Dear Mr. Baker:
You have our approval, in accordance with the attached conditions, to place fill material in various lengths of
stream channels for the purpose of repairing and stabilizing the streambanks. It was described in your application dated
January 21,1998 for project sites on Jerry, Roaring, Martin, Powder Mill and Henson Creeks, Molly Branch and North
Toe River: RC 1A, RC 1B, RC 1C, RC 1D, RC 3A, RC 3B, RC 3C, RC 3D, RC 3E, RC 1E, NT.1, NT 3, MC 4A, MC 4B,
MB 1A, MB 1B, MB 1C, JC 4, PM IA, PM 1B, PM 1C, PM 1D, HC IA, HC 1B, HC 1C, HC 1D, HC IF, HC 1F, HC 1G.
After reviewing your application, we have decided that this fill is covered by General Water Quality Certification
Number 3115. This Certification allows you to use Nationwide Permit Number 37 when the Corps of Engineers issues
it. In addition, you should get any other federal, state or local permits before you go ahead with your project including
(but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed
regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application for a new certification. If the property
is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre,
compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you
must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a heating, send a written petition which conforms
to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447,
Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If

MC4 B. Located 500' downstream from end of SRI 134.
Crcekbed has filled with rock, diverting water in three directions, undermining State
!toad and posing threat to 3 homes from even minor flooding, Repair vertical banks.
400' stretch (,minor work).
MC4 A Locatcd 29 mUes up Martin's Srancb.
Need to dip and Maui out rock to give channel some capacity. Water will flow overland
with minor flooding toward barn and home now. 300' stretch.

1, 5()o' upstream from mouth of Puncheon Camp Branch approximately
300 feet section of streambank should be stabilized with rootwads. 13atlk
is now 4' to 6' in height and vertical, void of auy vegetation.
2. Beginning approximately 1000' upstream from site #1 and progressing
upstream past burleson 'fruck Uarage 500' area needs removal of stone
to regain Capacity. Am area some 500' in length will need filling between
stream and highway where flood washed a major ditch out.
3. Located across highway from Christmas tree on roaring Greek
Road area approximately 200' in lend will need removal of large stone
to prevent flooding Of highway. Flood has narrowed channel to 5' is
spots.
4. Starting at bridge at Mollie Branch and progressing downstream
4ppro&ii uculy 500' -- strtm chmmel is loaded with large swue reduQiug
capacity. An area approximately 100' just below bridge needs bank
stabilization. Most of the stone is this section can be used in this section.

1, 500' upstream from Roaring Creek Road - gravel and stone needs
removal from a 150' section of stream.. TWQ Low water bridges plus
debris has caused this section to fill _ reducing capacity.
2. 1000' upstream from Moaning Creek Road A 200' section of stream
needs stone removal - heavily toaded with large stone. Approximately
50' of streambank needs repair due to water being fereed against
unprotected bank.
. BOO' T Tf stream .-1000' section of streambank needs channel restoration
and/or stone removal. `his section of Jerry Creek is where heaviest
damage took place- Area where home washed away will be uLost
difficult to repair .-large stone pis in piRce to help with stabilization.

Located above 131 drive on left after passing church. Severely eroded
streambanlc needs root wad placement to prevent further degradation of land
adjaccut to homesite_ Will dip excess gravel for backfill use. Approximately
150' strotch.
FM1B.
3 50' stretch located directly above 1 st State Bridge on Powdermill Road and
ending at Marble Lane. 3 homes are receiving severe erosion of front yard,
propose to dip , kil MI to stabilize. Need to haul large stone to protect toe of
hank. Upstream encl of site is filled to the extent of State, load flooding with
small rain.
PM 1 C.
Excavation of channel is necessary to provide storage for
stormwater. Ch=ne l now poses s threat to louse trailer and gauge.
Approximately 200' long located 300' above Pat-Bess Laue_ Will truck out
excess.
PM 1 D.
Located fium 100' below F. J, Joues IAua upstream to State Bridga. 200'
section. Deed to dip and place in order to protect foundation of walkbridge.
These people do no have a drive and walkbridge is the only access to home.
