After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non- Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Stormwater shall be directed to flow away from the driveway and turnarounds into adjacent vegetation rather than flow directly into surface waters. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROTECT SUMMARY: Applicant is proposing to construct an elevated wood boat ramp, a pier and gravel driveway. ' 9. NARRATIVE DESCRIPTION: The project is located at lot #1 in the Plantation Shores Subdivision in the Town of Cedar Point, Carteret County. The lot is 200' long x 50' wide and is bordered on the south by a small slough off Bogue Sound, on the north by Sunset Drive, to the east by a house and to the west by a mobile home. The applicant is also the developer of Plantation Shores Subdivision which consists of 32 lots off NC Hwy 24. The lot is basically cleared except for a border of oaks and small bushes which average approx. 50' wide near the waters edge. Waterward of this border of trees there is a fringe of Coastal Wetlands approx. 20' wide vegetated mainly with Spartina alterniflora. The slough is approx 107' wide from water edge to water edge. Water depths range from a minus 9" near the marsh edge to a minus 39" approx. 30' beyond the edge of the marsh. Waters at the project site have been classified as SA and are open to the harvesting of shellfish. This area of Bogue Sound is located within Outstanding Resource Waters (ORW). The applicant is proposing to construct an elevated wood boat ramp over the Coastal Wetlands with a pier adjacent to the ramp. The boat ramp would be approx. 64' long x 12' wide. The portion of the ramp on high ground and over the Coastal Wetlands would be elevated and constructed of wood. The approx. 14' long x 12' wide portion of the ramp beyond the Coastal Wetlands would be concrete. A pier 60' long x 6' wide would be built on the east side of the ramp. A gravel driveway would be constructed in the center of the property from Sunset Drive to within 30' of the MHW line. Two turn around areas measuring approx. 20' long x 18' wide would also be constructed. 10. ANTICIPATED IMPACTS: The project as proposed would result in some short term increases in turbidity during the placement of pilings for the ramp and pier. Approx. 400 sq. ft. of Coastal Wetlands would be shaded by the construction of the ramp and pier. Approx. 180 sq. ft. of shallow bottom habitat would be loss due to the placement of the concrete boat ramp in the water. No excavation or fill is being proposed for the installation of the boat ramp. Approx. 180 sq. ft. of open water area would be shaded by the installation of the pier. The body of water at the project site is approx. 107' from water to water. The pier would be located 15' from the riparian property line to the east and 25' from the riparian property line to the west. The pier would extend 30' beyond the edge of the Coastal Wetlands, but would not be beyond the existing pier located on the adjacent property to the west. The pier would also be within the one third rule. The applicant is not proposing any structures or any high ground improvements to the property except for the gravel driveway and two turn around areas. The, driveway and turn around areas would terminate thirty feet from the MHW, and the remainder' of the area to the water would be grassed and seeded. There has been much concern raised by FIELD INVESTIGATION REPORT: BRUCE GOEPEL/CARTERET COUNTY PAGE #3 the neighbors and several letters written concerning whether the project is for private use of the applicant or intended for the use of the subdivision the applicant is developing. According to the Carteret County Land Use Plan (LUP) a public or commercial boat ramp would not be consistent with the LUP. The installation of the gravel driveway and turn around areas would increase the impervious area by 1830 sq. ft. PROTECT SUMMARY: Applicant is proposing to construct an elevated wood boat ramp, a pier and gravel driveway. 9. NARRATIVE DESCRIPTION: The project is located at lot #1 in the Plantation Shores Subdivision in the Town of Cedar Point, Carteret County. The lot is 200' long x 50' wide and is bordered on the south by a small slough off Bogue Sound, on the north by Sunset Drive, to the east by a house and to the west by a mobile home. The applicant is also the developer of Plantation Shores Subdivision which consists of 32 lots off NC Hwy 24. The lot is basically cleared except for a border of oaks and small bushes which average approx. 50' wide near the waters edge. Waterward of this border of trees there is a fringe of Coastal Wetlands approx. 20' wide vegetated mainly with Spartina alterniflora. The slough is approx 107' wide from water edge to water edge. Water depths range from a minus 9" near the marsh edge to a minus 39" approx. 30' beyond the edge of the marsh. Waters at the project site have been classified as SA and are open to the harvesting of shellfish. This area of Bogue Sound is located within Outstanding Resource Waters (ORW). The applicant is proposing to construct an elevated wood boat ramp over the Coastal Wetlands with a pier adjacent to the ramp. The boat ramp would be approx. 64' long x 12' wide. The portion of the ramp on high ground and over the Coastal Wetlands would be elevated and constructed of wood. The approx. 14' long x 12' wide portion of the ramp beyond the Coastal Wetlands would be concrete. A pier 60' long x 6' wide would be built on the east side of the ramp. A gravel driveway would be constructed in the center of the property from Sunset Drive to within 30' of the MHW line. Two turn around areas measuring approx. 20' long x 18' wide would also be constructed. 10. ANTICIPATED IMPACTS: The project as proposed would result in some short term increases in turbidity during the placement of pilings for the ramp and pier. Approx. 400 sq. ft. of Coastal Wetlands would be shaded by the construction of the ramp and pier. Approx. 180 sq. ft. of shallow bottom habitat would be loss due to the placement of the concrete boat ramp in the water. No excavation or fill is being proposed for the installation of the boat ramp. Approx. 180 sq. ft. of open water area would be shaded by the installation of the pier. The body of water at the project site is approx. 107' from water to water. The pier would be located 15' from the riparian property line to the east and 25' from the riparian property line to the west. The pier would extend 30' beyond the edge of the Coastal Wetlands, but would not be beyond the existing pier located on the adjacent property to the west. The pier would also be within the one third rule. The applicant is not proposing any structures or any high ground improvements to the property except for the gravel driveway and two turn around areas. The driveway and turn around areas would terminate thirty feet from the MHW, and the remainder of the area to the water would be grassed and seeded. There has been much concern raised by FIELD INVESTIGATION REPORT: BRUCE GOEPEL/CARTERET COUNTY PAGE #3 the neighbors and several letters written concerning whether the project is for private use of the applicant or intended for the use of the subdivision the applicant is developing. According to the Carteret County Land Use Plan (LUP) a public or commercial boat ramp would not be consistent with the LUP. The installation of the gravel driveway and turn around areas would increase the impervious area by 1830 sq. ft.
