After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specked in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A N(_'AC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Y FIELD INVESTIGATION REPORT: CAROLINA ATLANTIC SEAFOOD ENTERPRISES/CARTERET COUNTY (POINT MARINA) PAGE #2 9. NARRATIVE DESCRIPTION: Project Setting CAMA Major Permit #107-84 was issued to Mr. C. H. Piner, III on 6/6/84 and authorized the development of a commercial marina complex at the "point" on Radio Island, in Carteret County. Located adjacent Morgan Creek and Beaufort Channel, the marina project included the construction of a drystack storage building, a ship's store, a parking lot, a boat launching ramp, 976' of bulkhead and a primary dock with 36 boat slips. The project has subsequently been renewed nine times. In September of 1997, the project was transferred to Carolina Atlantic Seafood Enterprises. Currently, the permit expires on December 31, 1999. According to information in the file, back in the late 1960's, the entire 1000' of shoreline on the 3-acre tract was bulkheaded. Subsequent failure of that bulkhead has caused severe erosion to the high ground site, leaving a sandy shoreline. Currently, only the derelict bulkhead and a row of dock pilings are the only development activities evident on the site. Also in the file, it was stated that the project site was used in late 1983 as a spoil disposal site for the Morgan Creek channel project which was sponsored by the Corps of Engineers. It does appear that the pilings driven in 1997 are within the Corps setback along the Federally Authorized Channel and they have requested that the pilings be removed from that setback area. The "as permitted" plat dated revised 5-14- 84 is attached to the current application. Access to the site is through an easement agreement with the adjacent property owner. Spot elevations on the tract indicate that the tract is between 6' and 12' in elevation. Water depths along the project area.adjacent to Morgan Creek grade down to the -6' contour line just outside the Corps Setback Line. On around the "point", the -6' contour line is some 70' from the MHW. The waters are classified SC and are closed to shellfishing. Project Description The applicant proposes to redesign the permitted marina complex. Specifically, the applicant proposes to reconfigure the docks, relocate the boat launching ramp, increase the number of wet slips from 36 to 44, change a section of permitted wooden bulkhead to rock rip rap and extend the bulkhead waterward of the MHW at the immediate "point", expand the area to be excavated, and completely modify the upland development activities including changing the size and location of the drystack storage, parking lots and clubhouse. The major elements of the project include the following: FIELD INVESTIGATION REPORT: CAROLINA ATLANTIC SEAFOOD ENTERPRISES/CARTERET COUNTY (POINT MARINA) PAGE #3 The docks - The latest proposal includes constructing twenty 18' X 40' slips adjacent to Morgan Creek. A 6' wide wooden walkway would be located behind the bulkhead and would run 385' along the shoreline. Eleven 3' X 24' finger piers would provide access to the slips. The boat launching area would be relocated on around the extreme "point" and would utilize two floating access docks. The 10' wide docks would form a 35' wide "basin" area that would serve as the boat launching facility. The northern most access dock associated with the boat launching facility would be 10' wide and would extend 90' into the water with a 10' wide X 165' long "L" shaped platform extending to the north. The southern most access dock would extend out 110' and would have a 10' wide X 55' long "L" shaped platform at the waterward end. This dock would serve as the fuel dock for the marina. It appears that the pilings for these structures would be on the Corps Setback Line with the outer 5' of the floating "L" platforms encroaching into the Setback area. Another dock would originate near the southern end of the property. This structure measures 10' wide X 170' long and has a 10' X 290' "T"-shaped floating platform. Sixteen 18' X 50' slips would be located on the outside of the platform and nine 3' X 24' finger piers would provide access to the slips. Eight 18' X 40' slips would be located on the inside of the platform and four 3' X 20' finger piers would provide the access to those slips. Permanent live-aboards would not be permitted but transient live- aboards would be permitted with a locked head policy. The bulkhead - The existing permit authorizes the bulkheading of the shoreline along the MHW. The current proposal deviates from that permit by cutting back into the high ground along a 200' section along Morgan Creek, but also extending out into the water along a 130' section at the extreme "point". Along this section of shoreline, the bulkhead would average about 10' waterward of the MHW and would extend a maximum distance of 17' to 18'. In addition to modifying the bulkhead alignment along the 970' of shoreline as stated above, the southern most 380' of shoreline would be stabilized by rock rip rap under the current proposal The proposed alignment would place the toe of the rock approximately 5' waterward of the MHW. Excavation - Excavation is proposed along Morgan Creek and around the "Point" down to the boat launching "basin" area. Excavation would extend to the -6' contour line, some- 60' to 70' waterward of the from the MHW. The total area below MHW to be excavated measures approximately 570' X 36' or 20,700 ftZ. The average existing depth is -2' and excavation is proposed to -6. Two areas behind the old deteriorated bulkhead would also be excavated. The first area is located adjacent Morgan Creek and involves approximately 1,250 fO and the other area is where the boat launching area would be located and involves approximately 3,250 fe. The original boat launching facility involved an area 100' X 50'. All proposed excavation would be accomplished with a dragline and the spoils would be placed on the site and graded according to the plans. FIELD INVESTIGATION REPORT: CAROLINA ATLANTIC SEAFOOD ENTERPRISES/CARTERET COUNTY (POINT MARINA) PAGE #4 Highground development - The existing permit authorized a 30,000 fe drystack storage that was capable of handling 250 boats inside and another 100 outside. The existing permit also authorizes a 5,000 fe ship's store with .showers and toilets as well as the associated septic area and a graveled parking lot. The current proposal includes a 25,000 fe 128-boat drystack storage facility and a 900 fe clubhouse. According to the application, the entire high ground would be graded after the excavation was conducted and the shoreline stabilization measures have been installed. It appears that there would be 102 asphalt and/or turfstone parking spaces. Underground fuel tanks for the fuel docks would be located near the southern property boundary. Based on information from the applicant, appropriate stormwater plans have been submitted. Anticipated Impacts Installation of the docks and 44 wet slips would result in the usurpation of approximately 47,650 fO of Public Trust Areas and Estuarine Waters. The proposed excavation would disturb approximately 20,700 fe of sandy bottom habitat and would remove approximately 3,600 yds3 of sandy substrate. Based on the dredging activities within Morgan Creek during 1983, the proposed dredging should produce little or at least no substantial impact on Morgan Creek, especially since there are no wetlands or SAVs at the project site. Approximately 3,025 fe of fill material would be place below MHW as a result of the installation of the bulkhead and rip rap. The entire tract or 129,386 fO would be disturbed during construction. After construction of the drystack storage, clubhouse, parking lots, and septic system installation and underground fuel storage, the impervious area within the Estuarine Shoreline AEC would be 17,343 ftz or 28.1 %. Essentially, the impervious areas within the AEC are concentrated in the boat launching facility area and any water quality concerns should be addressed in the stormwater plan. No sedimentation and erosion control plan was submitted. The docks are located outside but immediately adjacent to the Corps setback line along Morgan Creek. It does appear that the last slip up Morgan Creek is within 15' of the common riparian line. No waivers were submitted with the application package. Likewise, the outside 5' of the floating docks associated with the boat launching area do extend beyond the Corps setback line. Clarification from the Corps regarding floating dock encroachment is needed. Containment booms in conjunction with petroleum absorbent medium will be available at the launching apron in the event of a fuel spillage. M. The project involves reconfiguring the docks, expanding the number of slips to 44, modifying the bulkhead alignment, conducting excavation within the docking area and modifying the upland development including reducing the drystack storage capacity to 128 boats. r FIELD INVESTIGATION REPORT: CAROLINA ATLANTIC SEAFOOD ENTERPRISES/CARTERET COUNTY (POINT MARINA) PAGE #2 9. NARRATIVE DESCRIPTION: Project Setting CAMA Major Permit #107-84 was issued to Mr. C. H. Piner, III on 6/6/84 and authorized the development of a commercial marina complex at the "point" on Radio Island, in Carteret County. Located adjacent Morgan Creek and Beaufort Channel, the marina project included the construction of a drystack storage building, a ship's store, a parking lot, a boat launching ramp, 976' of bulkhead and a primary dock with 36 boat slips. The project has subsequently been renewed nine times. In September of 1997, the project was transferred to Carolina Atlantic Seafood Enterprises. Currently, the permit expires on December 31, 1999. According to information in the file, back in the late 1960's, the entire 1000' of shoreline on the 3-acre tract was bulkheaded. Subsequent failure of that bulkhead has caused severe erosion to the high ground site, leaving a sandy shoreline. Currently, only the derelict bulkhead and a row of dock pilings are the only development activities evident on the site. Also in the file, it was stated that the project site was used in late 1983 as a spoil disposal site for the Morgan Creek channel project which was sponsored by the Corps of Engineers. It does appear that the pilings driven in 1997 are within the Corps setback along the Federally Authorized Channel and they have requested that the pilings be removed from that setback area. The "as permitted" plat dated revised 5-14- 84 is attached to the current application. Access to the site is through an easement agreement with the adjacent property owner. Spot elevations on the tract indicate that the tract is between 6' and 12' in elevation. Water depths along the project area adjacent to Morgan Creek grade down to the -6' contour line just outside the Corps Setback Line. On around the "point", the -6' contour line is some 70' from the MHW. The waters are classified SC and are closed to shellfishing. Project Description The applicant proposes to redesign the permitted marina complex. Specifically, the applicant proposes to reconfigure the docks, relocate the boat launching ramp, increase the number of wet slips from 36 to 44, change a section of permitted wooden bulkhead to rock rip rap and extend the bulkhead waterward of the MHW at the immediate "point", expand the area to be excavated, and completely modify the upland development activities including changing the size and location of the drystack storage, parking lots and clubhouse. The major elements of the project include the following: FIELD INVESTIGATION REPORT: CAROLINA ATLANTIC SEAFOOD ENTERPRISES/CARTERET COUNTY (POINT MARINA) PAGE #3 The docks - The latest proposal includes constructing twenty 18' X 40' slips adjacent to Morgan Creek. A 6' wide wooden walkway would be located behind the bulkhead and would run 385' along the shoreline. Eleven 3' X 24' finger piers would provide access to the slips. The boat launching area would be relocated on around the extreme "point" and would utilize two floating access docks. The 10' wide docks would form a 35' wide "basin" area that would serve as the boat launching facility. The northern most access dock associated with the boat launching facility would be 10' wide and would extend 90' into the water with a 10' wide X 165' long "L" shaped platform extending to the north. The southern most access dock would extend out 110' and would have a 10' wide X 55' long "L" shaped platform at the waterward end. This dock would serve as the fuel dock for the marina. It appears that the pilings for these structures would be on the Corps Setback Line with the outer 5' of the floating "L" platforms encroaching into the Setback area. Another dock would originate near the southern end of the property. This structure measures 10' wide X 170' long and has a 10' X 290' "T"-shaped floating platform. Sixteen 18' X 50' slips would be located on the outside of the platform and nine 3' X 24' finger piers would provide access to the slips. Eight 18' X 40' slips would be located on the inside of the platform and four 3' X 20' finger piers would provide the access to those slips. Permanent live-aboards would not be permitted but transient live- aboards would be permitted with a locked head policy. The bulkhead - The existing permit authorizes the bulkheading of the shoreline along the MHW. The current proposal deviates from that permit by cutting back into the high ground along a 200' section along Morgan Creek, but also extending out into the water along a 130' section at the extreme "point". Along this section of shoreline, the bulkhead would average about 10' waterward of the MHW and would extend a maximum distance of 17' to 18'. In addition to modifying the bulkhead alignment along the 970' of shoreline as stated above, the southern most 380' of shoreline would be stabilized by rock rip rap under the current proposal The proposed alignment would place the toe of the rock approximately 5' waterward of the MHW. Excavation - Excavation is proposed along Morgan Creek and around the "Point" down to the boat launching "basin" area. Excavation would extend to the -6' contour line, some 60' to 70' waterward of the from the MHW. The total area below MHW to be excavated measures approximately 570' X 36' or 20,700 fe. The average existing depth is -2' and excavation is proposed to -6'. Two areas behind the old deteriorated bulkhead would also be excavated. The first area is located adjacent Morgan Creek and involves approximately 1,250 f' and the other area is where the boat launching area would be located and involves approximately 3,250 fe. The original boat launching facility involved an area 100' X 50'. All proposed excavation would be accomplished with a dragline and the spoils would be placed on the site and graded according to the plans. FIELD INVESTIGATION REPORT: CAROLINA ATLANTIC SEAFOOD ENTERPRISES/CARTERET COUNTY (POINT MARINA) PAGE #4 Highground development - The existing permit authorized a 30,000 ft2 drystack storage that was capable of handling 250 boats inside and another 100 outside. The existing permit also authorizes a 5,000 ft2 ship's store with showers and toilets as well as the associated septic area and a graveled parking lot. The current proposal includes a 25,000 fe 128-boat drystack storage facility and a 900 ft2 clubhouse. According to the application, the entire high ground would be graded after the excavation was conducted and the shoreline stabilization measures have been installed. It appears that there would be 102 asphalt and/or turfstone parking spaces. Underground fuel tanks for the fuel docks would be located near the southern property boundary. Based on information from the applicant, appropriate stormwater plans have been submitted. Anticipated Impacts Installation of the docks and 44 wet slips would result in the usurpation of approximately 47,650 ft2 of Public Trust Areas and Estuarine Waters. The proposed excavation would disturb approximately 20,700 fe of sandy bottom habitat and would remove approximately 3,600 y& of sandy substrate. Based on the dredging activities within Morgan Creek during 1983, the proposed dredging should produce little or at least no substantial impact on Morgan Creek, especially since there are no wetlands or SAVs at the project site. Approximately 3,025 ft2 of fill material would be place below MHW as a result of the installatiorr of the bulkhead and rip rap. The entire tract or 129,386 ft2 would be disturbed during construction. After construction of the drystack storage, clubhouse, parking lots, and septic system installation and underground fuel storage, the impervious area within the Estuarine Shoreline AEC would be 17,343 ft2 or 28.1 %. Essentially, the impervious areas within the AEC are concentrated in the boat launching facility area and any water quality concerns should be addressed in the stormwater plan. No sedimentation and erosion control plan was submitted. The docks are located outside but immediately adjacent to the Corps setback line along Morgan Creek. It does appear that the last slip up Morgan Creek is within 15' of the common riparian line. No waivers were submitted with the application package. Likewise, the outside 5' of the floating docks associated with the boat launching area do extend beyond the Corps setback line. Clarification from the Corps regarding floating dock encroachment is needed.
