base width of 12' and a top width of 2' projecting 1.5' above the NWL is proposed. The boat ramp will be constructed at the upstream end of the project site and will be 15' wide and 65' long (5' to be below the NWL). Four feet wide by 20' long finger piers will be constructed on either side of the boat ramp to aid in launching and retrieving boats. A 6' wide by 250' long pier is proposed near the center of the property with a 16' by 30' T-head. Two 4' by 20' finger piers are proposed on the pier ±150' out to create 4 mooring slips. A 16' by 32' boathouse is proposed at the waterward end of the pier with a flat roof and access steps to the roof. Anticipated impacts The project as proposed will result in the filling of ±2,970 ft2 of sound bottom associated with the placement of riprap, rock groin, and the construction of the boat ramp. Grading of the existing bluff will result in the disturbance of ±29,500 ftz of high ground. The construction of the pier, boathouse, and finger piers will result in the shading of ±2,652 ft2 of sound bottom. Blue-line prints or other larger plats are acceptable only if an adequate number of quality copies are provided by applicant.
