After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 211 .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Pond shall be designed to release cold water from the bottom or middle of the pond to assure temperature control downstream. Construction in the channel shall not be done before April 1, 1998. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Side Campground, to construct a pond on an unnamed tributary to Meadow Fork Creek, Alleghany County. Mr. Herman Bennett, Mt. Side Campground, Rt. 1 Miller Road, Laurel Springs, North Carolina 28644 is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit from the U.S. Army Corps of Engineers. A site visit was conducted with Mr. Bennett on March 6, 1998. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Mr. Bennett proposes to construct a pond, less than one acre in size, on a small tributary to Meadow Fork Creek, which is NCWRC Designated Public Mountain Trout Water managed as Hatchery Supported. The purpose of the project is to provide a trout catch-out pond for tourists and individuals staying at Mt. Side Campground. Mr. Bennett currently maintains a small trout hatchery in the unnamed tributary just above the proposed lake site. Less than 150 linear feet of stream channel (estimated average width is 3 feet) will be impounded. Pond construction will occur in a agricultural field and old growth field. No wetlands were observed on the site. Based on the information provided by the applicant during the site visit, we have no objection to the project as proposed provided the following conditions are implemented: 1. Instream work and land disturbance within the 25-foot wide buffer zone are prohibited during the trout spawning season of October 15 through April 1 to protect the egg and fry stages of in Meadow Fork Creek from off-site sedimentation. 2. Stringent erosion control measures should be installed where soil is disturbed and maintained until project completion. r? 3. Permanent herbaceous vegetation in disturbed areas should be established within 10 days of ground disturbing activities to provide long term erosion control. We prefer a "seed as you go" strategy rather than allowing a large amount of soil to lay bare. 4. During pond construction, work in the live stream flowing through the new pond site should be avoided as much as possible to lessen downstream sedimentation impacts. 5. The pond outlet structure (standpipe) should be designed to release cool water drawn from the bottom of the pond.
