After reviewing your application, we have decided that this impact is covered by General Water Quality Certification Number 3106. This Certification allows you to use Nationwide Permit Number 18 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non- Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. X115 l 12 March 1998 Dear Mr. Dorney: Enclosed is a permit application package for repairs to the dam on Lake Tabor in Columbus County. The dam on Lake Tabor failed during Hurricane Fran in September 1996. Funding has been secured to repair the dam. Repairs to the dam will consist of building a new sheet-pile spillway and upgrading the existing dam profile to meet State dam safety standards. The repairs will involve some minor filling, primarily to repair erosion of the dam profile, and the removal of trees and stumps from the back of the dam. The Army Corps of Engineers has determined that this action can be permitted under Nationwide Permit 18. All work will be conducted within areas previously disturbed by dam construction or maintenance. Jurisdictional wetlands on the lakeside of the dam are partially superimposed on the old dam fill profile. Part of this area is bare sand and mud and part is vegetated with soft rush (Juncus effusus) and dogfennel (Eupatorium capillifolium). ;Te land below the dam has 3 distinct plant communities, plus the primary outfall canal (Grissett Swamp) and a secondary (man-made) canal. The southernmost plant community consists only of turfgrass and is all upland. There is an upland area between the outfall canals that is primarily forested with loblolly pine (Pinus taeda), sweet gum (Liquidambar styraciflua) and swamp chestnut oak (Quercus michauxii), with a turfgrass ground cover. The northernmost community is a scrubby mixture of sweet gum, red maple (Acer rubrum) redbay (Persea palustris) and Chinese privet (Ligustrum sinense). This area is a mixture of upland and jurisdictional wetland that occurs on previously disturbed soils. No mature swamp or bottomland forest will be impacted by this project.
