Box 789 Edenton, North Carolina October 21, 2019 DEQ-DEMLR Stormwater Program Attn: Jeanette Powell 1612 Mail Service Center Raleigh, NC 27699-1612 Re: Notice of Deficiency (NOD-2019-PC-0211) The Fund for Sandy Point North Carolina NPDES MS4 Permit No. NCS000517 Chowan County Dear Ms Powell: I am in receipt of your letter dated October 2, 2019, respecting the subject matter referenced above.   Please note: it is important to the Sandy Point team, my partners and our engineers, that we correctly resolve the issue you raised in your October 2nd letter respecting the expiration date of the subject permit, which was issued July 25, 2017. In your letter, you state that the published expiration date of July 24, 2025, is a typographical error and, further, that the correct expiration date is July 24, 2022. With respect, we would like to discuss the extant permit’s expiration date with you, as the term of Sandy Point’s other State permits were retroactively extended for up to three years based on two Permit Extension Acts. We would very much like to meet with you in your office at your earliest convenience to discuss the options proposed in your October 2nd letter and, of course, the permit expiration issue raised in your letter.
