PROJECT SUMMARY: The applicant proposes to construct a private community pier 488' long by 6' wide with a 75' long by 8' wide floating dock which will provide docking space for six boats. . Mathias Epstein Page Two 9. PROJECT DESCRIPTION: The project site is located at the intersection of Summer Rest Road (NCSR 1417) and Beech Street (NCSR 1416) in New Hanover County. The property is adjacent to the Intracoastal Waterway (Wrightsville Sound) and is approximately 1,400' north of the US Highway 74/76 drawbridge. The property is directly across the Intracoastal Waterway from Lee's Cut. The High ground property is approximately 46' wide by 109' deep. The southern property boundary is an extension of the centerline of Beech Street. Near Summer Rest Road the site is approximately 22' above mean sea level but drops sharply to coastal marsh. Between the edge of high ground and the Intracoastal Waterway there is a 488' wide expanse of Smooth Salt Marsh Cordgrass marsh (Spanina alterniflora). Starting at approximately 200' into the marsh there is a channel that is seminavigable at high tide. The Intracoastal Waterway adjacent to the project site is approximately 600' across. The Wilmington-New Hanover County Land Use Plan classifies the area as Conservation. The applicants property is at the Division of Water Quality's classification dividing line for the Class SB# waters of the Wrightsville Recreational Area and the Class SA waters of the Intracoastal Waterway. The area is not designated as a Primary Nursery Area by the Division of Marine Fisheries and is closed to the taking of shellfish. The applicant is proposing to construct a private community pier 488' in length by 6' wide connected to a 75' by 8' floating dock which will provide docking space for six boats. At approximately 253' from mean high water (MHW) the applicant is proposing to construct an elevated section spanning the most navigable area of the small channel through the marsh. The elevated section will be 16' long and will provide a clearance of 6'-8' above MHW. Water depths at the floating dock would range from 0' to -8' at mean low water. Total project length will be approximately 578' or approximately 90' waterward of the edge of marsh. . 10. ANTICIPATED 51PACTS: The project as proposed will result in the shading of 2,928 sq. ft. of Spartina alterniflora, and will incorporate approximately 600 sq. ft. of Public Trust Area. The project will not extend more than 1/3 the width of the water body, will terminate approximately 115' from the near bottom edge of the federally maintained channel and can be constructed within the applicants riparian corridor, per the revised survey dated 02/09/98. Staff review of the plans and specifications has determined that the development activities proposed will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H. 1000. By copy of this letter, we are informing you that your project will not require a stormwater management permit. Please keep in mind that this determination does not relieve you of your legal responsibility to obtain other permits which may be required by the Division of Water Quality, the Division of Land Resources, Coastal Areas Management Act, Federal, State, or Local Governments. In addition, any future modifications to the project will require additional review from this Office to assure that stormwater impacts are not an issue. Mathias Epstein Page Two 9. PROJECT DESCRIPTION: The project site is located at the intersection of Summer Rest Road (NCSR 1417) and Beech Street (NCSR 1416) in New Hanover County. The property is adjacent to the Intracoastal Waterway (Wrightsville Sound) and is approximately 1,400' north of the US Highway 74/76 drawbridge. The property is directly across the Intracoastal Waterway from Lee's Cut. The High ground property is approximately 46' wide by 109' deep. The southern property boundary is an extension of the centerline of Beech Street. Near Summer Rest Road the site is approximately 22' above mean sea level but drops sharply to coastal marsh. Between the edge of high ground and the Intracoastal Waterway there is a 488' wide expanse of Smooth Salt Marsh Cordgrass marsh (Spartina alterniflora). Starting at approximately 200' into the marsh there is a channel that is seminavigable at high tide. The Intracoastal Waterway adjacent to the project site is approximately 600' across. The Wilmington-New Hanover County Land Use Plan classifies the area as Conservation. The applicants property is at the Division of Water Quality's classification dividing line for the Class SB# waters of the Wrightsville Recreational Area and the Class SA waters of the Intracoastal Waterway. The area is not designated as a Primary Nursery Area by the Division of Marine Fisheries and is closed to the taking of shellfish. The applicant is proposing to construct a private community pier 488' in length by 6' wide connected to a 75' by 8' floating dock which will provide docking space for six boats. At approximately 253' from mean high water (MHW) the applicant is proposing to construct an elevated section spanning the most navigable area of the small channel through the marsh. The elevated section will be 16' long and will provide a clearance of 6'-8' above MHW. Water depths at the floating dock would range from 0' to -8' at mean low water. Total project length will be approximately 578' or approximately 90' waterward of the edge of marsh. . 10. ANTICIPATED IMPACTS: The project as proposed will result in the shading of 2,928 sq. ft. of Spartina alterniflora, and will incorporate approximately 600 sq. ft. of Public Trust Area. The project will not extend more than 1/3 the width of the water body, will terminate approximately 115' from the near bottom edge of the federally maintained channel and can be constructed within the applicants riparian corridor, per the revised survey dated 02/09/98.
